11	11	AN ACT to create 43.58 (9) and 120.12 (25m) of the statutes; relating to:
12	12	requests for restrictions on the availability of library materials, including
13	13	school library materials.

15	15	The bill provides that, if a library board or school board has a procedure to
16	16	evaluate and resolve a complaint alleging that library materials should be removed
17	17	from the collection or restricted to certain users, the procedure may only be initiated
18	18	upon a finding that 1) the complaint is made by an individual who resides in a
19	19	political subdivision that established the public library or in the case of a school
20	20	library, the individual is either the parent or guardian of a pupil attending a school
21	21	in the school district or a resident of the school district, 2) the complaint is
22	22	accompanied by a statement from the individual making the complaint averring that
23	23	the individual has reviewed the library material in its entirety, 3) the complaint
24	24	contains an explanation of the individual's objections to the material, and 4) the
25	25	complaint is accompanied by the signatures of not less than 5 percent of the total
26	26	number of electors in the political subdivision that established the public library or
27	27	for a school library, 5 percent of the total number of the electors in the school district
28	28	in which the school library is located.
29	29	The people of the state of Wisconsin, represented in senate and assembly, do
30	30	enact as follows:

35	35	SECTION 1 SENATE BILL 824
36	36	SECTION 1. 43.58 (9) of the statutes is created to read:
37	37	43.58 (9) If a library board has a procedure to evaluate and resolve a complaint
38	38	alleging that library materials should be removed from the collection or restricted
39	39	to certain users, the procedure may only be initiated upon a finding that all of the
40	40	following are satisfied:
41	41	(a) The complaint is made by an individual who resides in a city, village, town,
42	42	or county that established the public library.
43	43	(b) The complaint is accompanied by a statement from the individual making
44	44	the complaint averring that the individual has reviewed the library material in its
45	45	entirety.
46	46	(c) The complaint contains an explanation of the individual's objections to the
47	47	material.
48	48	(d) The complaint is accompanied by the signatures of not less than 5 percent
49	49	of the total number of electors in the city, village, town, or county that established
50	50	the public library.
51	51	SECTION 2. 120.12 (25m) of the statutes is created to read:
52	52	120.12 (25m) SCHOOL LIBRARY MATERIALS; OBJECTIONS POLICY. If the school board
53	53	has a procedure to evaluate and resolve a complaint alleging that school library
54	54	materials should be removed from the collection or restricted to certain users, ensure
55	55	that the procedure may only be initiated upon a finding that all of the following are
56	56	satisfied:
57	57	(a) The complaint is made by an individual who is any of the following:
58	58	1. A parent or guardian of a pupil enrolled in the school district.
59	59	2. A resident of the school district.
