12	12	AN ACT to create 16.23 and 20.505 (1) (bm) of the statutes; relating to: small
13	13	law enforcement agency training grant pilot program, granting rule-making
14	14	authority, and making an appropriation.

16	16	This bill requires the Department of Administration to establish and
17	17	administer a pilot program for grants for payment of training costs for new law
18	18	enforcement officers at small law enforcement agencies. Under the bill, “small law
19	19	enforcement agency” means a police department, tribal police department, combined
20	20	protective services department, or sheriff's office that employs fewer than 25
21	21	full-time equivalent law enforcement officers who are not supervisors. The grants
22	22	may be used to pay for training a preservice student who is enrolled in a program to
23	23	become a law enforcement officer or tribal law enforcement officer and to pay for
24	24	employment costs during the first six months of employment of such an officer. Also
25	25	under the bill, if a small law enforcement agency has received reimbursement for
26	26	training a preservice student or recruit from the Law Enforcement Standards Board,
27	27	the agency may not also receive a grant under the program that duplicates the
28	28	amounts reimbursed. The bill requires any individual whose training or recruitment
29	29	period of six months is paid for under the pilot program to commit to remain with the
30	30	employing small law enforcement agency for one year after the training or service
31	31	paid for with the grant has ended. If such an individual does not complete 12 months
32	32	of employment, the department may seek from the individual repayment of the grant
33	33	on a prorated basis. Under the bill, DOA must administer the pilot program until
34	34	the appropriation for the program is fully depleted.

42	42	The people of the state of Wisconsin, represented in senate and assembly, do
43	43	enact as follows:
44	44	SECTION 1. 16.23 of the statutes is created to read:
45	45	16.23 Small law enforcement agency training pilot program. (1)
46	46	DEFINITIONS. In this section:
47	47	(a) “Preservice student” has the meaning given in s. 165.85 (2) (e).
48	48	(b) “Recruit” has the meaning given in s. 165.85 (2) (f).
49	49	(c) “Small law enforcement agency” means a police department, tribal police
50	50	department, combined protective services department under s. 60.553, 61.66, or
51	51	62.13 (2e), or sheriff's office that employs 25 or fewer full-time equivalent law
52	52	enforcement officers or tribal law enforcement officers who are not supervisors.
53	53	(2) ADMINISTRATION. The department shall establish and administer a pilot
54	54	program to provide training grants to small law enforcement agencies. The program
55	55	shall provide for all of the following:
56	56	(a) A small law enforcement agency may apply for a grant if the agency has been
57	57	notified that any law enforcement officer it employs will be retiring or leaving the
58	58	agency within 6 months, or the agency has a 20 percent or higher vacancy rate in its
59	59	authorized law enforcement officer positions.
60	60	(b) The grant application shall be on a form created by the department.
61	61	(c) The grant shall be used to pay costs for the following:
62	62	1. Preparatory training under s. 165.85 (4) (a) 1., for a preservice student who
63	63	will be employed by the small law enforcement agency after completion of the
64	64	training.

90	90	2. Compensation and costs related to employment of a recruit whose
91	91	preparatory training costs were paid by the grant, for up to 6 months of on-the-job
92	92	training.
93	93	(d) A preservice student or recruit whose training or service as a recruit is paid
94	94	for with a grant under this section shall commit to working for the small law
95	95	enforcement agency that received the grant for one year after the training or service
96	96	paid for with the grant has ended. If such an individual does not work for one year
97	97	at the small law enforcement agency, the department may seek from the individual
98	98	repayment of the grant on a prorated basis.
99	99	(e) A small law enforcement agency that receives a grant under this section is
100	100	not required to include a recruit whose training costs were paid by the grant, in any
101	101	required maintenance of effort for law enforcement officer staffing for 6 months after
102	102	the recruit completes training.
103	103	(f) If a small law enforcement agency has received reimbursement for training
104	104	a preservice student or recruit from the law enforcement standards board under s.
105	105	165.85 (5) (b), the agency may not also receive a grant under the program that
106	106	duplicates the amounts reimbursed, but may receive a grant that is the difference
107	107	between the amount reimbursed and the actual costs the agency incurred.
108	108	(g) A list, maintained by the department, of small law enforcement agencies in
109	109	this state.
110	110	(h) If the department receives a grant application from a small law enforcement
111	111	agency on the list in par. (g), and money is available from the appropriation under
112	112	s. 20.505 (1) (bm), the department shall, within one week of receiving the application,
113	113	distribute sufficient moneys to pay for training under par. (c) 1. or 2. while the
114	114	application is being reviewed by the department.

142	142	(i) If an application under par. (b) is approved, the department shall distribute
143	143	the grant money as soon as practicable after approving the application.
144	144	(j) If an application under par. (b) is denied, and the department distributed
145	145	money under par. (h), the department shall seek reimbursement from the small law
146	146	enforcement agency that received the money.
147	147	(k) The pilot program terminates 18 months after all moneys from the
148	148	appropriation under s. 20.505 (1) (bm) have been disbursed, and the department
149	149	shall continue to make reasonable efforts to seek repayment under par. (d).
150	150	(3) RULES. The department shall promulgate rules for the administration of
151	151	the small law enforcement agency training grant program.
152	152	SECTION 2. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert

160	160	20.505 (1) (bm) Small law enforcement agency training grants. As a continuing
161	161	appropriation, the amounts in the schedule to provide training grants to small law
162	162	enforcement agencies under s. 16.23 (2).
