11	11	AN ACT to create 252.047 of the statutes; relating to: waivers from
12	12	immunization requirements at institutions of higher education.

14	14	This bill requires any institution of higher education that receives public
15	15	funding and that requires any student or prospective student to receive an
16	16	immunization as a condition of attendance to waive the immunization requirement
17	17	for a student or prospective student if the student or prospective student objects to
18	18	the immunization for reasons of health, religion, or personal conviction. Under the
19	19	bill, no institution of higher education may require that a student or prospective
20	20	student provide any explanation or justification of the student's or prospective
21	21	student's objection to an immunization. Further, the bill requires an institution of
22	22	higher education that receives public funding to inform a student or prospective
23	23	student of the student's or prospective student's right to a waiver from the institution
24	24	of higher education's immunization requirements in writing at any time the
25	25	institution of higher education informs the student or prospective student of the
26	26	immunization requirements.
27	27	The people of the state of Wisconsin, represented in senate and assembly, do
28	28	enact as follows:
29	29	SECTION 1. 252.047 of the statutes is created to read:

35	35	252.047 Waiver from immunization requirements at universities,
36	36	colleges, and technical colleges. (1) In this section, institution of higher
37	37	education has the meaning given in s. 39.395 (1).
38	38	(2) If any institution of higher education that receives public moneys requires
39	39	any student or prospective student to receive an immunization as a condition of
40	40	attendance, the institution of higher education shall waive the immunization
41	41	requirement if the student or prospective student objects to the immunization for
42	42	reasons of health, religion, or personal conviction. No institution of higher education
43	43	may require that a student or prospective student provide any explanation or
44	44	justification for the student's or prospective student's objection to an immunization
45	45	under this section.
46	46	(3) At any time an institution of higher education that receives public moneys
47	47	informs a student or prospective student of any immunization requirements of the
48	48	institution of higher education, the institution of higher education shall inform the
49	49	student or prospective student in writing of the student's or prospective student's
50	50	right to a waiver under this section.
