9	9	AN ACT to renumber and amend 77.51 (9) (e); and to create 77.51 (9) (e) 1. and
10	10	2. of the statutes; relating to: the sales and use tax exemption for personal
11	11	farm property or household goods sold by auction on the Internet.
12	12	Analysis by the Legislative Reference Bureau
13	13	Current law provides a sales and use tax exemption for five or fewer auctions
14	14	for the sale of personal farm property or household goods that are held by the same
15	15	auctioneer at the same location during the year. This bill provides that the
16	16	exemption applies to five or fewer auction events that are the sale of such property
17	17	or goods held by the same auctioneer at the same location during the year. Under
18	18	the bill, an auction event is the total number of consecutive days for which property
19	19	at that location is available for bidding. With respect to an auction for which all or
20	20	some of the bids may be submitted over the Internet, an auction event is the total
21	21	number of consecutive days that winning bids are selected, regardless of whether the
22	22	property being sold is at multiple locations.
23	23	Because this bill relates to an exemption from state or local taxes, it may be
24	24	referred to the Joint Survey Committee on Tax Exemptions for a report to be printed
25	25	as an appendix to the bill.

27	27	printed as an appendix to this bill.
28	28	The people of the state of Wisconsin, represented in senate and assembly, do
29	29	enact as follows:

35	35	SECTION 1. 77.51 (9) (e) of the statutes is renumbered 77.51 (9) (e) (intro.) and
36	36	amended to read:
37	37	77.51 (9) (e) (intro.) Five or fewer auctions auction events that are the sale of
38	38	personal farm property or household goods and that are held by the same auctioneer
39	39	at the same location during the year. For purposes of this paragraph, an auction
40	40	event is the total number of consecutive days for which property at that location is
41	41	available for bidding. With respect to an auction for which all or some of the bids may
42	42	be submitted over the Internet, an auction event is the total number of consecutive
43	43	days that winning bids are selected, regardless of whether the property being sold
44	44	is at multiple locations. In this paragraph, with respect to indoor locations, “location"
45	45	means a building, except that in the case of a shopping center or a shopping mall
46	46	“location" means a store.:
47	47	SECTION 2. 77.51 (9) (e) 1. and 2. of the statutes are created to read:
48	48	77.51 (9) (e) 1. “Auctioneer” means a person, including an auction company as
49	49	defined in s. 480.01 (2), that is licensed to conduct an auction under the laws of this
50	50	state.
51	51	2. “Location” means the building or street address where the property to be
52	52	auctioned is physically located at the time of the auction. With respect to a shopping
53	53	center or shopping mall, “location” means a store.
54	54	SECTION 3.0Effective date.
55	55	(1) This act takes effect on the first day of the 3rd month beginning after
56	56	publication.
