AN ACT to create 118.07 (1m) of the statutes; relating to: requiring public and
private schools to offer a minimum amount of physical activity each week.

Under this bill, beginning in the 2024-25 school year, public schools, including
independent charter schools, and private schools participating in a parental choice
program must offer at least 180 minutes of physical activity each week to pupils in
kindergarten to eighth grade. Under the bill, physical activity is defined as
participation in exercise, sports, recreation, wellness, or fitness activities.  The bill
specifies that physical activity may occur during recess, physical education class,
school-sponsored athletics, or any other school-sponsored activity.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1.  118.07 (1m) of the statutes is created to read:
118.07 (1m) (a)  In this subsection, “physical activity” means participation in
exercise, sports, games, recreation, wellness, or fitness activities.  “Physical activity”
includes participation during recess, physical education class, school-sponsored
athletics, or any other school-sponsored activity.

(b)  Every school board, governing body of a private school participating in a
program under s. 118.60 or 119.23, and governing board of a charter school shall
ensure that during each week of a school term at least 180 minutes of physical
activity is offered to pupils in the elementary grades during school hours.  This
paragraph does not apply to a school board, governing body of a private school
participating in a program under s. 118.60 or 119.23, or governing board of a charter
school that does not operate elementary grades.
SECTION 2.0Initial applicability.
(1)  This act first applies to the 2024-25 school year.
