12	12	AN ACT to amend 119.04 (1); to create 118.40 (4) (ar) 3. and 120.12 (29) of the
13	13	statutes; relating to: access to public high schools for military recruiters.

15	15	In general, federal law requires local educational agencies, such as school
16	16	boards and charter schools, that receive federal assistance under the Elementary
17	17	and Secondary Education Act of 1965 to provide military recruiters the same access
18	18	to secondary school students that the local educational agencies provide to
19	19	postsecondary educational institutions or to prospective employers. This bill
20	20	requires school boards and governing boards of charter schools to, in addition to
21	21	complying with federal law, specifically allow military recruiters access to common
22	22	areas in high schools and to allow access during a school day and to school-
23	23	sanctioned events. Nothing in the bill requires a school board or governing board of
24	24	a charter school to provide a military recruiter access to a high school classroom
25	25	during instructional time.
26	26	The people of the state of Wisconsin, represented in senate and assembly, do
27	27	enact as follows:
28	28	SECTION 1. 118.40 (4) (ar) 3. of the statutes is created to read:

36	36	118.40 (4) (ar) 3. Allow military recruiters access to high schools operated by
37	37	the governing board as required under 10 USC 503 (c), except that regardless of the
38	38	access the governing board provides to postsecondary educational institutions or to
39	39	prospective employers, the governing board shall allow a military recruiter access to
40	40	all of the following:
41	41	a. Common areas of a high school building while the military recruiter visits
42	42	a high school for recruitment purposes.
43	43	b. A high school during a school day or a school-sanctioned event. Nothing in
44	44	this subd. 3. b. requires a school board to allow a military recruiter access to a high
45	45	school classroom during instructional time.

86	86	of a contract, to the commissioner or to any school transferred to an opportunity
87	87	schools and partnership program.
88	88	SECTION 3. 120.12 (29) of the statutes is created to read:
89	89	120.12 (29) MILITARY RECRUITERS. Allow military recruiters access to high
90	90	schools operated by the school board as required under 10 USC 503 (c), except that
91	91	regardless of the access the school board provides to postsecondary educational
92	92	institutions or to prospective employers, the school board shall allow a military
93	93	recruiter access to all of the following:
94	94	(a) Common areas of a high school building while the military recruiter visits
95	95	a high school for recruitment purposes.
96	96	(b) A high school during a school day or a school-sanctioned event. Nothing in
97	97	this paragraph requires a school board to allow a military recruiter access to a high
98	98	school classroom during instructional time.
99	99	SECTION 4. Initial applicability.
100	100	(1) This act first applies to access provided to military recruiters during the
101	101	2025-26 school year.
