human trafficking of adults at risk for the purpose of commercial sex acts and
providing a penalty.
Analysis by the Legislative Reference Bureau
Under current law it is a Class D felony to traffick an adult for the purpose of
commercial sex acts and it is a Class C felony to traffick a child for the purpose of
commercial sex acts. This bill increases the felony classification to a Class C felony
for trafficking an adult for the purpose of commercial sex acts if the adult is an adult

at risk. Under the bill, an “adult at risk” is defined as an adult who has a physical
or mental condition that substantially impairs his or her ability to care for his or her
needs and who has experienced, is currently experiencing, or is at risk of
experiencing abuse, neglect, self-neglect, or financial exploitation.
Because this bill creates a new crime or revises a penalty for an existing crime,
the Joint Review Committee on Criminal Penalties may be requested to prepare a
report.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1. 48.371 (3) (d) of the statutes is amended to read:
48.371 (3) (d) Any involvement of the child, whether as victim or perpetrator,
in sexual intercourse or sexual contact in violation of s. 940.225, 948.02, 948.025, or
948.085, prostitution in violation of s. 944.30 (1m), trafficking in violation of s.
940.302 (2) if s. 940.302 (2) (a) 1. b. applies or in violation of s. 940.303, sexual
exploitation of a child in violation of s. 948.05, trafficking of a child in violation of s.
948.051, or causing a child to view or listen to sexual activity in violation of s.
948.055, if the information is necessary for the care of the child or for the protection
of any person living in the foster home, group home, or residential care center for
children and youth or in the home of the relative.
SECTION 2. 103.10 (1m) (b) 6. of the statutes is amended to read:
103.10 (1m) (b) 6. “Sexual abuse" means conduct that is in violation of s.
940.225, 940.303, 944.30 (1m), 948.02, 948.025, 948.05, 948.051, 948.055, 948.06,
948.085, 948.09, or 948.10 or that is in violation of s. 940.302 (2) if s. 940.302 (2) (a)
1. b. applies.
SECTION 3. 103.34 (1) (b) 2. of the statutes is amended to read:
103.34 (1) (b) 2. A violation of s. 940.01, 940.02, 940.03, 940.05, 940.06, 940.07,

250.04 (14) (a) Subject to the availability of funds and to par. (b), the
department may provide or fund emergency services or assistance to victims of s.
940.302 (2), 940.303, or 948.051.
SECTION 18. 301.45 (1d) (b) of the statutes is amended to read:
301.45 (1d) (b) “Sex offense" means a violation, or the solicitation, conspiracy,
or attempt to commit a violation, of s. 940.22 (2), 940.225 (1), (2) or (3), 940.303,
944.06, 944.18, 948.02 (1) or (2), 948.025, 948.05, 948.051, 948.055, 948.06, 948.07

905.045 (1) (a) “Abusive conduct" means abuse, as defined in s. 813.122 (1) (a),
of a child, as defined in s. 813.122 (1) (b), interspousal battery, as described under s.
940.19 or 940.20 (1m), domestic abuse, as defined in s. 813.12 (1) (am), sexual
exploitation by a therapist under s. 940.22, sexual assault under s. 940.225, human
trafficking involving a commercial sex act under s. 940.302 or 940.303, or child
sexual abuse under s. 948.02, 948.025, or 948.05 to 948.11.
SECTION 22. 939.46 (1m) of the statutes is amended to read:
939.46 (1m) A victim of a violation of s. 940.302 (2), 940.303, or 948.051 has
an affirmative defense for any offense committed as a direct result of the violation
of s. 940.302 (2), 940.303. or 948.051 without regard to whether anyone was
prosecuted or convicted for the violation of s. 940.302 (2), 940.303, or 948.051.
SECTION 23. 939.615 (1) (b) 1. of the statutes is amended to read:
939.615 (1) (b) 1. A violation, or the solicitation, conspiracy, or attempt to
commit a violation, of s. 940.22 (2), 940.225 (1), (2), or (3), 940.303, 948.02 (1) or (2),
948.025 (1), 948.05 (1) or (1m), 948.051, 948.055 (1), 948.06, 948.07, 948.075, 948.08,

SECTION 25. 940.302 (2) (a) (intro.) of the statutes is amended to read:
940.302 (2) (a) (intro.) Except as provided in s. 940.303 or 948.051, whoever
knowingly engages in trafficking is guilty of a Class D felony if all of the following
apply:
SECTION 26. 940.303 of the statutes is created to read:
940.303 Trafficking of an adult at risk. (1) In this section:
(a) “Adult at risk” has the meaning given in s. 55.01 (1e).
(b) “Commercial sex act” has the meaning given in s. 940.302 (1) (a).
(2) Whoever knowingly recruits, entices, provides, obtains, harbors,
transports, patronizes, or solicits or knowingly attempts to recruit, entice, provide,
obtain, harbor, transport, patronize, or solicit an adult at risk for the purpose of
commercial sex acts is guilty of a Class C felony.
(3) Whoever benefits in any manner from a violation of sub. (2) is guilty of a
Class C felony if the person knows that the benefits come from an act described in
sub. (2).
(4) Any person who incurs an injury or death as a result of a violation of sub.
(2) or (3) may bring a civil action against the person who committed the violation.
In addition to actual damages, the court may award punitive damages to the injured
party, not to exceed treble the amount of actual damages incurred, and reasonable
attorney fees.
SECTION 27. 941.29 (1g) (a) of the statutes, as affected by 2023 Wisconsin Act
10, is amended to read:
941.29 (1g) (a) “Violent felony" means any felony under s. 943.23 (1m), 1999
stats., s. 943.23 (1r), 1999 stats., or s. 943.23 (1g), 2021 stats., this section, or s.
940.01, 940.02, 940.03, 940.05, 940.06, 940.08, 940.09, 940.10, 940.19, 940.195,

SECTION 30. 950.045 (1) (a) of the statutes is amended to read:
950.045 (1) (a) In addition to all rights afforded to victims under s. 950.04, an
individual who is a victim of a violation of s. 940.22, 940.225, 940.302, 940.303,
948.02, 948.025, or 948.05 to 948.11 has the right to be accompanied by a victim
advocate at law enforcement interviews, subject to par. (b) or (c) and except as
provided in par. (c) or (d).
SECTION 31. 950.045 (2) (a) of the statutes is amended to read:
950.045 (2) (a) In addition to all rights afforded to victims under s. 950.04, an
individual who is a victim of a violation of s. 940.22, 940.225, 940.302, 940.303,
948.02, 948.025, or 948.05 to 948.11 has a right to be accompanied by a victim
advocate at interviews and proceedings at which he or she is requested or allowed
to attend that are related to the crime committed against him or her, including
prosecution interviews, department of corrections proceedings, court proceedings,
and postconviction proceedings, except as provided in s. 950.045 (1) (c) and (d).

970.03 (4) (a) If the defendant is accused of a crime under s. 940.225, 940.303,
948.02, 948.025, 948.05, 948.051, 948.06, 948.085, or 948.095, or under s. 940.302 (2),
if the court finds that the crime was sexually motivated, as defined in s. 980.01 (5),
the court may exclude from the hearing all persons who are not officers of the court,
members of the complainant's or defendant's families or others considered by the
court to be supportive of the complainant or defendant, the service representative,
as defined in s. 895.45 (1) (c), or other persons required to attend, if the court finds
that the state or the defendant has established a compelling interest that would
likely be prejudiced if the persons were not excluded. The court may consider as a
compelling interest, among others, the need to protect a complainant from undue
embarrassment and emotional trauma.
SECTION 35. 971.31 (11) of the statutes is amended to read:
971.31 (11) In actions under s. 940.225, 940.303, 948.02, 948.025, 948.051,
948.085, or 948.095, or under s. 940.302 (2), if the court finds that the crime was
sexually motivated, as defined in s. 980.01 (5), evidence which is admissible under
s. 972.11 (2) must be determined by the court upon pretrial motion to be material to
a fact at issue in the case and of sufficient probative value to outweigh its
inflammatory and prejudicial nature before it may be introduced at trial.
SECTION 36. 972.11 (2) (b) (intro.) of the statutes is amended to read:
972.11 (2) (b) (intro.) If the defendant is accused of a crime under s. 940.225,
940.303, 942.09, 948.02, 948.025, 948.05, 948.051, 948.06, 948.07, 948.08, 948.085,
948.09, or 948.095, or under s. 940.302 (2), if the court finds that the crime was
sexually motivated, as defined in s. 980.01 (5), any evidence concerning the
complaining witness's prior sexual conduct or opinions of the witness's prior sexual
conduct and reputation as to prior sexual conduct shall not be admitted into evidence

during the course of the hearing or trial, nor shall any reference to such conduct be
made in the presence of the jury, except the following, subject to s. 971.31 (11):
SECTION 37. 973.015 (2m) (a) of the statutes is amended to read:
973.015 (2m) (a) The person was a victim of trafficking for the purposes of a
commercial sex act, as defined in s. 940.302 (1) (a), under s. 940.302, 940.303, or
948.051 or under 22 USC 7101 to 7112.
SECTION 38. 973.075 (1) (b) 3. of the statutes is amended to read:
973.075 (1) (b) 3. In the commission of a crime in violation of s. 940.302,
940.303, 944.30 (1m), 944.31, 944.32, 944.33, 944.34, 948.02, 948.025, 948.05,
948.051, 948.055, 948.06, 948.07, 948.08, 948.081, 948.09, 948.10, 948.12, or 948.14.
SECTION 39. 973.075 (2) (intro.) of the statutes is amended to read:
973.075 (2) (intro.) A law enforcement officer may seize property subject to this
section upon process issued by any court of record having jurisdiction over the
property. Except for vehicles used in the commission of a crime in violation of s.
940.302, 940.303, 944.30 (1m), 944.31, 944.32, 944.33, 944.34, 948.02, 948.025,
948.05, 948.051, 948.055, 948.06, 948.07, 948.08, 948.081, 948.09, 948.10, 948.12, or
948.14, seizure without process may be made under any of the following
circumstances:
SECTION 40. 973.123 (1) of the statutes, as affected by 2023 Wisconsin Act 10,
is amended to read:
973.123 (1) In this section, “violent felony" means any felony under s. 943.23
(1m), 1999 stats., s. 943.23 (1r), 1999 stats., or s. 943.23 (1g), 2021 stats., or s. 940.01,
940.02, 940.03, 940.05, 940.06, 940.08, 940.09, 940.10, 940.19, 940.195, 940.198,
