99 AN ACT to amend 20.370 (4) (hq) and 287.21 (intro.); and to create 287.25 of the
1010 statutes; relating to: education about rechargeable batteries and providing
1111 grants for collecting and recycling rechargeable batteries.
1212 Analysis by the Legislative Reference Bureau
1313 Current law requires the Department of Natural Resources to prepare
1414 educational materials about municipal and county solid waste management
1515 programs.  This bill requires DNR to also prepare educational materials to inform
1616 the public about the dangers of rechargeable batteries in the waste and recycling
1717 streams and about existing options for properly recycling rechargeable batteries.
1818 The bill also requires DNR to provide grants to responsible units,
1919 municipalities, businesses, tribal governments, and nonprofit organizations for the
2020 purpose of expanding rechargeable battery collection and recycling operations,
2121 creating new sites for the collection or recycling of rechargeable batteries,
2222 purchasing rechargeable battery collection and shipping kits and equipment for
2323 handling damaged or defective rechargeable batteries, and transporting
2424 rechargeable batteries to third-party collection and recycling facilities.  DNR may
2525 provide more than one grant to a single responsible unit, municipality, business,
2626 tribal government, or nonprofit organization; however, DNR may not provide a total
2727 amount of more than $20,000 to a single collection site.
2828 Under the bill, DNR must also provide grants to solid waste facilities and
2929 materials recovery facilities for the purpose of installing, upgrading, or expanding
3030 fire detection and suppression systems to address the increased risk of fire due to the

3636 presence of rechargeable batteries in the waste and recycling streams.  DNR may
3737 provide more than one grant to a single solid waste facility or materials recovery
3838 facility; however, DNR may not provide a total amount of more than $50,000 to a
3939 single solid waste facility or materials recovery facility.
4040 In addition, current law provides an appropriation to DNR from the segregated
4141 environmental fund for various environmental programs and for the administration
4242 of this state's solid waste reduction, recovery, and recycling programs.  The bill allows
4343 this appropriation to be used for the existing statewide program to educate
4444 government employees, businesses, and the general public about the dangers of
4545 rechargeable batteries in the waste and recycling streams and about existing options
4646 for proper recycling of such batteries.
4747 Finally, under the bill, DNR must submit a request to the Joint Committee on
4848 Finance for supplemental funding, not to exceed $10,000,000, for these purposes.

5151 The people of the state of Wisconsin, represented in senate and assembly, do
5252 enact as follows:
5353 SECTION 1. 20.370 (4) (hq) of the statutes is amended to read:
5454 20.370 (4) (hq)  Recycling; administration.  From the environmental fund, the
5555 amounts in the schedule for the administration of subch. II of ch. 287, other than ss.
5656 287.21 and s. 287.23.
5757 SECTION 2. 287.21 (intro.) of the statutes is amended to read:
5858 287.21  Statewide education program.  (intro.)  The department shall
5959 collect, prepare, and disseminate information and conduct educational and training
6060 programs designed to assist in the implementation of solid waste management and
6161 recycling programs under ss. 287.01 to 287.27,; enhance municipal and county solid
6262 waste management and recycling programs under s. 287.09 (2) (a) and; inform the
6363 public of the relationship among an individual's consumption of goods and services,
6464 the generation of different types and quantities of solid waste, and the
6565 implementation of the solid waste management and recycling priorities in s. 287.05
6666 (12); and inform the public about the dangers of rechargeable batteries in the waste

8585 and recycling streams and about existing options for proper recycling of such
8686 batteries.  The department shall prepare the information and programs on a
8787 statewide basis for the following groups:
8888 SECTION 3. 287.25 of the statutes is created to read:
8989 287.25  Grants for rechargeable battery recycling.  (1)  In this section,
9090 “rechargeable battery” means a battery that contains one or more voltaic or galvanic
9191 cells, electrically connected to produce electric energy, and that is designed to be
9292 recharged, including lithium-ion batteries.
9393 (2) (a)  The department shall create and administer a program to provide grants
9494 to expand rechargeable battery recycling and recovery programs.  The department
9595 shall provide grants under this subsection to responsible units, municipalities,
9696 businesses, tribal governments, and nonprofit organizations for any of the following
9797 purposes:
9898 1.  For grant recipients that collect and recycle rechargeable batteries,
9999 expanding operations and ensuring continued operations.
100100 2.  Creating new sites for the collection or recycling of rechargeable batteries.
101101 3.  Purchasing rechargeable battery collection and shipping kits and equipment
102102 for handling damaged or defective rechargeable batteries.
103103 4.  Transporting rechargeable batteries to 3rd-party collection and recycling
104104 facilities.
105105 (b)  The department may provide more than one grant under this subsection to
106106 a single responsible unit, municipality, business, tribal government, or nonprofit
107107 organization in the same grant cycle.  The department may not provide grants under
108108 this subsection to a single collection site in a total amount greater than $20,000 in
109109 the same grant cycle.

137137 (3) (a)  The department shall create and administer a program to provide grants
138138 to solid waste facilities and materials recovery facilities for the purpose of installing,

141141 recycling streams.
142142 (b)  The department may not provide grants under this subsection to a single
143143 solid waste facility or materials recovery facility in a total amount greater than
144144 $50,000 in the same grant cycle.
145145 SECTION 4.0Nonstatutory provisions.
146146 (1)  SUPPLEMENTAL FUNDING REQUESTS.
147147 (a)  In the 2023-25 fiscal biennium, the department of natural resources shall
148148 request under s. 13.101 (3) that the joint committee on finance supplement the
149149 appropriation under s. 20.370 (4) (hq) with sufficient funds from the environmental
150150 fund for the purpose of providing education to the public under s. 287.21 about the
151151 dangers of rechargeable batteries in the waste and recycling streams and about
152152 existing options for proper recycling of such batteries.  The department shall submit
153153 additional such requests as needed for this purpose after the 2023-25 fiscal
154154 biennium.
155155 (b)  In the 2023-25 fiscal biennium, the department of natural resources shall
156156 request under s. 13.101 (3) that the joint committee on finance supplement the
157157 appropriation under s. 20.370 (4) (hq) with sufficient funds from the environmental
158158 fund for the purpose of providing grants under s. 287.25.  The department shall
159159 submit additional such requests as needed for this purpose after the 2023-25 fiscal
160160 biennium.

189189 (c)  The joint committee on finance may not provide supplements under this
190190 subsection in a total amount greater than $10,000,000.  The committee may provide
191191 supplements under this subsection without finding that an emergency exists under
192192 s. 13.101 (3) (a) 1.
