10	10	AN ACT to create 302.073 and 302.074 of the statutes; relating to: personal
11	11	hygiene products for inmates of state correctional institutions and county jails
12	12	and houses of correction and making an appropriation.

14	14	This bill requires the Department of Corrections to provide all of the following
15	15	personal hygiene products in each state correctional institution commissary:
16	16	1. At no more than 125 percent of the sales price of the product at the
17	17	highest-grossing retail chain in the state, at least two varieties of the following
18	18	personal hygiene products: deodorant, antiperspirant, shampoo, hair conditioner,
19	19	liquid body wash, bar soap, body lotion, face wash, facial lotion, toothpaste,
20	20	toothbrush, dental floss, razor, shaving cream, sunscreen, comb, hairbrush, and
21	21	cleansing wipes.
22	22	2. At no more than 100 percent of the sales price of the product at the
23	23	highest-grossing retail chain in the state, at least two varieties of the following
24	24	culturally sensitive personal hygiene products: shampoo, conditioner, natural hair
25	25	oil, and shaving cream that are appropriate for types 2, 3, and 4 hair, bar soap, and
26	26	cocoa-butter-based body lotion.
27	27	The bill also requires DOC to provide each inmate with a monthly personal
28	28	hygiene stipend of $25 to purchase personal hygiene products from the commissary.
29	29	The bill provides $6,450,000 to DOC in each year of the 2023-25 biennium to provide
30	30	personal hygiene stipends.
31	31	The bill also requires sheriffs to provide the same personal hygiene products in
32	32	the commissaries of county jails and houses of correction at the prices established by

38	38	DOC for those products in state correctional institutions and requires sheriffs to
39	39	provide each inmate with a monthly personal hygiene stipend of $25 to purchase
40	40	personal hygiene products from the commissary.

42	42	printed as an appendix to this bill.
43	43	The people of the state of Wisconsin, represented in senate and assembly, do
44	44	enact as follows:
45	45	SECTION 1. 302.073 of the statutes is created to read:
46	46	302.073 State correctional institution inmate personal hygiene
47	47	products. (1) In this section:
48	48	(a) “Benchmark retailer” means the retail chain in this state that has at least
49	49	one physical store in the state and has the highest annual gross receipts of any retail
50	50	chain in the state.
51	51	(b) “Sales price” has the meaning given in s. 77.51 (15b).
52	52	(2) The department shall ensure that each state correctional institution has
53	53	a commissary that provides all of the following personal hygiene products for
54	54	acquisition by inmates:
55	55	(a) To be sold at all state correctional facilities for no more than 125 percent of
56	56	the sales price of the same product at the benchmark retailer, at least 2 varieties of
57	57	all of the following products:
58	58	1. Deodorant.
59	59	2. Antiperspirant.
60	60	3. Shampoo.
61	61	4. Hair conditioner.

140	140	products. (1) The sheriff shall ensure that each county jail or house of correction
141	141	has a commissary that provides all of the following personal hygiene products for
142	142	acquisition by inmates:
143	143	(a) To be sold for no more than the price set for the same product under s.
144	144	302.073 (2) (a), at least 2 varieties of all of the following products:

203	203	SECTION 3.0Fiscal changes.
204	204	(1) PERSONAL HYGIENE STIPENDS. In the schedule under s. 20.005 (3) for the
205	205	appropriation to the department of corrections under s. 20.410 (1) (a), the dollar
206	206	amount for fiscal year 2023-24 is increased by $6,450,000 to provide personal
207	207	hygiene stipends under s. 302.073 (3). In the schedule under s. 20.005 (3) for the
208	208	appropriation to the department of corrections under s. 20.410 (1) (a), the dollar
209	209	amount for fiscal year 2024-25 is increased by $6,450,000 to provide personal
210	210	hygiene stipends under s. 302.073 (3).
