5959 Current law
6060 Current law penalizes the act of causing bodily harm to another person (battery).
6161 The penalties for battery depend on the level of harm caused, the intent of the actor,
6262 and, under certain circumstances, whether the actor or the victim is a member of a
6363 category chosen by the legislature to receive particular consideration.

8181 Battery
8282 A person who causes bodily harm to another, with the intent to cause bodily harm
8383 to that person or another and without the consent of the person harmed, is guilty of the
8484 crime of battery. Battery, sometimes referred to as Xsimple battery,Y is a Class A
8585 misdemeanor.
8686 Substantial battery
8787 A person who causes substantial bodily harm to another, with the intent to cause
8888 bodily harm to that person or another, is guilty of the crime of substantial battery.
8989 Substantial battery is a Class I felony.
9090 Aggravated battery
9191 A person who causes great bodily harm to another is guilty of aggravated battery.
9292 Aggravated battery is a Class H felony if the actor intended to cause bodily harm to that
9393 person or another and a Class E felony if the actor intended to cause great bodily harm
9494 to that person or another.
9595 Additionally, a person who causes bodily harm to another by conduct that creates
9696 a substantial risk of great bodily harm is guilty of aggravated battery. Aggravated
9797 battery under these circumstances is a Class H felony.
9898 Sections 940.20 to 940.208, stats.: Special circumstances battery
9999 Under current law, simple battery (causing bodily harm with the intent to cause
100100 bodily harm and without the consent of the victim) may be elevated to a Class H felony
101101 or a Class I felony if the battery is committed by a particular class of persons or
102102 committed against a particular class of persons. These batteries, called Xspecial
103103 circumstancesY batteries, are codified in ss. 940.20 to 940.208, stats.
104104 Section 940.20, stats., contains several of the special circumstances batteries,
105105 including those committed by a particular class of persons and some of the special
106106 circumstances batteries committed against certain classes of persons. Other special
107107 circumstances are codified in ss. 940.201 to 940.208, stats.
108108 Sections 940.195 and 940.198, stats.: Battery, substantial battery, and aggravated
109109 battery to an unborn child and physical abuse of an elder person
110110 Under current law, a person who causes bodily harm, substantial bodily harm, or
111111 great bodily harm to an unborn child is subject to the same penalties as under s. 940.19,
112112 stats. The intent of the actor may be to cause harm to the unborn child, the mother of
113113 the unborn child, or another.
114114 A person who intentionally or recklessly causes bodily harm to an elder person is
115115 subject to penalties ranging from a Class I felony to a Class C felony, depending on the
116116 degree of harm to the elder person and the intent of the actor.
117117 The bill
118118 This bill recodifies the battery statutes found in ss. 940.19 to 940.208, stats., by
119119 moving them into a newly created subchapter III, entitled XBodily security; battery,Y in
120120 ch. 940, stats. In doing so, the bill generally reorganizes the various crimes of battery
121121 by 1) who the actor is; and 2) who the person harmed is. The bill does not change the
122122 penalty for any crime within the battery statutes that exists under current law. The bill
123123 also makes several changes to the battery statutes:
124124 1. The bill moves most of the definitions that are specifically for the battery
125125 statutes to the beginning of the new subchapter specifically created for the battery
126126 statutes.
127127 2. The bill renumbers the special circumstances batteries to two separate
128128 statutes: the first statute codifies special circumstances batteries on the basis of the
129129 identity of the actor. For example, this first statute includes battery caused by persons
130130 subject to certain injunctions and battery by prisoners or certain detained or committed
131131 persons. The second statute codifies special circumstances batteries on the basis of the
132132 identity of the victim. For example, this second statute includes battery to certain 2025 - 2026 Legislature

137137 individuals involved with a court or legal system. In each statute, the offenses are
138138 separated on the basis of whether the penalty is a Class H felony or Class I felony.
139139 3. The bill expands the definition of Xfamily memberY to also include a
140140 XgrandparentY or Xlegal guardian.Y
141141 4. The bill adds the term XjailY to the crime of bodily harm caused by prisoners to
142142 clarify that this type of facility is included in this crime.
143143 5. The bill combines the various threats to commit a battery into one crime,
144144 entitled XThreatening to cause bodily harm,Y and moves it to ch. 947, stats., relating to
145145 crimes against public peace, order, and other interests. This chapter contains other
146146 criminal threats (e.g., bomb scares, terrorist threats, harassment, etc.).
147147 6. With respect to the crimes of Xbattery, substantial battery, and aggravated
148148 battery to an unborn childY and Xphysical abuse of an elder person,Y ss. 940.195 and
149149 940.198, stats., respectively, the bill does the following: 1) changes the titles of these
150150 crimes to be consistent with other titles used in the bill; 2) moves them into the newly
151151 created subchapter; and 3) otherwise retains the structure of these crimes in their own
152152 separate statutes.
153153 7. At the end of the bill is a table of each statute that cross-references one or more
154154 battery statutes and is affected by the bill. The table lists both the cross-references to
155155 the old battery statute and the new provision recreated in the bill.
156156 SECTION 1. 165.25 (22) (title) of the statutes is created to read:
157157 165.25 (22) (title) POST MODEL LANGUAGE FOR HEALTH CARE FACILITIES.
158158 NOTE: This SECTION creates a new subsection entitled, XPOST MODEL LANGUAGE
159159 FOR HEALTH CARE FACILITIES.Y This subsection is placed in a section of statutes, s.
160160 165.25, stats., that lists the duties of the Department of Justice (DOJ) because SECTION
161161 70 moves language from the Criminal Code that requires DOJ to post certain language
162162 on its website to this list of duties. Specifically, SECTION 70 moves language that
163163 requires DOJ to post on its website model language relating to the penalties for causing
164164 bodily harm or threatening to cause bodily harm to a health care provider or staff to s.
165165 165.25, stats.
166166 SECTION 2. 343.12 (7) (c) 9j. of the statutes is amended to read:
167167 343.12 (7) (c) 9j. Physical abuse of Battery to an elder person under s. 940.198
168168 (2) 940.66 (2) or s. 940.198 (2), 2023 stats.
169169 NOTE: Under current law, the Department of Transportation may not renew a
170170 school bus driver license endorsement if a person has been convicted of specified crimes,
171171 including XPhysical abuse to an elder person.Y This SECTION renumbers and changes
172172 the reference to this crime to XBattery to an elder person,Y and renumbers this crime
173173 consistent with the changes made by this bill.
174174 SECTION 3. 939.22 (21) (e) of the statutes is amended to read:
175175 939.22 (21) (e) Battery, special circumstances by certain persons, as
176176 prohibited in s. 940.20 940.61 or s. 940.20, 2023 stats.; or battery to certain persons,

190190 threatening to cause bodily harm as prohibited in s. 947.016 (1) or (2).
191191 SECTION 4. 939.22 (21) (em) of the statutes is repealed.
192192 NOTE: The Criminal Code defines Xpattern of criminal gang activityY generally to
193193 mean 2 or more specified crimes that have been committed within 3 years of one
194194 another, which must be committed either on separate occasions or, if committed on the
195195 same occasion, by 2 or more persons. This definition includes the following batteries: 1)
196196 battery, substantial battery, and aggravated battery; 2) battery to an unborn child,
197197 substantial battery to an unborn child, and aggravated battery to an unborn child; 3)
198198 special circumstance batteries; and 4) battery to a witness.
199199 SECTION 3 updates the various cross-references to these batteries consistent with
200200 renumbering changes made by this bill. SECTION 4 repeals a separate cross-reference
201201 for battery to a witness, because, under the bill, this crime is now codified in s. 940.62,
202202 stats., which is listed in SECTION 3.

294294 tissue injury, as defined in s. 946.41 (2) (c), to an officer, employee, visitor, or
295295 another inmate of such prison or institution, without his or her consent, is guilty of
296296 a Class H felony.
297297 SECTION 16. 940.20 (1g) of the statutes is renumbered 940.61 (2) (b) and
298298 amended to read:
299299 940.61 (2) (b) Battery by certain detained or committed persons. Any The
300300 person who causes the bodily harm is placed in a facility under s. 980.04 or 980.065
301301 and who intentionally causes the bodily harm to an officer, employee, agent, visitor,
302302 or other resident of the facility, without his or her consent, is guilty of a Class H

304304 NOTE: SECTIONS 15 and 16 codify the crimes of XBattery by prisonersY and
305305 XBattery by certain detained or committed personsY into one subsection. SECTION 15
306306 also adds the term XjailY to the list of places where a prisoner who causes bodily harm to

10121012 (2) CLASS H FELONY BATTERY TO CERTAIN PERSONS. A person who causes
10131013 bodily harm to another by an act done with intent to cause bodily harm to that
10141014 person or another without the consent of the person so harmed is guilty of a Class H
10151015 felony if any of the following applies:
10161016 (a) Battery to certain individuals involved with a court or legal system. The
10171017 person causes the bodily harm to the person or family member of any current or
10181018 former judge, prosecutor, law enforcement officer, guardian ad litem, corporation
10191019 counsel, advocate, attorney, witness, or grand or petit juror, or a person sharing a
10201020 common domicile with a witness, under all of the following circumstances:
10211021 1. At the time of the act, the person knows or has reason to know that the
10221022 victim is a judge, prosecutor, law enforcement officer, guardian ad litem,
10231023 corporation counsel, advocate, attorney, witness, or grand or petit juror or a
10241024 member of their family, or a person sharing a common domicile with a witness.
10251025 2. The act is in response to any action taken by the victim acting in an official
10261026 capacity or in a legal proceeding.
10271027 (c) Battery to department of revenue, department of safety and professional
10281028 services, or department of workforce development employees or their family members.
10291029 NOTE: SECTION 86 creates a title and introductory language for s. 940.62, stats.,
10301030 entitled XBattery; bodily harm caused to certain personsY. SECTION 86 also creates
10311031 certain consolidated and renumbered special circumstances batteries. This created
10321032 statute contains all of the special circumstances battery due to the status of the victim,
10331033 except for the crimes of battery to an unborn child and battery to an elder person.

11211121 supervision agent, or an aftercare agent, or a member of the agent[s family.
11221122 (b) The threat is in response to any action taken by the agent acting in an
11231123 official capacity.
11241124 (3) HEALTH CARE PROVIDERS AND STAFF AND THEIR FAMILY MEMBERS. The
11251125 person threatens a health care provider or a person who works in a health care
11261126 facility or a family member of a health care provider or a person who works in a
11271127 health care facility under all of the following circumstances:
11281128 (a) At the time of the threat, the person knows or should have known that the
11291129 victim works or formerly worked in a health care facility or is a family member of
11301130 the person who works or formerly worked in a health care facility.
11311131 (b) The threat is in response to an action occurring at the health care facility
11321132 or an action by an official, employee, or agent of the health care facility acting in his
11331133 or her official capacity.
11341134 (4) DEPARTMENT OF REVENUE, DEPARTMENT OF SAFETY AND PROFESSIONAL
11351135 SERVICES, AND DEPARTMENT OF WORKFORCE DEVELOPMENT EMPLOYEES AND THEIR
11361136 FAMILY MEMBERS. The person threatens the person or family member of any
11371137 department of revenue, department of safety and professional services, or
11381138 department of workforce development official, employee, or agent under all of the
