99 AN ACT to amend 940.11 (1) and 940.11 (2) of the statutes; relating to: hiding,
1010 burying, or mutilating a corpse to conceal a crime and providing a penalty.
1111 Analysis by the Legislative Reference Bureau
1212 Under current law it is a Class F felony to mutilate, disfigure, dismember, hide,
1313 or bury a corpse if the act is done to conceal a crime or to avoid being apprehended,
1414 prosecuted, or convicted for a crime. This bill increases the penalty to a Class C
1515 felony.
1616 A person who is convicted of a Class F felony is subject to a fine of not more than
1717 $25,000, imprisonment for not more than 12 years and 6 months, or both. A person
1818 who is convicted of a Class C felony is subject to a fine of not more than $100,000,
1919 imprisonment for not more than 40 years, or both.
2020 Because this bill creates a new crime or revises a penalty for an existing crime,
2121 the Joint Review Committee on Criminal Penalties may be requested to prepare a
2222 report.
2323 The people of the state of Wisconsin, represented in senate and assembly, do
2424 enact as follows:
2525 SECTION 1. 940.11 (1) of the statutes is amended to read:

3131 940.11 (1) Whoever mutilates, disfigures, or dismembers a corpse, with intent
3232 to conceal a crime or avoid apprehension, prosecution, or conviction for a crime, is
3333 guilty of a Class F C felony.
3434 SECTION 2. 940.11 (2) of the statutes is amended to read:
3535 940.11 (2) Whoever hides or buries a corpse, with intent to conceal a crime or
3636 avoid apprehension, prosecution, or conviction for a crime or notwithstanding is
3737 guilty of a Class C felony.
3838 (2m) Notwithstanding s. 946.90 (2) or (3), 946.91 (2), 946.92, or 946.93 (2) or
3939 (3), whoever hides or buries a corpse with intent to collect benefits under the
4040 assistance program for families with dependent children administered under ss.
4141 49.141 to 49.161, the Medical Assistance program administered under subch. IV of
4242 ch. 49, or the food stamp program, as defined in s. 49.79 (1) (c), is guilty of a Class
4343 F felony.
