99 AN ACT to create 120.18 (1) (cm) of the statutes; relating to: requiring school

1515 The people of the state of Wisconsin, represented in senate and assembly, do
1616 enact as follows:
1717 JOINT LEGISLATIVE COUNCIL PREFATORY NOTE: This bill was prepared for the
1818 Joint Legislative Council[s Special Committee on State-Tribal Relations.
1919 Under current law, the State Superintendent of Public Instruction must conduct
2020 a statewide, biennial assessment of the need for American Indian language and culture
2121 education programs. Various information must be included in this assessment,
2222 including information on the numbers, ages, location, and tribal affiliation of American
2323 Indian pupils. While certain school districts began voluntarily reporting tribal
2424 affiliation data to the Department of Public Instruction (DPI) during the 2021-2022
2525 academic school year, current law does not explicitly require school districts to collect
2626 this information and report it to DPI.

3434 Current law also requires each school district to submit an annual school district
3535 report to DPI. This report must include various information related to the school
3636 district, including the number of children taught in the schools of the school district, the
3737 number of hours of direct pupil instruction provided in each school of the school district,
3838 and the names of all teachers employed by the school district during the school year. The
3939 bill expands the requirements of this report, requiring each school district to report the
4040 numbers, ages, and tribal affiliation of American Indian children attending the schools
4141 of the school district. The requirement that a school district report information relating
4242 to American Indian children attending the schools of the school district does not apply
4343 until the 2026-2027 school year.
4444 SECTION 1. 120.18 (1) (cm) of the statutes is created to read:
4545 120.18 (1) (cm) Beginning with the annual report filed for the 2026-27 school
4646 year, the numbers, ages, and tribal affiliation of American Indian children
4747 attending the schools of the school district during the school year. In this
4848 paragraph, XAmerican IndianY has the meaning given in s. 115.71 (2).
