1111 AN ACT to amend 79.05 (2) (c); to create 256.04 (3) of the statutes; relating to:
1212 reimbursement of emergency services under the Medical Assistance program

1414 practice of emergency medical responders and emergency medical services
1515 practitioners, and eligibility for the expenditure restraint incentive program.

1717 Medical Assistance reimbursement for nontransport ambulance services
1818 Under current law, the Department of Health Services uses a standardized
1919 coding system, which is known as the Healthcare Common Procedure Coding
2020 System (HCPCS) and produced by the federal Centers for Medicare and Medicaid
2121 Services, to describe certain products, supplies, and services for those submitting
2222 claims for reimbursement under the Medical Assistance program. The Medical
2323 Assistance program is a joint state and federal program that provides health
2424 services to individuals who have limited financial resources. This bill directs DHS
2525 to change, for dates of service beginning with January 1, 2027, the current
2626 maximum reimbursement allowed under the Medical Assistance program for
2727 services provided under HCPCS code A0998, often referenced as Xambulance
2828 response and treatment, no transport,Y from the current maximum allowable fee to

4141 Report on scope of practice changes
4242 The bill requires the Emergency Medical Services Board, in consultation with
4343 DHS and the Technical College System Board, to annually submit a report to the
4444 legislature on state and national changes to the scope of practice of emergency
4545 medical responders, emergency medical services practitioners, or any equivalent
4646 practitioners in other jurisdictions and how those scope of practice changes may
4747 affect training for emergency medical responders and emergency medical services
4848 practitioners in this state.
4949 Expenditure restraint incentive program
5050 The bill also excludes expenditures of amounts levied for fees apportioned to
5151 each municipality operating a joint fire department or joint emergency medical
5252 services district that are exempt from local levy limits from being considered in
5353 determining eligibility for an expenditure restraint incentive program payment.
5454 Under current law, a municipality is eligible to receive an expenditure restraint
5555 incentive program payment if its property tax levy is greater than 5 mills and if the
5656 annual increase in its municipal budget, subject to certain exceptions, is less than
5757 the sum of factors based on inflation and the increased value of property in the
5858 municipality as a result of new construction.

6161 The people of the state of Wisconsin, represented in senate and assembly, do
6262 enact as follows:
6363 SECTION 1. 79.05 (2) (c) of the statutes is amended to read:
6464 79.05 (2) (c) Its municipal budget; exclusive of principal and interest on long-
6565 term debt and exclusive of revenue sharing payments under s. 66.0305, payments of
6666 premiums under s. 66.0137 (5) (c) 1. and 1m., expenditures of amounts levied under
6767 s. 66.0602 (3) (h), revenues generated from a tax imposed under s. 77.701, payments
6868 received under s. 79.038, expenditures of payments due to the termination of a tax
6969 incremental district under s. 79.096 (3), recycling fee payments under s. 289.645,
7070 expenditures of grant payments under s. 16.297 (1m), unreimbursed expenses

8383 related to an emergency declared under s. 323.10, expenditures from moneys
8484 received pursuant to P.L. 111-5, grants received from the state or federal
8585 government for the purpose of providing law enforcement, fire protection, or
8686 emergency medical services, and expenditures made pursuant to a purchasing
8787 agreement with a school district whereby the municipality makes purchases on
8888 behalf of the school district; for the year of the statement under s. 79.015 increased
8989 over its municipal budget as adjusted under sub. (6); exclusive of principal and
9090 interest on long-term debt and exclusive of revenue sharing payments under s.
9191 66.0305, payments of premiums under s. 66.0137 (5) (c) 1. and 1m., expenditures of
9292 amounts levied under s. 66.0602 (3) (h), revenues generated from a tax imposed
9393 under s. 77.701, payments received under s. 79.038, expenditures of payments due
9494 to the termination of a tax incremental district under s. 79.096 (3), recycling fee
9595 payments under s. 289.645, expenditures of grant payments under s. 16.297 (1m),
9696 unreimbursed expenses related to an emergency declared under s. 323.10,
9797 expenditures from moneys received pursuant to P.L. 111-5, grants received from the
9898 state or federal government for the purpose of providing law enforcement, fire
9999 protection, or emergency medical services, and expenditures made pursuant to a
100100 purchasing agreement with a school district whereby the municipality makes
101101 purchases on behalf of the school district; for the year before that year by less than
102102 the sum of the inflation factor and the valuation factor, rounded to the nearest 0.10

104104 SECTION 2. 256.04 (3) of the statutes is created to read:

140140 SECTION 3. Nonstatutory provisions.
141141 (1) MEDICAL ASSISTANCE REIMBURSEMENT RATES FOR NONTRANSPORT
142142 AMBULANCE SERVICES. For dates of service beginning with January 1, 2027, the
143143 department of health services shall increase reimbursement rates for services
144144 provided and reimbursable under the healthcare common procedure coding system
145145 code A0998 with a description of Xambulance response and treatment, no
146146 transportY from the current maximum allowable fee to a rate that matches the
147147 maximum allowable rate for reimbursement of services provided under healthcare
148148 common procedure coding system code A0429 with a description of Xambulance
149149 service, basic life support, emergency transport (bls-emergency).Y
