1111 AN ACT to create 302.074 of the statutes; relating to: free feminine hygiene
1212 products for inmates of state correctional institutions or county jails or houses

1515 This bill requires the Department of Corrections to ensure that each state
1616 correctional institution has a commissary that provides all of the following feminine
1717 hygiene products free of charge to any inmate with an active menstrual cycle: at least
1818 three brands of tampons, with at least one brand having a plastic applicator, in
1919 appropriate absorbencies for varying levels of menstrual flow; at least three brands
2020 of menstrual pads in appropriate absorbencies for varying levels of menstrual flow;
2121 and at least one brand of reusable menstrual cup. The department must also ensure
2222 that the state correctional institution has the means to sanitize inmate menstrual
2323 cups on an as-needed basis.
2424 The bill requires the sheriff to ensure that each county jail or house of correction
2525 has a commissary that provides all of the following feminine hygiene products free
2626 of charge to any inmate with an active menstrual cycle: at least three brands of
2727 tampons, with at least one brand having a plastic applicator, in appropriate
2828 absorbencies for varying levels of menstrual flow; at least three brands of menstrual
2929 pads in appropriate absorbencies for varying levels of menstrual flow; and at least
3030 one brand of reusable menstrual cup. The sheriff must also ensure that the county
3131 jail or house of correction has the means to sanitize inmate menstrual cups on an
3232 as-needed basis.

4040 The people of the state of Wisconsin, represented in senate and assembly, do
4141 enact as follows:
4242 SECTION 1. 302.074 of the statutes is created to read:
4343 302.074 Feminine hygiene products for inmates of state correctional
4444 institutions and county jails. (1) (a) The department shall ensure that each state
4545 correctional institution has a commissary that provides all of the following feminine
4646 hygiene products free of charge to any inmate with an active menstrual cycle:
4747 1. At least 3 brands of tampons, with at least one brand having a plastic
4848 applicator, in appropriate absorbencies for varying levels of menstrual flow.
4949 2. At least 3 brands of menstrual pads, in appropriate absorbencies for varying
5050 levels of menstrual flow.
5151 3. At least one brand of reusable menstrual cup.
5252 (b) The department shall ensure that each state correctional institution has the
5353 means to sanitize inmate menstrual cups on an as-needed basis.
5454 (2) (a) The sheriff shall ensure that each county jail or house of correction has
5555 a commissary that provides all of the following feminine hygiene products free of
5656 charge to any inmate with an active menstrual cycle:
5757 1. At least 3 brands of tampons, with at least one brand having a plastic
5858 applicator, in appropriate absorbencies for varying levels of menstrual flow.
