9	9	AN ACT to repeal 175.095; to amend 125.32 (3) (a), 125.68 (4) (c) 1. and
10	10	990.001 (12) of the statutes; relating to: eliminating daylight saving time in
11	11	Wisconsin.
12	12	Analysis by the Legislative Reference Bureau
13	13	This bill eliminates daylight saving time. Current law defines standard time
14	14	and provides that daylight saving time begins at 2 a.m. on the second Sunday in
15	15	March and ends at 2 a.m. on the first Sunday in November of each year.
16	16	Federal law generally preempts states from deviating from standard time or
17	17	eliminating daylight saving time, but federal law allows a state that lies entirely in
18	18	one timezone, such as Wisconsin, to observe standard time instead of daylight
19	19	saving time as long as the observation is throughout the entire state.
20	20	The people of the state of Wisconsin, represented in senate and assembly, do
21	21	enact as follows:
22	22	SECTION 1. 125.32 (3) (a) of the statutes is amended to read:
23	23	125.32 (3) (a) No premises for which a Class XBY license or permit is issued
24	24	may remain open between the hours of 2 a.m. and 6 a.m., except as provided in this

35	35	paragraph and par. (c). On Saturday and Sunday, the closing hours shall be
36	36	between 2:30 a.m. and 6 a.m. except that, on the Sunday that daylight saving time
37	37	begins as specified in s. 175.095 (2), the closing hours shall be between 3:30 a.m.
38	38	and 6 a.m. On January 1 premises operating under a Class XBY license or permit
39	39	are not required to close.
40	40	SECTION 2. 125.68 (4) (c) 1. of the statutes is amended to read:
41	41	125.68 (4) (c) 1. Subject to subds. 3. and 6. and s. 125.51 (3r) (a) 3., no
42	42	premises for which a XClass BY license or permit or a XClass CY license has been
43	43	issued may remain open between the hours of 2 a.m. and 6 a.m., except as otherwise
44	44	provided in this subdivision and subd. 4. On January 1 premises operating under a
45	45	XClass BY license or permit are not required to close. On Saturday and Sunday, no
46	46	premises may remain open between 2:30 a.m. and 6 a.m. except that, on the Sunday
47	47	that daylight saving time begins as specified in s. 175.095 (2), no premises may
48	48	remain open between 3:30 a.m. and 6 a.m. This subdivision does not apply to a
49	49	XClass BY license issued to a winery under s. 125.51 (3) (am).
50	50	SECTION 3. 175.095 of the statutes is repealed.
51	51	SECTION 4. 990.001 (12) of the statutes is amended to read:
52	52	990.001 (12) TIME. When time is referred to, the standard of time as provided
53	53	by s. 175.09 or 175.095, whichever is applicable, is meant.
54	54	SECTION 5. Effective date.
55	55	(1) This act takes effect on the first January 1 after publication.
