1010 AN ACT to create 49.45 (62) and 49.46 (2) (b) 24. of the statutes; relating to:
1111 reimbursement of services to find and sustain housing under the Medical
1212 Assistance program.

1414 This bill directs the Department of Health Services to request from the
1515 secretary of the federal Department of Health and Human Services any waiver of
1616 federal law, state plan amendment, or other federal approval necessary to allow DHS
1717 to reimburse certified providers for services to help recipients of Medical Assistance
1818 find and sustain housing. Under the bill, assistance to find and sustain housing may
1919 include, among other things, financing for utility deposits, payments, or arrears;
2020 payment of security deposits and first month's rent; onetime transition and moving
2121 costs; early detection and intervention for behaviors that may jeopardize housing,
2222 such as late rental payments and lease violations; and assistance with the housing
2323 recertification process. If the federal Department of Health and Human Services
2424 does not approve a waiver of federal law, state plan amendment, or other federal
2525 approval as provided in the bill, DHS is not allowed to reimburse certified providers
2626 for services to help recipients find and sustain housing under the bill. The Medical
2727 Assistance program is a joint federal and state program that provides health services
2828 to individuals who have limited financial resources.

3636 The people of the state of Wisconsin, represented in senate and assembly, do
3737 enact as follows:
3838 SECTION 1. 49.45 (62) of the statutes is created to read:
3939 49.45 (62) HOUSING ASSISTANCE. (a) The department shall request from the
4040 secretary of the federal department of health and human services any waiver of
4141 federal law, state plan amendment, or other federal approval necessary to permit the
4242 department to reimburse certified providers for services to help Medical Assistance
4343 recipients find and sustain housing under the Medical Assistance program under
4444 this subchapter. If a waiver of federal law, state plan amendment, or other federal
4545 approval under this paragraph is granted, the department shall reimburse certified
4646 providers for services to help Medical Assistance recipients find and sustain housing
4747 pursuant to this paragraph and state and federal law and regulations. Assistance
4848 to find and sustain housing may include any of the following services as permitted
4949 under this paragraph:
5050 1. Financing for utility deposits, payments, or arrears.
5151 2. Payment of security deposits and first month's rent.
5252 3. Onetime transition and moving costs.
5353 4. Short-term post hospitalization housing.
5454 5. Education and training on the role, rights, and responsibilities of a tenant
5555 and landlord.
5656 6. Early detection and intervention for behaviors that may jeopardize housing,
5757 such as late rental payments and lease violations.
5858 7. Assistance with the housing recertification process.

8484 8. Coordination with services and service providers for primary care, substance
8585 use disorder treatment, mental health providers, and vocational and employment

8787 (b) If the federal department of health and human services does not approve

8989 (a), the department may not reimburse certified providers for services to help
