1111 AN ACT to create 252.047 of the statutes; relating to: waivers from
1212 immunization requirements at institutions of higher education.

1414 This bill requires any institution of higher education that receives public
1515 funding and that requires any student or prospective student to receive an
1616 immunization as a condition of attendance to waive the immunization requirement
1717 for a student or prospective student if the student or prospective student objects to
1818 the immunization for reasons of health, religion, or personal conviction. Under the
1919 bill, no institution of higher education may require that a student or prospective
2020 student provide any explanation or justification of the student's or prospective
2121 student's objection to an immunization. Further, the bill requires an institution of
2222 higher education that receives public funding to inform a student or prospective
2323 student of the student's or prospective student's right to a waiver from the institution
2424 of higher education's immunization requirements in writing at any time the
2525 institution of higher education informs the student or prospective student of the
2626 immunization requirements.
2727 The people of the state of Wisconsin, represented in senate and assembly, do
2828 enact as follows:
2929 SECTION 1. 252.047 of the statutes is created to read:

3535 252.047 Waiver from immunization requirements at universities,
3636 colleges, and technical colleges. (1) In this section, institution of higher
3737 education has the meaning given in s. 39.395 (1).
3838 (2) If any institution of higher education that receives public moneys requires
3939 any student or prospective student to receive an immunization as a condition of
4040 attendance, the institution of higher education shall waive the immunization
4141 requirement if the student or prospective student objects to the immunization for
4242 reasons of health, religion, or personal conviction. No institution of higher education
4343 may require that a student or prospective student provide any explanation or
4444 justification for the student's or prospective student's objection to an immunization
4545 under this section.
4646 (3) At any time an institution of higher education that receives public moneys
4747 informs a student or prospective student of any immunization requirements of the
4848 institution of higher education, the institution of higher education shall inform the
4949 student or prospective student in writing of the student's or prospective student's
5050 right to a waiver under this section.
