88 AN ACT to create 46.995 (2g) (c) and 46.995 (2m) of the statutes; relating to:

1111 Under current law, the Department of Health Services is required to determine
1212 the amount of contribution that a county is required to maintain based on historical
1313 county expenditures for the Children's Long-Term Support program and may
1414 require counties to maintain a specified level of contribution for the program. This
1515 bill sunsets the current funding methodology after December 31, 2024, and requires
1616 DHS, in cooperation with counties, to review county contributions and develop a
1717 revised funding methodology for the Children's Long-Term Support program to take
1818 effect on January 1, 2025. In developing a revised funding methodology, the bill
1919 prohibits DHS from requiring counties to maintain any level of contribution. The
2020 Children's Long-Term Support program is a program operating under a waiver of
2121 federal Medicaid law to provide home and community-based services to children
2222 with disabilities. The Children's Long-Term Support program is referred to as the
2323 disabled children's long-term support program in the bill.

2525 printed as an appendix to this bill.
2626 The people of the state of Wisconsin, represented in senate and assembly, do
2727 enact as follows:

3232 SECTION 1. 46.995 (2g) (c) of the statutes is created to read:
3333 46.995 (2g) (c) This subsection does not apply after December 31, 2024.
3434 SECTION 2. 46.995 (2m) of the statutes is created to read:
3535 46.995 (2m) (a) Beginning on the effective date of this paragraph .... [LRB
3636 inserts date], the department shall cooperate with counties to review county
3737 contributions under sub. (2g) and develop a revised funding methodology for the
3838 disabled children's long-term support program.
3939 (b) In developing a revised funding methodology under par. (a), the department
4040 may not require a county to maintain any level of contribution for the disabled
4141 children's long-term support program.
4242 (c) The revised funding methodology under par. (a) shall take effect on January
4343 1, 2025.
4444 SECTION 3.0Nonstatutory provisions.
4545 (1) No later than June 1, 2024, the department of health services shall report
4646 to the appropriate standing committees of the legislature, as determined by the
4747 speaker of the assembly and the president of the senate, in the manner provided
4848 under s. 13.172 (3), and to the joint committee on finance the amount and source of
4949 moneys that may be reallocated following implementation of the revised funding
5050 methodology under s. 46.995 (2m) (a).
