10	10	AN ACT to create 565.27 (1) (g) and 565.30 (6v) of the statutes; relating to:
11	11	privacy of lottery winner.
12	12	Analysis by the Legislative Reference Bureau
13	13	This bill prohibits a retailer who sold a lottery ticket, the administrator of the
14	14	state lottery, and the Department of Revenue, which administers the lottery, from
15	15	disclosing the name, address, or social security number of a lottery prize winner of
16	16	$1,000,000 or more for up to one year after the winner becomes entitled to the lottery
17	17	prize, if the winner requests confidentiality. The bill provides exceptions where
18	18	disclosure is allowed, including disclosures made to withhold taxes from the
19	19	winnings, to determine whether the winner is delinquent in tax payment or
20	20	court-ordered child support, to determine any withholding for child, spousal, or
21	21	family support, and to determine any withholding for unpaid court judgments.
22	22	Additionally, the bill exempts from the right to inspection, copying, or receipt under
23	23	public records law written records of a confidential winner's name, address, or social
24	24	security number for up to one year after the winner becomes entitled to the lottery
25	25	prize.
26	26	The people of the state of Wisconsin, represented in senate and assembly, do
27	27	enact as follows:
28	28	SECTION 1. 565.27 (1) (g) of the statutes is created to read:

34	34	565.27 (1) (g) The procedure for a winner of a lottery prize or lottery share equal
35	35	to or greater than $1,000,000 to request a retailer, the administrator, or the
36	36	department to keep his or her identity confidential under s. 565.30 (6v) for up to one
37	37	year after the winner becomes entitled to the lottery prize under s. 565.30 (1).
38	38	SECTION 2. 565.30 (6v) of the statutes is created to read:
39	39	565.30 (6v) PRIZE WINNER PRIVACY. (a) If a winner of a lottery prize or lottery
40	40	share equal to or greater than $1,000,000 makes a request to the retailer,
41	41	administrator, or department for his or her identity as a winner to be treated as
42	42	confidential, the administrator, department, and retailer may not disclose the name,
43	43	address, or social security number of that winner for up to one year after the winner
44	44	becomes entitled to the lottery prize under sub. (1) except under any of the following
45	45	circumstances:
46	46	1. The disclosure is made by the retailer, administrator, or department to an
47	47	employee or contractor of the department for the purpose of administering the state
48	48	lottery.
49	49	2. The disclosure is made to a parent or guardian of a minor under sub. (2).
50	50	3. The disclosure is made for the purpose of withholding income taxes under
51	51	sub. (4) or is made under sub. (5), (5m), or (5r).
52	52	4. The disclosure is made in conjunction with a proceeding under sub. (6m) or
53	53	(6r).
54	54	(b) Written records containing the name, address, or social security number of
55	55	any winner of a lottery prize or lottery share equal to or greater than $1,000,000 who
56	56	has requested confidentiality under par. (a) are exempt from the right to inspection,
57	57	copying, or receipt under s. 19.35 for up to one year after the winner becomes entitled
58	58	to the lottery prize under sub. (1).

89	89	(1) This act first applies to selections of winners of lottery prizes or lottery
90	90	shares on the effective date of this subsection.
