11	11	AN ACT to create 118.60 (3) (am) and 119.23 (3) (am) of the statutes; relating
12	12	to: pupil applications to attend a private school participating in a parental
13	13	choice program.

15	15	This bill allows a private school participating in the Milwaukee Parental Choice
16	16	Program, Racine Parental Choice Program, or the Wisconsin Parental Choice
17	17	Program (parental choice program) to allow parents and guardians of pupils
18	18	participating in a parental choice program to opt to use an automatic application
19	19	process to attend the private school under the parental choice program in subsequent
20	20	school years. If a parent or guardian opts to use an automatic application process
21	21	offered by a private school, the parent or guardian is considered to have annually
22	22	submitted an application to the private school for the pupil to attend the private
23	23	school under the parental choice program, as required by law, until 1) the parent or
24	24	guardian submits a notice to the private school to stop the automatic application
25	25	process or 2) the pupil is enrolled in the highest grade offered by the private school.
26	26	If the pupil is participating in the WPCP, an application submitted through an
27	27	automatic application process is considered to be accepted by the private school
28	28	during the WPCP application period.
29	29	Under current law, a private school participating in the WPCP is allowed to
30	30	accept applications for the following school year between the first weekday in
31	31	February and the third Thursday in April from pupils. Current law requires private
32	32	schools participating in the WPCP to report the number of pupils who apply during

38	38	this application period to the Department of Public Instruction for DPI to determine
39	39	whether accepted applications exceed school district pupil participation limits, and
40	40	if necessary, implement the school district participation limits.
41	41	The people of the state of Wisconsin, represented in senate and assembly, do
42	42	enact as follows:
43	43	SECTION 1. 118.60 (3) (am) of the statutes is created to read:
44	44	118.60 (3) (am) A private school participating in a program under this section
45	45	may allow the parent or guardian of a pupil attending the private school under this
46	46	section to use an automatic application process under which the pupil is considered
47	47	to have annually applied to attend the private school under this section until the
48	48	pupil's parent or guardian submits a notice to the private school indicating that the
49	49	pupil will not attend the private school under this section in the following school year
50	50	or until the pupil is enrolled in the highest grade offered by the private school. If a
51	51	parent or guardian opts to use an automatic application process under this
52	52	paragraph, the parent or guardian is considered to have submitted an application
53	53	under par. (a) for each school year to which the automatic application process applies.
54	54	For pupils who reside in a school district, other than an eligible school district or a
55	55	1st class city school district, applications submitted through an automatic
56	56	application process are considered accepted by the private school within the
57	57	application period under par. (ar) 1.
58	58	SECTION 2. 119.23 (3) (am) of the statutes is created to read:
59	59	119.23 (3) (am) A private school participating in a program under this section
60	60	may allow the parent or guardian of a pupil attending the private school under this
61	61	section to use an automatic application process under which the pupil is considered
62	62	to have annually applied to attend the private school under this section until the
