11	11	AN ACT to create 995.80 of the statutes; relating to: governmental restrictions
12	12	based on the energy source of a motor vehicle or other device.

14	14	Under this bill, no state agency and no local governmental unit may restrict 1)
15	15	the use or sale of a motor vehicle on the basis of the energy source used to power the
16	16	motor vehicle, including use for propulsion or use for powering other functions of
17	17	the motor vehicle, or 2) the use or sale of any other device on the basis of the energy
18	18	source that is used to power the device or that is consumed by the device.
19	19	The people of the state of Wisconsin, represented in senate and assembly, do
20	20	enact as follows:
21	21	SECTION 1. 995.80 of the statutes is created to read:
22	22	995.80 Regulation based on energy source. (1) DEFINITIONS. In this
23	23	section:
24	24	(a) XLocal governmental unitY means a political subdivision of this state, a
25	25	special purpose district in this state, an agency or corporation of a political

37	37	subdivision or special purpose district, or a combination or subunit of any of the
38	38	foregoing.
39	39	(b) XMotor vehicleY means a self-propelled device designed to transport
40	40	persons or property from one place to another.
41	41	(c) XState agencyY means an association, authority, board, department,
42	42	commission, independent agency, institution, office, society, or other body in state
43	43	government created or authorized to be created by the constitution or any law.
44	44	(2) LIMITS ON REGULATION. No state agency and no local governmental unit
45	45	may do any of the following:
46	46	(a) 1. Restrict the use or sale of a motor vehicle on the basis of the energy
47	47	source used to power the motor vehicle, including use for propulsion or use for
48	48	powering other functions of the motor vehicle.
49	49	2. This paragraph does not affect any policy established by a state agency or
50	50	local governmental unit related to the purchase of motor vehicles for the use of the
51	51	state agency or local governmental unit.
52	52	(b) Restrict the use or sale of a device other than a motor vehicle on the basis
53	53	of the energy source that is used to power the device or that is consumed by the
54	54	device. Under this paragraph, a device is powered by an energy source or consumes
55	55	an energy source if any significant function of the device uses that energy source or
56	56	consumes that energy source to accomplish the function.
