12	12	AN ACT to amend 20.445 (1) (bm), 106.27 (2g) (a) 1., 106.27 (2g) (a) 2. and 106.27
13	13	(3); and to create 20.445 (1) (bp) and 106.27 (1p) of the statutes; relating to:
14	14	green jobs training program grants, providing an exemption from emergency
15	15	rule procedures, and making an appropriation.
16	16	Analysis by the Legislative Reference Bureau
17	17	This bill creates a green jobs training program to be administered by the
18	18	Department of Workforce Development. Under the program, DWD must award
19	19	grants to public or private organizations for the development and implementation
20	20	of green jobs training programs. The bill defines “green jobs” as jobs that produce
21	21	goods or provide services that benefit the environment or conserve natural resources.
22	22	The bill also allows DWD to require a public or private organization, as a condition
23	23	of receiving a grant, to provide matching funds at a percentage to be determined by
24	24	DWD.
25	25	For further information see the state fiscal estimate, which will be printed as
26	26	an appendix to this bill.
27	27	The people of the state of Wisconsin, represented in senate and assembly, do
28	28	enact as follows:
29	29	SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
30	30	the following amounts for the purposes indicated:

44	44	SECTION 2. 20.445 (1) (bm) of the statutes is amended to read:
45	45	20.445 (1) (bm) Workforce training; administration. Biennially, the amounts
46	46	in the schedule for the administration of the local youth apprenticeship grant
47	47	program under s. 106.13 (3m), the youth summer jobs program under s. 106.18, the
48	48	employment transit assistance grant program under s. 106.26, the workforce
49	49	training program programs under s. 106.27, the teacher development program
50	50	grants under s. 106.272, the career and technical education incentive grant program
51	51	under s. 106.273, the technical education equipment grant program under s.
52	52	106.275, and the apprentice programs under subch. I of ch. 106.
53	53	SECTION 3. 20.445 (1) (bp) of the statutes is created to read:
54	54	20.445 (1) (bp) Green jobs training program; grants. As a continuing
55	55	appropriation, the amounts in the schedule for green jobs training program grants
56	56	under s. 106.27 (1p).
57	57	SECTION 4. 106.27 (1p) of the statutes is created to read:
58	58	106.27 (1p) GREEN JOBS TRAINING PROGRAM. (a) In this subsection, “green jobs”
59	59	means jobs that produce goods or provide services that benefit the environment or
60	60	conserve natural resources.
61	61	(b) From the appropriation under s. 20.445 (1) (bp), the department shall award
62	62	grants to public or private organizations for the development and implementation

90	90	of green jobs training programs. As a condition of receiving a grant under this
91	91	subsection, the department may require a public or private organization to provide
92	92	matching funds at a percentage to be determined by the department.
93	93	SECTION 5. 106.27 (2g) (a) 1. of the statutes is amended to read:
94	94	106.27 (2g) (a) 1. Promulgate rules prescribing procedures and criteria for
95	95	awarding grants under sub. subs. (1) and (1p) and the information with respect to
96	96	those grants that must be contained in the reports required under subd. 3.
97	97	SECTION 6. 106.27 (2g) (a) 2. of the statutes is amended to read:
98	98	106.27 (2g) (a) 2. Receive and review applications for grants under subs. (1),
99	99	(1g), and (1j) (am), and (1p) and prescribe the form, nature, and extent of the
100	100	information that must be contained in an application for a grant under sub. (1), (1g),
101	101	or (1j) (am), or (1p).
102	102	SECTION 7. 106.27 (3) of the statutes is amended to read:
103	103	106.27 (3) ANNUAL REPORT. Annually, by December 31, the department shall
104	104	submit a report to the governor and the cochairpersons of the joint committee on
105	105	finance providing an account of the department's activities and expenditures under
106	106	this section during the preceding fiscal year and detailing the amounts allocated to
107	107	and expended for each of the programs, grants, and services specified in s. 20.445 (1)
108	108	(b) and, (bm), and (bp) for that fiscal year. The report shall include information on
109	109	the number of unemployed and underemployed workers and incumbent employees
110	110	who participate in training programs under sub. (1) or, (1j), or (1p); the number of
111	111	unemployed workers who obtain gainful employment, underemployed workers who
112	112	obtain new employment, and incumbent employees who receive increased
113	113	compensation after participating in such a training program; and the wages earned
114	114	by those workers and employees both before and after participating in such a

142	142	training program. The report shall also include information on the extent to which
143	143	waiting lists for enrollment in courses and programs provided by technical colleges
144	144	in high-demand fields are reduced as a result of grants under sub. (1g) (a), on the
145	145	number of students who participate in certification or training programs under sub.
146	146	(1) (a) or (e) or (1g) (b), on the building modifications funded under sub. (1) (f) and the
147	147	effect of those building modifications on the school districts' technical education
148	148	programs, and on the number of persons with disabilities who participate in
149	149	employment enhancement activities under sub. (1g) (c). In addition, the report shall
150	150	provide information on the number of student interns who are placed with employers
151	151	as a result of the coordination activities conducted under sub. (1r) or the grants
152	152	awarded under sub. (1) (d).
153	153	SECTION 8.0Nonstatutory provisions.
154	154	(1) POSITION AUTHORIZED. The authorized FTE positions for the department of
155	155	workforce development are increased by 1.0 GPR position, to be funded from the
156	156	appropriation under s. 20.445 (1) (bm), for the purpose of administering the green
157	157	jobs training program under s. 106.27 (1p).
158	158	(2) EMERGENCY RULES. The department of workforce development may
159	159	promulgate emergency rules under s. 227.24 necessary to implement s. 106.27 (1p).
160	160	Notwithstanding s. 227.24 (1) (c) and (2), emergency rules under this subsection
161	161	remain in effect until July 1, 2024, or the date on which permanent rules take effect,
162	162	whichever is sooner. Notwithstanding s. 227.24 (1) (a) and (3), the department is not
163	163	required to provide evidence that promulgating a rule under this subsection as an
164	164	emergency rule is necessary for the preservation of the public peace, health, safety,
165	165	or welfare and is not required to provide a finding of emergency for a rule
166	166	promulgated under this subsection.

197	197	(1) This act takes effect on the day after publication, or on the 2nd day after
198	198	publication of the 2023 biennial budget act, whichever is later.
