1212 AN ACT relating to: a law enforcement officer virtual behavioral health crisis
1313 care pilot program.

1515 This bill directs the Department of Health Services to establish a pilot program
1616 to implement virtual behavioral health crisis care services for use by county or
1717 municipal law enforcement agencies in the field to connect law enforcement officers
1818 who encounter persons in crisis to behavioral healthcare services. Under the bill,
1919 DHS must contract with a private entity to provide virtual behavioral health crisis
2020 care services, including related equipment and training, that provide law
2121 enforcement officers with remote access via two-way audio/video communication to
2222 behavioral healthcare expertise and decision-making support. Then DHS must
2323 identify counties and municipalities to participate in the pilot program to use the
2424 contracted services.
2525 Under the bill, to be eligible to participate in the pilot program a county or
2626 municipality must pay 30 percent of the cost for the equipment and services
2727 contracted for that county or municipality. No more than 50 percent of program
2828 resources may be allocated to counties or municipalities with a population of more
2929 than 50,000, and no more than 10 percent of program resources may be allocated to
3030 a single county or municipality.
3131 No later than May 1, 2025, DHS must collect and report information to the Joint
3232 Committee on Finance on the program's costs and effectiveness.

3939 The people of the state of Wisconsin, represented in senate and assembly, do
4040 enact as follows:
4141 SECTION 1.0Nonstatutory provisions.
4242 (1) LAW ENFORCEMENT OFFICER VIRTUAL BEHAVIORAL HEALTH CRISIS CARE PILOT
4343 PROGRAM.
4444 (a) The department of health services shall establish a pilot program to
4545 implement virtual behavioral health crisis care services for use by county or
4646 municipal law enforcement agencies in the field to connect law enforcement officers
4747 who encounter persons in crisis to behavioral healthcare services.
4848 (b) Within 90 days after the effective date of this paragraph, the department
4949 of health services shall obtain and review proposals using its request-for-proposals
5050 procedure to contract with one or more private entities to provide virtual behavioral
5151 health crisis care services, including related equipment and training, that provide
5252 law enforcement officers with remote access via two-way audio/video
5353 communication to behavioral healthcare expertise and decision-making support.
5454 The department shall enter a contract with a vendor as soon as is practicable after
5555 all proposals have been received.
5656 (c) After the department of health services enters a contract under par. (b), the
5757 department shall identify counties and municipalities to participate in the program
5858 under par. (a) that will receive the services contracted for under par. (b). To be eligible
5959 to participate in the pilot program under par. (a), a county or municipality must pay
6060 30 percent of the cost for the services contracted for under par. (b) for that county or
6161 municipality. No more than 50 percent of the program resources for the program

8787 under par. (a) may be allocated to counties or municipalities with a population of
8888 more than 50,000, and no more than 10 percent of the program resources may be
8989 allocated to a single county or municipality.
9090 (d) The department of health services shall collect all of the following
9191 information as of March 31, 2025, for the pilot program under par. (a), and report it
9292 to the joint committee on finance by May 1, 2025:
9393 1. For each participating county or municipality, how much money was received
9494 under the pilot program and how much money was contributed by the county or
9595 municipality.
9696 2. Which counties and municipalities participated in the program.
9797 3. The number of law enforcement officers that were equipped with the services
9898 provided under the program.
9999 4. The number of incidents in which the services provided under the program
100100 were utilized.
101101 5. Of the incidents in which the services provided under the program were
102102 utilized, the number that were predicted to otherwise have resulted in an
103103 involuntary commitment.
104104 6. Of the incidents in which the services provided under the program were
105105 utilized, the number that ended with the person in crisis remaining in place rather
106106 than requiring some kind of transport.
107107 7. An estimate of how many working hours were saved by utilizing the services
108108 provided under the program.
