9+AN ACT to amend 341.14 (1a), 341.14 (1e) (a), 341.14 (1m), 341.14 (1q), 343.51
10+(1) and 343.62 (4) (a) 4. of the statutes; relating to: authorizing physical
11+therapists to make certifications for acquiring disabled parking plates and
612 cards.
7-The people of the state of Wisconsin, represented in
8-senate and assembly, do enact as follows:
9-SECTION 1. 341.14 (1a) of the statutes is amended to
10-read:
11-341.14 (1a)  If any resident of this state, who is regis-
12-tering or has registered an automobile, or a motor truck,
13-dual purpose motor home or dual purpose farm truck
14-which has a gross weight of not more than 8,000 pounds,
15-a farm truck which has a gross weight of not more than
16-12,000 pounds or a motor home, submits a statement
17-once every 4 years, as determined by the department,
18-from a physician licensed to practice medicine in any
19-state, from an advanced practice nurse licensed to prac-
20-tice nursing in any state, from a public health nurse certi-
21-fied or licensed to practice in any state, from a physician
22-assistant licensed or certified to practice in any state,
23-from a podiatrist licensed to practice in any state, from a
24-chiropractor licensed to practice chiropractic in any state,
25-from a physical therapist licensed to practice in any state,
26-or from a Christian Science practitioner residing in this
27-state and listed in the Christian Science journal certifying
28-to the department that the resident is a person with a dis-
29-ability that limits or impairs the ability to walk, the
30-department shall procure, issue and deliver to the dis-
31-abled person plates of a special design in lieu of plates
32-which ordinarily would be issued for the vehicle, and
33-shall renew the plates.  The plates shall be so designed as
34-to readily apprise law enforcement officers of the fact that
35-the vehicle is owned by a nonveteran disabled person and
36-is entitled to the parking privileges specified in s. 346.50
37-(2a).  No charge in addition to the registration fee shall be
38-made for the issuance or renewal of such plates.
39-SECTION 2. 341.14 (1e) (a) of the statutes is amended
40-to read:
41-341.14 (1e) (a)  If any resident of this state, who is reg-
42-istering or has registered a motorcycle, submits a state-
43-ment once every 4 years, as determined by the depart-
44-ment, from a physician licensed to practice medicine in
45-any state, from an advanced practice nurse licensed to
46-practice nursing in any state, from a public health nurse
47-certified or licensed to practice in any state, from a physi-
48-cian assistant licensed or certified to practice in any state,
49-from a podiatrist licensed to practice in any state, from a
50-chiropractor licensed to practice chiropractic in any state,
51-from a physical therapist licensed to practice in any state,
52-from a Christian Science practitioner residing in this state
53-and listed in the Christian Science journal, or from the
54-U.S. department of veterans affairs certifying to the
55-department that the resident is a person with a disability
56-that limits or impairs the ability to walk, the department
57-shall procure, issue and deliver to the disabled person a
58-plate of a special design in lieu of the plate which ordinar-

64-of the physician, advanced practice nurse, public health
65-nurse, physician assistant, podiatrist, chiropractor, physi-
66-cal therapist, practitioner, or U.S. department of veterans
67-affairs as to the duration of the disability.  The plate shall
68-be so designed as to readily apprise law enforcement offi-
69-cers of the fact that the motorcycle is owned by a disabled
70-person and is entitled to the parking privileges specified

73-SECTION 3. 341.14 (1m) of the statutes is amended to
74-read:
75-341.14 (1m)  If any licensed driver submits to the
76-department a statement once every 4 years, as determined
77-by the department, from a physician licensed to practice
78-medicine in any state, from a public health nurse certified
79-or licensed to practice in any state, from an advanced
80-practice nurse licensed to practice nursing in any state,
81-from a physician assistant licensed or certified to practice
82-in any state, from a podiatrist licensed to practice in any
83-state, from a chiropractor licensed to practice chiroprac-
84-tic in any state, from a physical therapist licensed to prac-
85-tice in any state, or from a Christian Science practitioner
86-residing in this state and listed in the Christian Science
87-journal certifying that another person who is regularly
88-dependent on the licensed driver for transportation is a
89-person with a disability that limits or impairs the ability
90-to walk, the department shall issue and deliver to the
91-licensed driver plates of a special design in lieu of the
92-plates which ordinarily would be issued for the automo-
93-bile or motor truck, dual purpose motor home or dual pur-
94-pose farm truck having a gross weight of not more than
95-8,000 pounds, farm truck having a gross weight of not
96-more than 12,000 pounds or motor home, and shall renew
97-the plates.  The plates shall be so designed as to readily
98-apprise law enforcement officers of the fact that the vehi-
99-cle is operated by a licensed driver on whom a disabled
100-person is regularly dependent and is entitled to the park-
101-ing privileges specified in s. 346.50 (2a).  No charge in
102-addition to the registration fee may be made for the
103-issuance or renewal of the plates.  The plates shall con-
104-form to the plates required in sub. (1a).
105-SECTION 4. 341.14 (1q) of the statutes is amended to
106-read:
107-341.14 (1q)  If any employer who provides an auto-
108-mobile, or a motor truck, dual purpose motor home or
109-dual purpose farm truck which has a gross weight of not
110-more than 8,000 pounds, a farm truck which has a gross
111-weight of not more than 12,000 pounds or a motor home,
112-for an employee’s use submits to the department a state-
113-ment once every 4 years, as determined by the depart-
114-ment, from a physician licensed to practice medicine in
115-any state, from an advanced practice nurse licensed to
116-practice nursing in any state, from a public health nurse
117-certified or licensed to practice in any state, from a physi-
118-cian assistant licensed or certified to practice in any state,
119-from a podiatrist licensed to practice in any state, from a
120-physical therapist licensed to practice in any state, from
121-a chiropractor licensed to practice chiropractic in any
122-state, or from a Christian Science practitioner residing in
123-this state and listed in the Christian Science journal certi-
124-fying that the employee is a person with a disability that
125-limits or impairs the ability to walk, the department shall
126-issue and deliver to such employer plates of a special
127-design in lieu of the plates which ordinarily would be
128-issued for the vehicle, and shall renew the plates.  The
129-plates shall be so designed as to readily apprise law
130-enforcement officers of the fact that the vehicle is oper-
131-ated by a disabled person and is entitled to the parking
132-privileges specified in s. 346.50 (2a).  No charge in addi-
133-tion to the registration fee may be made for the issuance
134-or renewal of the plates.  The plates shall conform to the
135-plates required in sub. (1a).
136-SECTION 5. 343.51 (1) of the statutes is amended to
137-read:
138-343.51 (1)  Any person who qualifies for registration
139-plates of a special design under s. 341.14 (1), (1a), (1m),
140-or (1q) or any other person with a disability that limits or
141-impairs the ability to walk may request from the depart-
142-ment a special identification card that will entitle any
143-motor vehicle parked by, or under the direction of, the
144-person, or a motor vehicle operated by or on behalf of the
145-organization when used to transport such a person, to
146-parking privileges under s. 346.50 (2), (2a), and (3).  The
147-department shall issue the card at a fee to be determined
148-by the department, upon submission by the applicant, if
149-the applicant is an individual rather than an organization,
150-of a statement from a physician licensed to practice
151-medicine in any state, from an advanced practice nurse
152-licensed to practice nursing in any state, from a public
153-health nurse certified or licensed to practice in any state,
154-from a physician assistant licensed or certified to practice
155-in any state, from a podiatrist licensed to practice in any
156-state, from a chiropractor licensed to practice chiroprac-
157-tic in any state, from a physical therapist licensed to prac-
158-tice in any state, or from a Christian Science practitioner
159-residing in this state and listed in the Christian Science
160-journal that the person is a person with a disability that
161-limits or impairs the ability to walk.  The statement shall
162-state whether the disability is permanent or temporary
163-and, if temporary, the opinion of the physician, advanced
164-practice nurse, public health nurse, physician assistant,
165-podiatrist, chiropractor, physical therapist, or practi-
166-tioner as to the duration of the disability.  The department
167-shall issue the card upon application by an organization
168-on a form prescribed by the department if the department
169-believes that the organization meets the requirements
170-under this subsection.
171-SECTION 6. 343.62 (4) (a) 4. of the statutes is

173-343.62 (4) (a) 4.  The applicant submits with the
174-application a statement completed within the immedi-
175-ately preceding 24 months, except as provided by rule, by
176-a physician licensed to practice medicine in any state,
177-from an advanced practice nurse licensed to practice
178-nursing in any state, from a physician assistant licensed
179-or certified to practice in any state, from a podiatrist
180-licensed to practice in any state, from a chiropractor
181-licensed to practice chiropractic in any state, from a phys-
182-ical therapist licensed to practice in any state, or from a
183-Christian Science practitioner residing in this state, and
184-listed in the Christian Science journal certifying that, in
185-the medical care provider’s judgment, the applicant is
186-physically fit to teach driving.
187-SECTION 7m.0Effective date.
188-(1)  This act takes effect on the first day of the 10th
189-month beginning after publication.
13+Analysis by the Legislative Reference Bureau
14+This bill authorizes physical therapists to certify to the Department of
15+Transportation information necessary for a person to acquire a disabled parking
16+plate or card.
17+Under current law, a person with a disability that limits or impairs the ability
18+to walk may apply for and obtain from DOT special motor vehicle registration plates
19+or a special identification card entitling a motor vehicle used by the person to certain
20+parking privileges, including parking in spaces reserved for such vehicles. An
21+application for the special plate or card must contain required information from a
22+licensed physician, advanced practice nurse, public health nurse, physician
23+assistant, podiatrist, chiropractor, Christian Science practitioner, or the U.S.
24+Department of Veterans Affairs.
