16 | 16 | | the public about the dangers of rechargeable batteries in the waste and recycling |
---|
17 | 17 | | streams and about existing options for properly recycling rechargeable batteries. |

18 | 18 | | The bill also requires DNR to provide grants to responsible units, |

19 | 19 | | municipalities, businesses, tribal governments, and nonprofit organizations for the |
---|
20 | 20 | | purpose of expanding rechargeable battery collection and recycling operations, |
---|
21 | 21 | | creating new sites for the collection or recycling of rechargeable batteries, |

22 | 22 | | purchasing rechargeable battery collection and shipping kits and equipment for |
---|
23 | 23 | | handling damaged or defective rechargeable batteries, and transporting |
---|
24 | 24 | | rechargeable batteries to third-party collection and recycling facilities. DNR may |
---|
25 | 25 | | provide more than one grant to a single responsible unit, municipality, business, |
---|
26 | 26 | | tribal government, or nonprofit organization; however, DNR may not provide a total |
---|
27 | 27 | | amount of more than $20,000 to a single collection site. |

28 | 28 | | Under the bill, DNR must also provide grants to solid waste facilities and |
---|
29 | 29 | | materials recovery facilities for the purpose of installing, upgrading, or expanding |
---|
30 | 30 | | fire detection and suppression systems to address the increased risk of fire due to the |

---|
37 | 37 | | provide more than one grant to a single solid waste facility or materials recovery |
---|
38 | 38 | | facility; however, DNR may not provide a total amount of more than $50,000 to a |
---|
39 | 39 | | single solid waste facility or materials recovery facility. |
---|
40 | 40 | | In addition, current law provides an appropriation to DNR from the segregated |
---|
41 | 41 | | environmental fund for various environmental programs and for the administration |
---|
42 | 42 | | of this state's solid waste reduction, recovery, and recycling programs. The bill allows |
---|
43 | 43 | | this appropriation to be used for the existing statewide program to educate |
---|
44 | 44 | | government employees, businesses, and the general public about the dangers of |
---|
45 | 45 | | rechargeable batteries in the waste and recycling streams and about existing options |
---|
46 | 46 | | for proper recycling of such batteries. |
---|
47 | 47 | | Finally, under the bill, DNR must submit a request to the Joint Committee on |
---|
48 | 48 | | Finance for supplemental funding, not to exceed $10,000,000, for these purposes. |
---|
49 | 49 | | For further information see the state and local fiscal estimate, which will be |

50 | 50 | | printed as an appendix to this bill. |

51 | 51 | | The people of the state of Wisconsin, represented in senate and assembly, do |
---|
52 | 52 | | enact as follows: |

53 | 53 | | SECTION 1. 20.370 (4) (hq) of the statutes is amended to read: |
---|
54 | 54 | | 20.370 (4) (hq) Recycling; administration. From the environmental fund, the |
---|
55 | 55 | | amounts in the schedule for the administration of subch. II of ch. 287, other than ss. |
---|
56 | 56 | | 287.21 and s. 287.23. |
---|
57 | 57 | | SECTION 2. 287.21 (intro.) of the statutes is amended to read: |
---|
58 | 58 | | 287.21 Statewide education program. (intro.) The department shall |
---|
59 | 59 | | collect, prepare, and disseminate information and conduct educational and training |
---|
60 | 60 | | programs designed to assist in the implementation of solid waste management and |
---|
61 | 61 | | recycling programs under ss. 287.01 to 287.27,; enhance municipal and county solid |
---|
62 | 62 | | waste management and recycling programs under s. 287.09 (2) (a) and; inform the |
---|
63 | 63 | | public of the relationship among an individual's consumption of goods and services, |
---|
64 | 64 | | the generation of different types and quantities of solid waste, and the |
---|
65 | 65 | | implementation of the solid waste management and recycling priorities in s. 287.05 |
---|
66 | 66 | | (12); and inform the public about the dangers of rechargeable batteries in the waste |

86 | 86 | | batteries. The department shall prepare the information and programs on a |
---|
87 | 87 | | statewide basis for the following groups: |

88 | 88 | | SECTION 3. 287.25 of the statutes is created to read: |

89 | 89 | | 287.25 Grants for rechargeable battery recycling. (1) In this section, |
---|
90 | 90 | | “rechargeable battery” means a battery that contains one or more voltaic or galvanic |
---|
91 | 91 | | cells, electrically connected to produce electric energy, and that is designed to be |
---|
92 | 92 | | recharged, including lithium-ion batteries. |
---|
93 | 93 | | (2) (a) The department shall create and administer a program to provide grants |
---|
94 | 94 | | to expand rechargeable battery recycling and recovery programs. The department |
---|
95 | 95 | | shall provide grants under this subsection to responsible units, municipalities, |
---|
96 | 96 | | businesses, tribal governments, and nonprofit organizations for any of the following |
---|
97 | 97 | | purposes: |
---|
98 | 98 | | 1. For grant recipients that collect and recycle rechargeable batteries, |
---|
99 | 99 | | expanding operations and ensuring continued operations. |
---|
100 | 100 | | 2. Creating new sites for the collection or recycling of rechargeable batteries. |
---|
101 | 101 | | 3. Purchasing rechargeable battery collection and shipping kits and equipment |
---|
102 | 102 | | for handling damaged or defective rechargeable batteries. |
---|
103 | 103 | | 4. Transporting rechargeable batteries to 3rd-party collection and recycling |
---|
104 | 104 | | facilities. |
---|
105 | 105 | | (b) The department may provide more than one grant under this subsection to |
---|
106 | 106 | | a single responsible unit, municipality, business, tribal government, or nonprofit |
---|
107 | 107 | | organization in the same grant cycle. The department may not provide grants under |
---|
108 | 108 | | this subsection to a single collection site in a total amount greater than $20,000 in |

146 | 146 | | (1) SUPPLEMENTAL FUNDING REQUESTS. |
---|
147 | 147 | | (a) In the 2023-25 fiscal biennium, the department of natural resources shall |
---|
148 | 148 | | request under s. 13.101 (3) that the joint committee on finance supplement the |
---|
149 | 149 | | appropriation under s. 20.370 (4) (hq) with sufficient funds from the environmental |
---|
150 | 150 | | fund for the purpose of providing education to the public under s. 287.21 about the |
---|
151 | 151 | | dangers of rechargeable batteries in the waste and recycling streams and about |
---|
152 | 152 | | existing options for proper recycling of such batteries. The department shall submit |
---|
153 | 153 | | additional such requests as needed for this purpose after the 2023-25 fiscal |
---|
154 | 154 | | biennium. |
---|
155 | 155 | | (b) In the 2023-25 fiscal biennium, the department of natural resources shall |
---|
156 | 156 | | request under s. 13.101 (3) that the joint committee on finance supplement the |
---|
157 | 157 | | appropriation under s. 20.370 (4) (hq) with sufficient funds from the environmental |
---|
158 | 158 | | fund for the purpose of providing grants under s. 287.25. The department shall |
