11	11	AN ACT to create 71.05 (6) (b) 57., 71.26 (1) (j), 71.45 (1) (e) and 253.17 of the
12	12	statutes; relating to: childhood obesity prevention and management grants.

14	14	This bill requires the Department of Health Services, in coordination with
15	15	relevant state agencies, to award two-year grants to organizations, cities, villages,
16	16	towns, counties, school districts, or Indian tribes for childhood obesity prevention
17	17	and management programs. Under the bill, “childhood obesity prevention and
18	18	management program” means any of the following designed to assist a person who
19	19	is 22 years of age or younger or an unborn child (collectively, “child”):
20	20	1. Early interventions and screenings to better identify and promote healthy
21	21	growth and development and to prevent and manage childhood obesity.
22	22	2. Parental support for and education on childhood weight management,
23	23	including support for guardians, caregivers, or others who have or will have
24	24	responsibility for the child other than the parent.
25	25	3. Removal of barriers and promotion of better access to proper nutrition and
26	26	spaces for play and other physical activities.
27	27	4. School-based efforts to impact circumstances contributing to childhood
28	28	weight management.
29	29	5. Early childhood care and education, including both school-based and
30	30	out-of-school care efforts to impact circumstances contributing to healthy growth
31	31	and development and reduce childhood obesity.
32	32	6. Any other type of program, approach, or innovative practice that addresses
33	33	the factors that prevent childhood obesity and mitigate its impact.

38	38	The bill prohibits DHS from awarding a grant unless the applicant
39	39	demonstrates that its program includes or will include participation of both a child
40	40	and the child's parent or guardian (unless the child is not born or the child is 18 years
41	41	of age or older), the applicant agrees to provide nonidentifying data on program
42	42	results and effectiveness, and the applicant contributes matching funds or in-kind
43	43	services with a value equal to at least 25 percent of the grant amount. The bill
44	44	requires DHS to prioritize applications in which all of the applicant's matching funds
45	45	or in-kind services are provided by nongovernmental entities and then, if sufficient
46	46	funds are available, applications with the most matching funds or in-kind services
47	47	provided by nongovernmental entities.
48	48	The bill allows DHS to renew a grant at the end of the two-year grant period.
49	49	If sufficient funds are available, the bill requires DHS to renew a grant at the same
50	50	amount previously awarded if all of the grant recipient's matching funds or in-kind
51	51	services are provided by nongovernmental entities and the recipient has shown to
52	52	DHS's satisfaction that the program is effective. The bill allows DHS to renew a
53	53	grant at a higher amount than previously awarded if the recipient has increased the
54	54	amount of matching funds or in-kind services provided by nongovernmental
55	55	entities.
56	56	Under the bill, DHS must submit an annual report on the childhood obesity
57	57	prevention and management program grants to the legislature.
58	58	The bill also provides an individual income tax subtraction and a corporate
59	59	income and franchise tax exemption for any amount of money or in-kind services
60	60	provided to a grant recipient that is used to satisfy the matching requirement under
61	61	the bill.
62	62	Because this bill relates to an exemption from state or local taxes, it may be
63	63	referred to the Joint Survey Committee on Tax Exemptions for a report to be printed
64	64	as an appendix to the bill.
65	65	For further information see the state fiscal estimate, which will be printed as
66	66	an appendix to this bill.
67	67	The people of the state of Wisconsin, represented in senate and assembly, do
68	68	enact as follows:
69	69	SECTION 1. 71.05 (6) (b) 57. of the statutes is created to read:
70	70	71.05 (6) (b) 57. For taxable years beginning after December 31, 2023, any
71	71	amount of money or in-kind services provided to a recipient of a grant under s. 253.17
72	72	that is used by the grant recipient to satisfy the matching requirement under s.
73	73	253.17 (3) (c).
74	74	SECTION 2. 71.26 (1) (j) of the statutes is created to read:

85	85	71.26 (1) (j) Money or services used for satisfying childhood obesity prevention
86	86	and management grant matching requirement. For taxable years beginning after
87	87	December 31, 2023, any amount of money or in-kind services provided to a recipient
88	88	of a grant under s. 253.17 that is used by the grant recipient to satisfy the matching
89	89	requirement under s. 253.17 (3) (c).
90	90	SECTION 3. 71.45 (1) (e) of the statutes is created to read:
91	91	71.45 (1) (e) Money or services used for satisfying childhood obesity prevention
92	92	and management grant matching requirement. For taxable years beginning after
93	93	December 31, 2023, any amount of money or in-kind services provided to a recipient
94	94	of a grant under s. 253.17 that is used by the grant recipient to satisfy the matching
95	95	requirement under s. 253.17 (3) (c).
96	96	SECTION 4. 253.17 of the statutes is created to read:
97	97	253.17 Childhood obesity prevention and management grants. (1) In
98	98	this section:
99	99	(a) “Child” means an individual who is 22 years of age or younger or an unborn
100	100	child.
101	101	(b) “Childhood obesity prevention and management program” means any of the
102	102	following designed to assist a child:
103	103	1. Early interventions and screenings to better identify and promote healthy
104	104	growth and development and to prevent and manage childhood obesity.
105	105	2. Parental support for and education on childhood weight management,
106	106	including support for guardians, caregivers, or others who have or will have
107	107	responsibility for the child other than the parent.
108	108	3. Removal of barriers and promotion of better access to proper nutrition and
109	109	spaces for play and other physical activities.

144	144	(2) The department, in coordination with relevant state agencies, shall award
145	145	grants to organizations, coalitions of organizations, cities, villages, towns, counties,
146	146	school districts, or Indian tribes in this state for childhood obesity prevention and
147	147	management programs. The department shall award a grant under this section for
148	148	a 2-year period.
149	149	(3) The department may not award a grant under this section unless the
150	150	applicant demonstrates all of the following:
151	151	(a) The applicant's childhood obesity prevention and management program
152	152	includes or will include participation of both a child and the child's parent or
153	153	guardian, except for all of the following:
154	154	1. If the child is 18 years of age or older, the child's parent or guardian need not
155	155	participate.
156	156	2. If the child is not born, only the parent's participation is required.
157	157	(b) The applicant agrees to provide the department with nonidentifying data
158	158	on program results and effectiveness.
159	159	(c) The applicant contributes matching funds or in-kind services with a value
160	160	equal to at least 25 percent of the grant amount requested.

189	189	(4) In awarding a grant under this section, the department shall give first
190	190	priority to applications in which all of the applicant's matching funds or in-kind
191	191	services are provided by nongovernmental entities. If sufficient funds are available,
192	192	the department shall then give priority to applications with the most matching funds
193	193	or in-kind services provided by nongovernmental entities.
194	194	(5) (a) Subject to pars. (b) and (c), the department may renew a grant at the end
195	195	of the 2-year grant period.
196	196	(b) If sufficient funds are available, the department shall renew a grant at the
197	197	same amount previously awarded if all of the following are true:
198	198	1. The renewal request is from a grant recipient for which all matching funds
199	199	or in-kind services will be provided by nongovernmental entities or a grant recipient,
200	200	regardless of whether the grant recipient met this standard for the previous grant.
201	201	2. The grant recipient has provided evidence satisfactory to the department
202	202	showing that its childhood obesity prevention and management program is effective.
203	203	(c) The department may renew a grant at a higher amount than previously
204	204	awarded if the grant recipient has increased the amount of matching funds or
205	205	in-kind services provided by nongovernmental entities.
206	206	(6) On an annual basis, the department shall submit a report to the legislature
207	207	under s. 13.172 (2) on the grant program under this section. The report shall include
208	208	all of the following:
209	209	(a) A description of each type of program funded.
210	210	(b) The percentages of nongovernmental matching funds and in-kind services
211	211	offered by each grant recipient.
212	212	(c) The number of participants enrolled in or reached by each funded childhood
213	213	obesity prevention and management program.

242	242	funded childhood obesity prevention and management program.
243	243	(e) The effectiveness of each funded childhood obesity prevention and
244	244	management program to address factors related to childhood obesity.
