10	10	AN ACT to create 49.45 (62) and 49.46 (2) (b) 24. of the statutes; relating to:
11	11	reimbursement of services to find and sustain housing under the Medical
12	12	Assistance program.

14	14	This bill directs the Department of Health Services to request from the
15	15	secretary of the federal Department of Health and Human Services any waiver of
16	16	federal law, state plan amendment, or other federal approval necessary to allow DHS
17	17	to reimburse certified providers for services to help recipients of Medical Assistance
18	18	find and sustain housing. Under the bill, assistance to find and sustain housing may
19	19	include, among other things, financing for utility deposits, payments, or arrears;
20	20	payment of security deposits and first month's rent; onetime transition and moving
21	21	costs; early detection and intervention for behaviors that may jeopardize housing,
22	22	such as late rental payments and lease violations; and assistance with the housing
23	23	recertification process. If the federal Department of Health and Human Services
24	24	does not approve a waiver of federal law, state plan amendment, or other federal
25	25	approval as provided in the bill, DHS is not allowed to reimburse certified providers
26	26	for services to help recipients find and sustain housing under the bill. The Medical
27	27	Assistance program is a joint federal and state program that provides health services
28	28	to individuals who have limited financial resources.

36	36	The people of the state of Wisconsin, represented in senate and assembly, do
37	37	enact as follows:
38	38	SECTION 1. 49.45 (62) of the statutes is created to read:
39	39	49.45 (62) HOUSING ASSISTANCE. (a) The department shall request from the
40	40	secretary of the federal department of health and human services any waiver of
41	41	federal law, state plan amendment, or other federal approval necessary to permit the
42	42	department to reimburse certified providers for services to help Medical Assistance
43	43	recipients find and sustain housing under the Medical Assistance program under
44	44	this subchapter. If a waiver of federal law, state plan amendment, or other federal
45	45	approval under this paragraph is granted, the department shall reimburse certified
46	46	providers for services to help Medical Assistance recipients find and sustain housing
47	47	pursuant to this paragraph and state and federal law and regulations. Assistance
48	48	to find and sustain housing may include any of the following services as permitted
49	49	under this paragraph:
50	50	1. Financing for utility deposits, payments, or arrears.
51	51	2. Payment of security deposits and first month's rent.
52	52	3. Onetime transition and moving costs.
53	53	4. Short-term post hospitalization housing.
54	54	5. Education and training on the role, rights, and responsibilities of a tenant
55	55	and landlord.
56	56	6. Early detection and intervention for behaviors that may jeopardize housing,
57	57	such as late rental payments and lease violations.
58	58	7. Assistance with the housing recertification process.

84	84	8. Coordination with services and service providers for primary care, substance
85	85	use disorder treatment, mental health providers, and vocational and employment
86	86	support.
87	87	(b) If the federal department of health and human services does not approve
88	88	a waiver of federal law, state plan amendment, or other federal approval under par.
89	89	(a), the department may not reimburse certified providers for services to help
90	90	Medical Assistance recipients find and sustain housing under this subsection.
91	91	SECTION 2. 49.46 (2) (b) 24. of the statutes is created to read:
92	92	49.46 (2) (b) 24. Subject to s. 49.45 (62), assistance to find and sustain housing.
