7	7	AN ACT to create 5.051 of the statutes; relating to: the suspension of a rule of
8	8	the Elections Commission.

10	10	This bill is introduced as required by s. 227.26 (2) (j), stats., in support of the
11	11	action of the Joint Committee for Review of Administrative Rules in suspending
12	12	emergency rule 2408 of the Wisconsin Elections Commission on July 22, 2024. The
13	13	suspended emergency rule 1) described requirements and procedures for filing a
14	14	declaration of candidacy for a local, state, or federal office (declaration of
15	15	candidacy), 2) identified grounds for bringing challenges to a declaration of
16	16	candidacy, and 3) described the procedures by which the commission or filing officer
17	17	would hear and decide these complaints for such challenges and the ability of an
18	18	individual to seek review of the commission[s or filing officer[s decision on the
19	19	complaint.
20	20	The people of the state of Wisconsin, represented in senate and assembly, do
21	21	enact as follows:
22	22	SECTION 1. 5.051 of the statutes is created to read:
23	23	5.051 Repeal of emergency rule. The emergency rule promulgated by the

32	32	elections commission that took effect on July 1, 2024, and that created ss. EL 2.06
33	33	and 2.08, Wis. Adm. Code, relating to challenge procedures for declarations of
34	34	candidacy, is repealed.
