Current law waives both of these fees when an application is made to transfer a decedent’s interest in a motor vehicle to his or her surviving spouse or domestic partner. 2023 Senate Bill 60 expands the types of family members who are eligible for a fee waiver when retitling a motor vehicle to transfer a decedent’s interest in the vehicle. Under the bill, the certificate of title fee and supplemental title fee are waived when an application is made to transfer a decedent’s interest in a motor vehicle to an “immediate family member.” For this purpose, immediate family member is defined to mean a spouse, grandparent, parent, sibling, child, stepchild, stepparent, or grandchild, or the spouse of a grandparent, parent, sibling, child, stepchild, stepparent, or grandchild. SENATE AMENDMENT 1 Senate Amendment 1 delays the effective date of Senate Bill 60 until the first day of the seventh month beginning after publication. BILL HISTORY Senator Cowles offered Senate Amendment 1 to Senate Bill 60 on June 6, 2023. On September 14, 2023, the Senate voted to adopt the amendment and pass the bill, as amended.
