10	10	AN ACT to create 36.39 of the statutes; relating to: the provision of absentee
11	11	ballots to nonresident students at the University of Wisconsin System.

13	13	This bill requires the Board of Regents of the University of Wisconsin System
14	14	to provide to all first-year students at its institutions with electronic or paper notice
15	15	that includes an application to request an absentee ballot from the student's home
16	16	state and accurate and clear instructions regarding how the nonresident student
17	17	may complete and submit the absentee ballot to the appropriate authority in the
18	18	student's home state. The board shall ensure that any voter registration or voter
19	19	education partnership or contract it enters into results in the provision of absentee
20	20	ballot information to nonresident students. Under the bill, the board is also required
21	21	to develop and implement policies that ensure compliance with the bill's provisions,
22	22	and to biennially review the policies for effectiveness and relevance. The board is
23	23	required to submit an annual report to the legislature detailing the implementation
24	24	of the provisions of the bill.

27	27	The people of the state of Wisconsin, represented in senate and assembly, do
28	28	enact as follows:
29	29	SECTION 1. 36.39 of the statutes is created to read:

35	35	36.39 Nonresident student absentee ballots. (1) DEFINITION. In this
36	36	section, “nonresident student” means a student who is not a resident of the state as
37	37	determined under s. 36.27.
38	38	(2) NONRESIDENT STUDENT ABSENTEE BALLOTS. (a) The board shall ensure that
39	39	a nonresident student receives during the student's first-year student orientation
40	40	an electronic or paper notice that includes all of the following:
41	41	1. An application to request an absentee ballot from the student's home state.
42	42	2. Accurate, up-to-date, easily-understandable, and clear instructions
43	43	regarding how the nonresident student may complete and submit the absentee ballot
44	44	to the appropriate authority in the student's home state.
45	45	(b) The board shall ensure that any voter registration or voter education
46	46	partnership or contract between the board and a private entity or between an
47	47	institution and a private entity results in the provision of absentee ballot information
48	48	to nonresident students. Any such contracts entered into, modified, or renewed on
49	49	or after the effective date of this paragraph .... [LRB inserts date], shall clearly note
50	50	the requirement of providing absentee ballot information to nonresident students.
51	51	(c) The board shall develop and implement policies that ensure compliance
52	52	with this section and biennially review and update the policies for effectiveness and
53	53	relevance.
54	54	(d) The board may contract with a 3rd-party for the provision of the notice
55	55	required under par. (a).
56	56	(e) Beginning one year after the effective date of this paragraph .... [LRB inserts
57	57	date], and annually thereafter, the board shall submit to the governor and to the
58	58	appropriate standing committees of the legislature under s. 13.172 (3) a report
