13 | 13 | | prohibiting the keeping of up to four chickens or quail (fowl) by property owners or |

14 | 14 | | certain lessors on properties zoned for residential use. The bill specifically allows |

15 | 15 | | political subdivisions and sewerage districts to do any of the following with regard |

16 | 16 | | to the keeping of fowl: |

17 | 17 | | 1. Require a keeper of fowl to obtain a permit. |
---|
18 | 18 | | 2. Require notification of adjoining land owners. |
---|
19 | 19 | | 3. Impose reasonable regulations related to the location of fowl housing on a |
---|
20 | 20 | | property. |
---|
21 | 21 | | 4. Prohibit the keeping of roosters. |

22 | 22 | | 5. Impose reasonable cleanliness standards. |

23 | 23 | | The people of the state of Wisconsin, represented in senate and assembly, do |

24 | 24 | | enact as follows: |

25 | 25 | | SECTION 1. 66.0443 of the statutes is created to read: |

35 | 35 | | (b) XLocal governmental unitY means a city, village, town, county, or sewerage |
---|

37 | 37 | | (2) No local governmental unit may prohibit the keeping of 4 or fewer fowl by |

38 | 38 | | any of the following on a property zoned for residential use: |

39 | 39 | | (a) The owner of the property. A local governmental unit may prohibit any |
---|
40 | 40 | | keeping of fowl that is inconsistent with the condominium[s declarations, bylaws, |
---|
41 | 41 | | and rules on a property that is a condominium. |
---|
42 | 42 | | (b) A lessor of the property if the property is owner-occupied. |
---|
43 | 43 | | (3) Notwithstanding sub. (2), a local governmental unit may do any of the |
---|
44 | 44 | | following with regard to the keeping of fowl: |
---|
45 | 45 | | (a) Require a keeper of fowl to obtain a permit. |

46 | 46 | | (b) Require notification of owners of properties adjoining the property on |
---|
47 | 47 | | which fowl are to be kept. |
