99 AN ACT to repeal 175.095; to amend 125.32 (3) (a), 125.68 (4) (c) 1. and
1010 990.001 (12) of the statutes; relating to: eliminating daylight saving time in
1111 Wisconsin.
1212 Analysis by the Legislative Reference Bureau
1313 This bill eliminates daylight saving time. Current law defines standard time
1414 and provides that daylight saving time begins at 2 a.m. on the second Sunday in
1515 March and ends at 2 a.m. on the first Sunday in November of each year.
1616 Federal law generally preempts states from deviating from standard time or
1717 eliminating daylight saving time, but federal law allows a state that lies entirely in
1818 one timezone, such as Wisconsin, to observe standard time instead of daylight
1919 saving time as long as the observation is throughout the entire state.
2020 The people of the state of Wisconsin, represented in senate and assembly, do
2121 enact as follows:
2222 SECTION 1. 125.32 (3) (a) of the statutes is amended to read:
2323 125.32 (3) (a) No premises for which a Class XBY license or permit is issued
2424 may remain open between the hours of 2 a.m. and 6 a.m., except as provided in this

3535 paragraph and par. (c). On Saturday and Sunday, the closing hours shall be
3636 between 2:30 a.m. and 6 a.m. except that, on the Sunday that daylight saving time
3737 begins as specified in s. 175.095 (2), the closing hours shall be between 3:30 a.m.
3838 and 6 a.m. On January 1 premises operating under a Class XBY license or permit
3939 are not required to close.
4040 SECTION 2. 125.68 (4) (c) 1. of the statutes is amended to read:
4141 125.68 (4) (c) 1. Subject to subds. 3. and 6. and s. 125.51 (3r) (a) 3., no
4242 premises for which a XClass BY license or permit or a XClass CY license has been
4343 issued may remain open between the hours of 2 a.m. and 6 a.m., except as otherwise
4444 provided in this subdivision and subd. 4. On January 1 premises operating under a
4545 XClass BY license or permit are not required to close. On Saturday and Sunday, no
4646 premises may remain open between 2:30 a.m. and 6 a.m. except that, on the Sunday
4747 that daylight saving time begins as specified in s. 175.095 (2), no premises may
4848 remain open between 3:30 a.m. and 6 a.m. This subdivision does not apply to a
4949 XClass BY license issued to a winery under s. 125.51 (3) (am).
5050 SECTION 3. 175.095 of the statutes is repealed.
5151 SECTION 4. 990.001 (12) of the statutes is amended to read:
5252 990.001 (12) TIME. When time is referred to, the standard of time as provided
5353 by s. 175.09 or 175.095, whichever is applicable, is meant.
5454 SECTION 5. Effective date.
5555 (1) This act takes effect on the first January 1 after publication.
