1010 AN ACT to create 565.27 (1) (g) and 565.30 (6v) of the statutes; relating to:
1111 privacy of lottery winner.
1212 Analysis by the Legislative Reference Bureau
1313 This bill prohibits a retailer who sold a lottery ticket, the administrator of the
1414 state lottery, and the Department of Revenue, which administers the lottery, from
1515 disclosing the name, address, or social security number of a lottery prize winner of
1616 $1,000,000 or more for up to one year after the winner becomes entitled to the lottery
1717 prize, if the winner requests confidentiality. The bill provides exceptions where
1818 disclosure is allowed, including disclosures made to withhold taxes from the
1919 winnings, to determine whether the winner is delinquent in tax payment or
2020 court-ordered child support, to determine any withholding for child, spousal, or
2121 family support, and to determine any withholding for unpaid court judgments.
2222 Additionally, the bill exempts from the right to inspection, copying, or receipt under
2323 public records law written records of a confidential winner's name, address, or social
2424 security number for up to one year after the winner becomes entitled to the lottery
2525 prize.
2626 The people of the state of Wisconsin, represented in senate and assembly, do
2727 enact as follows:
2828 SECTION 1. 565.27 (1) (g) of the statutes is created to read:

3434 565.27 (1) (g) The procedure for a winner of a lottery prize or lottery share equal
3535 to or greater than $1,000,000 to request a retailer, the administrator, or the
3636 department to keep his or her identity confidential under s. 565.30 (6v) for up to one
3737 year after the winner becomes entitled to the lottery prize under s. 565.30 (1).
3838 SECTION 2. 565.30 (6v) of the statutes is created to read:
3939 565.30 (6v) PRIZE WINNER PRIVACY. (a) If a winner of a lottery prize or lottery
4040 share equal to or greater than $1,000,000 makes a request to the retailer,
4141 administrator, or department for his or her identity as a winner to be treated as
4242 confidential, the administrator, department, and retailer may not disclose the name,
4343 address, or social security number of that winner for up to one year after the winner
4444 becomes entitled to the lottery prize under sub. (1) except under any of the following
4545 circumstances:
4646 1. The disclosure is made by the retailer, administrator, or department to an
4747 employee or contractor of the department for the purpose of administering the state
4848 lottery.
4949 2. The disclosure is made to a parent or guardian of a minor under sub. (2).
5050 3. The disclosure is made for the purpose of withholding income taxes under
5151 sub. (4) or is made under sub. (5), (5m), or (5r).
5252 4. The disclosure is made in conjunction with a proceeding under sub. (6m) or
5353 (6r).
5454 (b) Written records containing the name, address, or social security number of
5555 any winner of a lottery prize or lottery share equal to or greater than $1,000,000 who
5656 has requested confidentiality under par. (a) are exempt from the right to inspection,
5757 copying, or receipt under s. 19.35 for up to one year after the winner becomes entitled
5858 to the lottery prize under sub. (1).

8888 SECTION 3.0Initial applicability.
8989 (1) This act first applies to selections of winners of lottery prizes or lottery
