11	11	AN ACT to amend 23.33 (2j) (a) 1. and 340.01 (74); to create 23.33 (1) (gm),
12	12	23.33 (2) (bm) and 340.01 (73e) of the statutes; relating to: all-terrain
13	13	vehicles and utility terrain vehicles with out-of-state registrations.

15	15	This bill provides that a vehicle with out-of-state registration that meets this
16	16	state[s definition of an all-terrain vehicle (ATV) or utility terrain vehicle (UTV) is
17	17	an ATV or UTV, regardless of the vehicle type specified on the out-of-state
18	18	registration, and is subject to legal requirements applicable to ATVs and UTVs. A
19	19	vehicle with out-of-state registration that does not meet this state[s definition of an
20	20	ATV or UTV is not an ATV or UTV and is not eligible for public operation on ATV
21	21	trails or routes as an ATV or UTV.
22	22	The bill modifies the definition of Xpublic all-terrain vehicle corridorY to
23	23	include ATV routes and Xhybrid trails,Y which are combination ATV routes and
24	24	trails. The bill also modifies the definition of Xvehicle,Y as that term is defined for
25	25	purposes related to motor vehicle regulation, to provide that a UTV is not a vehicle,
26	26	Xexcept for purposes made specifically applicable by statute.Y
27	27	The people of the state of Wisconsin, represented in senate and assembly, do
28	28	enact as follows:

36	36	SECTION 1. 23.33 (1) (gm) of the statutes is created to read:
37	37	23.33 (1) (gm) XHybrid trailY means an all-terrain vehicle trail and all-terrain
38	38	vehicle route combination that allows all-terrain vehicles and motor vehicles to use
39	39	the same linear surface and the combination is used to connect one all-terrain
40	40	vehicle trail to another all-terrain vehicle trail or services.
41	41	SECTION 2. 23.33 (2) (bm) of the statutes is created to read:
42	42	23.33 (2) (bm) Vehicles registered out-of-state. 1. A vehicle registered outside
43	43	of this state that meets the definition of an all-terrain vehicle under sub. (1) (b) or a
44	44	utility terrain vehicle under sub. (1) (ng) shall be considered an all-terrain vehicle
45	45	or utility terrain vehicle, regardless of the vehicle type specified on the out-of-state
46	46	registration for the vehicle, and shall be subject to the requirements of this section
47	47	and chs. 340 to 351 that are applicable to all-terrain vehicles or utility terrain
48	48	vehicles.
49	49	2. A vehicle registered outside of this state that does not meet the definition of
50	50	an all-terrain vehicle under sub. (1) (b) or a utility terrain vehicle under sub. (1) (ng)
51	51	is not an all-terrain vehicle or utility terrain vehicle for purposes of this section and
52	52	chs. 340 to 351 and the owner or operator of the vehicle may not be issued a
53	53	nonresident trail pass under sub. (2j) for the vehicle.
54	54	SECTION 3. 23.33 (2j) (a) 1. of the statutes is amended to read:
55	55	23.33 (2j) (a) 1. XPublic all-terrain vehicle corridorY means an all-terrain
56	56	vehicle trail, all-terrain vehicle route, hybrid trail, or other established all-terrain
57	57	vehicle corridor that is open to the public but does not include an all-terrain vehicle
58	58	route.
59	59	SECTION 4. 340.01 (73e) of the statutes is created to read:

88	88	340.01 (73e) XUtility terrain vehicleY has the meaning given in s. 23.33 (1)
89	89	(ng).
90	90	SECTION 5. 340.01 (74) of the statutes is amended to read:
91	91	340.01 (74) XVehicleY means every device in, upon, or by which any person or
92	92	property is or may be transported or drawn upon a highway, except railroad trains.
93	93	A snowmobile, an all-terrain vehicle, a utility terrain vehicle, a personal delivery
94	94	device, an electric scooter, and an electric personal assistive mobility device shall
95	95	not be considered a vehicle except for purposes made specifically applicable by
96	96	statute.
