8	8	AN ACT to amend 110.075 (6), 194.05 (4), 194.09, 194.38 (2), 340.01 (8) (a), 340.01
9	9	(8) (b), 343.04 (1) (a), 343.04 (1) (b) and 343.04 (1) (c) (intro.) of the statutes;
10	10	relating to: eliminating references to registered weight for commercial motor
11	11	vehicles and modifying Department of Transportation administrative rules.

13	13	This bill removes a reference to “registered weight" in the statutory definition
14	14	of commercial motor vehicle (CMV) and several other references to the “registered
15	15	weight" of CMVs and other motor vehicles. The bill also removes a reference to
16	16	“registered weight” from a section of Department of Transportation administrative
17	17	rules pertaining to exemptions from motor carrier safety rules.
18	18	Under current law, CMVs are, in part, defined as motor vehicles that have a
19	19	weight rating, a registered weight, or an actual gross weight of over 26,000 pounds.
20	20	The people of the state of Wisconsin, represented in senate and assembly, do
21	21	enact as follows:
22	22	SECTION 1. 110.075 (6) of the statutes is amended to read:
23	23	110.075 (6) The secretary shall set standards and adopt rules to establish a
24	24	plan of inspection to implement the inspection program provided by this section.

34	34	Nothing in this section shall permit the department to promulgate any rule under
35	35	which the provisions of 49 CFR 393 and 396 are applicable to, or enforceable with
36	36	respect to, any farm truck or dual purpose farm truck combined with any semitrailer
37	37	or farm trailer, or any vehicle combined with a horse trailer, if the vehicle
38	38	combination's gross combination weight rating, registered weight, and actual gross
39	39	weight do not exceed 26,000 pounds, the vehicle combination does not include a
40	40	commercial motor vehicle described in s. 340.01 (8) (c) or (d), and the vehicle
41	41	combination is operated solely in intrastate commerce.
42	42	SECTION 2. 194.05 (4) of the statutes is amended to read:
43	43	194.05 (4) This chapter shall not apply to any farm truck or dual purpose farm
44	44	truck combined with any semitrailer or farm trailer, or any vehicle combined with
45	45	a horse trailer, if the vehicle combination's gross combination weight rating,
46	46	registered weight, and actual gross weight do not exceed 26,000 pounds, the vehicle
47	47	combination does not include a commercial motor vehicle described in s. 340.01 (8)
48	48	(c) or (d), and the vehicle combination is operated solely in intrastate commerce.
49	49	SECTION 3. 194.09 of the statutes is amended to read:
50	50	194.09 Marking carrier vehicles. Each motor vehicle operated by a common
51	51	motor carrier of property or of passengers, a contract motor carrier or a private motor
52	52	carrier shall be plainly marked in such manner as the department may prescribe, so
53	53	as to identify such motor vehicle as being operated pursuant to this chapter. This
54	54	section does not apply to any farm truck or dual purpose farm truck combined with
55	55	any semitrailer or farm trailer, or any vehicle combined with a horse trailer, if the
56	56	vehicle combination's gross combination weight rating, registered weight, and actual
57	57	gross weight do not exceed 26,000 pounds, the vehicle combination does not include

88	88	SECTION 4. 194.38 (2) of the statutes is amended to read:
89	89	194.38 (2) Nothing in this section shall permit the department to promulgate
90	90	any rule under which the provisions of 49 CFR 390, 391, 392, 395, and 397 are
91	91	applicable to, or enforceable with respect to, any farm truck or dual purpose farm
92	92	truck combined with any semitrailer or farm trailer, or any vehicle combined with
93	93	a horse trailer, if the vehicle combination's gross combination weight rating,
94	94	registered weight, and actual gross weight do not exceed 26,000 pounds, the vehicle
95	95	combination does not include a commercial motor vehicle described in s. 340.01 (8)
96	96	(c) or (d), and the vehicle combination is operated solely in intrastate commerce.
97	97	SECTION 5. 340.01 (8) (a) of the statutes is amended to read:
98	98	340.01 (8) (a) The vehicle is a single vehicle with a gross vehicle weight rating
99	99	of 26,001 or more pounds or the vehicle's registered weight or actual gross weight is
100	100	more than 26,000 pounds.
101	101	SECTION 6. 340.01 (8) (b) of the statutes is amended to read:
102	102	340.01 (8) (b) The vehicle is a combination vehicle with a gross combination
103	103	weight rating, registered weight or actual gross weight of 26,001 or more pounds
104	104	inclusive of a towed unit with a gross vehicle weight rating, registered weight or
105	105	actual gross weight of more than 10,000 pounds.
106	106	SECTION 7. 343.04 (1) (a) of the statutes is amended to read:
107	107	343.04 (1) (a) Class A. A “Class A" motor vehicle is any combination of vehicles
108	108	with a gross vehicle weight rating, actual gross weight or registered weight of over
109	109	26,000 pounds, if the aggregate total gross vehicle weight rating, or actual gross

137	137	10,000 pounds.
138	138	SECTION 8. 343.04 (1) (b) of the statutes is amended to read:
139	139	343.04 (1) (b) Class B. A “Class B" motor vehicle is any single vehicle with a
140	140	gross vehicle weight rating, or actual gross weight or registered weight of over 26,000
141	141	pounds, and any such vehicle towing a vehicle or vehicles with an aggregate total
142	142	gross vehicle weight rating, actual gross weight or registered weight of 10,000
143	143	pounds or less.
144	144	SECTION 9. 343.04 (1) (c) (intro.) of the statutes is amended to read:
145	145	343.04 (1) (c) Class C. (intro.) A “Class C" motor vehicle is any single vehicle
146	146	with a gross vehicle weight rating, and actual gross weight and registered weight of
147	147	26,000 pounds or less, including any such vehicle towing a vehicle with a gross
148	148	vehicle weight rating, actual gross weight and registered weight of less than 10,000
149	149	pounds, if any of the following applies:
150	150	SECTION 10. Trans 327.09 (7) of the administrative code is amended to read:
151	151	Trans 327.09 (7) The provisions of this chapter do not apply to any farm truck
152	152	or dual purpose farm truck combined with any semitrailer or farm trailer, or any
153	153	vehicle combined with a horse trailer, if the vehicle combination's gross combination
154	154	weight rating, registered weight, and actual gross weight do not exceed 26,000
155	155	pounds, the vehicle combination does not include a commercial motor vehicle
156	156	described in s. 340.01 (8) (c) or (d), Stats., and the vehicle combination is operated
157	157	solely in intrastate commerce.
158	158	SECTION 11.0Effective date.
