1010 AN ACT to create 118.16 (2) (cg) 2m. of the statutes; relating to: notice to the
1111 parent or guardian of a habitually truant child.

1313 Under this bill, a school attendance officer must include in the notice provided
1414 to the parent or guardian of a child who is habitually truant, which means the child
1515 has been absent without an excuse for part or all of five or more days during a school
1616 semester, that the parent or guardian may request an evaluation of whether the child
1717 is a child with a disability or, for a child who has been identified as a child with a
1818 disability and for whom an individualized education program has been prepared, a
1919 review of the IEP and, if appropriate, revision of the child's IEP. Under current law,
2020 a school attendance officer must provide a notice to the parent or guardian of a child
2121 who is habitually truant that includes 1) a statement of the parent's or guardian's
2222 responsibility to have the child to attend school regularly; 2) a statement that the
2323 parent or guardian may request certain program or curriculum modifications and
2424 that the child may be eligible for enrollment in a program for children at risk; 3) a
2525 request that the parent or guardian meet with the school to discuss the child's
2626 truancy; and 4) a statement of the penalties that may be imposed on the parent or
2727 guardian if the parent or guardian fails to have the child to attend school regularly.

3434 SECTION 1. 118.16 (2) (cg) 2m. of the statutes is created to read:
3535 118.16 (2) (cg) 2m. A statement that the parent or guardian may request any
3636 of the following:
3737 a. A referral under s. 115.777 for an evaluation of whether the child is a child
3838 with a disability, as defined under s. 115.76 (5).
3939 b. A copy of the information described under s. 115.777 (3) (d).
4040 c. For a child who has been identified as a child with a disability, as defined
4141 under s. 115.76 (5), and for whom an individualized education program under s.
4242 115.787 is in effect, a meeting of the child's individualized education program team
4343 to review and, if appropriate, revise that individualized education program as
4444 provided under s. 115.787 (4).
