11	11	AN ACT to create 101.02 (7r) (h) and 101.028 of the statutes; relating to:
12	12	creating a stretch energy code.
13	13	Analysis by the Legislative Reference Bureau
14	14	This bill requires the Department of Safety and Professional Services to create
15	15	a stretch energy code working group, which is required to establish a stretch energy
16	16	code.
17	17	Under current law, DSPS promulgates rules setting design requirements for
18	18	construction and equipment for the purpose of energy conservation in public
19	19	buildings and places of employment (commonly known as the “energy conservation
20	20	code”). In general, a local unit of government is prohibited from enacting or enforcing
21	21	an ordinance establishing minimum standards for constructing, altering, or adding
22	22	to public buildings or buildings that are places of employment unless that ordinance
23	23	strictly conforms to applicable DSPS rules.
24	24	The bill requires the stretch energy code working group to establish the stretch
25	25	energy code, which must have separate components for commercial and residential
26	26	buildings and must establish minimum energy efficiency requirements that may
27	27	exceed the requirements of the energy conservation code. The bill provides that any
28	28	county, city, village, or town may by ordinance adopt the residential or commercial
29	29	components of the stretch energy code, or both, and make the adopted requirements
30	30	of the stretch energy code applicable within the county, city, village, or town.

37	37	The people of the state of Wisconsin, represented in senate and assembly, do
38	38	enact as follows:
39	39	SECTION 1. 101.02 (7r) (h) of the statutes is created to read:
40	40	101.02 (7r) (h) Notwithstanding par. (a), a county, city, village, or town may
41	41	enact and enforce an ordinance establishing an energy code that is stricter than rules
42	42	promulgated by the department under s. 101.027 (2) if the ordinance is in strict
43	43	conformity with the stretch energy code established by the stretch energy code
44	44	working group under s. 101.028 (2).
45	45	SECTION 2. 101.028 of the statutes is created to read:
46	46	101.028 Stretch energy code. (1) The department shall create a stretch
47	47	energy code working group consisting of the secretary, or his or her designee, and
48	48	other members appointed by the secretary, or his or her designee, who are any of the
49	49	following:
50	50	(a) An employee of the department.
51	51	(b) An industry leader in deep clean energy.
52	52	(c) A nonprofit leader focused on scaling climate solutions.
53	53	(d) A representative from a municipality that has a climate action plan.
54	54	(2) No later than December 31, 2023, the stretch energy code working group
55	55	shall establish the stretch energy code, which shall have separate components for
56	56	commercial and residential buildings and shall establish minimum energy efficiency
57	57	requirements that may exceed the minimum energy efficiency requirements
58	58	established in the energy conservation code under s. 101.027.

83	83	(3) A county, city, village, or town may by ordinance adopt the residential or
84	84	commercial components of the stretch energy code, or both, and make the adopted
85	85	requirements of the stretch energy code applicable within the county, city, village, or
86	86	town.
87	87	SECTION 3.0Nonstatutory provisions.
88	88	(1) The authorized FTE positions for the department of safety and professional
89	89	services are increased by 1.0 GPR project position, to be funded from the
90	90	appropriation under s. 20.165 (1) (a), for the purpose of administering the creation
91	91	of the stretch energy code under s. 101.028.
