42 | 42 | | FREEZING OF ASSETS |
---|
43 | 43 | | Under current law, there is a procedure for a court to freeze or seize assets |
---|
44 | 44 | | from a defendant who has been charged with a financial exploitation crime when |
---|
45 | 45 | | the victim is an elder person. The procedure allows a court to freeze the funds, |
---|
46 | 46 | | assets, or property of the defendant in an amount up to 100 percent of the alleged |
---|
47 | 47 | | value of the property involved in the defendant[s pending criminal proceeding for |
---|
48 | 48 | | purposes of preserving the property for future payment of restitution to the crime |
---|
49 | 49 | | victim. |
---|
50 | 50 | | This bill allows the court to apply the same procedure to freeze or seize assets |
---|
51 | 51 | | when the crime victim an adult at risk. |
---|
52 | 52 | | PHYSICAL ABUSE OF AN ADULT AT RISK |
---|
53 | 53 | | Under current law, there is a set of penalties that apply to physical abuse of an |
---|
54 | 54 | | elder person, which range from a Class I felony to a Class C felony depending on the |
---|
55 | 55 | | severity of the conduct. This bill applies those same penalties to physical abuse of |
---|
56 | 56 | | an adult at risk. |
---|
57 | 57 | | INCREASED PENALTIES |
---|
58 | 58 | | This bill allows a term of imprisonment that is imposed for a criminal |
---|
59 | 59 | | conviction to be increased in length if the crime victim was an adult at risk. Under |
---|
60 | 60 | | the bill, a maximum term of imprisonment of one year or less may be increased to |
---|
61 | 61 | | two years; a maximum term of imprisonment of one to 10 years may be increased by |
---|
62 | 62 | | up to four years; and a maximum term of imprisonment of more than 10 years may |
---|
63 | 63 | | be increased by up to six years. Under the bill, the term of imprisonment may be |
---|
64 | 64 | | lengthened irrespective of whether the defendant knew that the crime victim was |
---|
65 | 65 | | an adult at risk. |
---|
66 | 66 | | RESTRAINING ORDERS FOR AN ADULT AT RISK |
---|
67 | 67 | | Under current law, a person seeking a domestic violence, individual-at-risk, or |
---|
68 | 68 | | harassment restraining order must appear in person in the courtroom at a hearing |
---|
69 | 69 | | to obtain a restraining order. |
---|
70 | 70 | | This bill allows an adult at risk who is seeking a domestic violence, individual- |
---|
71 | 71 | | at-risk, or harassment restraining order to appear in a court hearing by telephone |
---|
72 | 72 | | or live audiovisual means. |
---|
