4-AN ACT to renumber and amend 101.16 (2); and to create 101.16 (2) (b), 101.16 (2) (c) and 101.16 (4) (d) of the
5-statutes; relating to: prohibiting certain rules related to self−service dispensing liquefied petroleum gases and com-
6-pressed natural gas for vehicle fuel purposes and granting rule−making authority.
7-The people of the state of Wisconsin, represented in
8-senate and assembly, do enact as follows:
9-SECTION 1. 101.16 (2) of the statutes is renumbered
10-101.16 (2) (a) and amended to read:
11-101.16 (2) (a)  The Except as provided in par. (b), the
12-department shall promulgate rules to ascertain, fix, and
13-order such reasonable standards, rules, or regulations for
14-the design, construction, location, installation, operation,
15-repair, and maintenance of equipment for storage, han-
16-dling, use, and transportation by tank truck or tank trailer,
17-of liquefied petroleum gases for fuel purposes, and for the
18-odorization of said gases used therewith, as shall render
19-such equipment safe.
20-SECTION 2. 101.16 (2) (b) of the statutes is created to
21-read:
22-101.16 (2) (b) 1.  The department may not promulgate
23-a rule that prohibits self−service dispensing by the gen-
24-eral public of compressed natural gas or liquefied petro-
25-leum gases into an individual vehicle fuel tank.
26-2.  The department may not promulgate a rule that
27-requires completion of training to self−service dispense
28-compressed natural gas or liquefied petroleum gases into
29-an individual vehicle fuel tank.
30-SECTION 3. 101.16 (2) (c) of the statutes is created to
31-read:
32-101.16 (2) (c)  The department shall promulgate rules
33-ensuring that safety requirements under this section and
34-federal law are satisfied during self−service dispensing
35-by the general public of compressed natural gas and liq-
36-uefied petroleum gases and rules establishing require-
37-ments for the signage required under sub. (4) (d).
38-SECTION 4. 101.16 (4) (d) of the statutes is created to
39-read:
40-101.16 (4) (d)  A person who owns a device used for
41-self−service dispensing of compressed natural gas or liq-
42-uefied petroleum gases shall display signage that pro-
43-vides step−by−step directions for fueling a vehicle and
44-that advises users of safety requirements for fueling
45-under state and federal law.

47-partial veto which does not expressly prescribe the time when it takes effect shall take effect on the day after its date of publication.”

13+This bill prohibits the Department of Safety and Professional Services from
14+promulgating any rule that does any of the following regarding liquefied petroleum
15+gases used for vehicle fuel purposes: 1) prohibits self-service dispensing; or 2)
16+requires completion of training to dispense. Under current law, DSPS must
17+promulgate rules to establish rules and standards for the design, construction,
18+location, operation, and maintenance of equipment for storage, handling, use, and
19+transportation by tank truck or tank trailer of liquefied petroleum gases used for fuel
20+purposes.
