1212 AN ACT to amend 119.04 (1); to create 118.40 (4) (ar) 3. and 120.12 (29) of the
1313 statutes; relating to: access to public high schools for military recruiters.

1515 In general, federal law requires local educational agencies, such as school
1616 boards and charter schools, that receive federal assistance under the Elementary
1717 and Secondary Education Act of 1965 to provide military recruiters the same access
1818 to secondary school students that the local educational agencies provide to
1919 postsecondary educational institutions or to prospective employers. This bill
2020 requires school boards and governing boards of charter schools to, in addition to
2121 complying with federal law, specifically allow military recruiters access to common
2222 areas in high schools and to allow access during a school day and to school-
2323 sanctioned events. Nothing in the bill requires a school board or governing board of
2424 a charter school to provide a military recruiter access to a high school classroom
2525 during instructional time.
2626 The people of the state of Wisconsin, represented in senate and assembly, do
2727 enact as follows:
2828 SECTION 1. 118.40 (4) (ar) 3. of the statutes is created to read:

3636 118.40 (4) (ar) 3. Allow military recruiters access to high schools operated by
3737 the governing board as required under 10 USC 503 (c), except that regardless of the
3838 access the governing board provides to postsecondary educational institutions or to
3939 prospective employers, the governing board shall allow a military recruiter access to
4040 all of the following:
4141 a. Common areas of a high school building while the military recruiter visits
4242 a high school for recruitment purposes.
4343 b. A high school during a school day or a school-sanctioned event. Nothing in
4444 this subd. 3. b. requires a school board to allow a military recruiter access to a high
4545 school classroom during instructional time.

8888 SECTION 3. 120.12 (29) of the statutes is created to read:
8989 120.12 (29) MILITARY RECRUITERS. Allow military recruiters access to high
9090 schools operated by the school board as required under 10 USC 503 (c), except that
9191 regardless of the access the school board provides to postsecondary educational
9292 institutions or to prospective employers, the school board shall allow a military
9393 recruiter access to all of the following:
9494 (a) Common areas of a high school building while the military recruiter visits
9595 a high school for recruitment purposes.
9696 (b) A high school during a school day or a school-sanctioned event. Nothing in
9797 this paragraph requires a school board to allow a military recruiter access to a high
9898 school classroom during instructional time.
9999 SECTION 4. Initial applicability.
100100 (1) This act first applies to access provided to military recruiters during the
101101 2025-26 school year.
