99 AN ACT to amend 943.10 (1m) (intro.) of the statutes; relating to: entering
1010 certain places with intent to commit battery and providing a penalty.
1111 Analysis by the Legislative Reference Bureau
1212 Under current law, it is a Class F felony to intentionally enter a dwelling or
1313 certain other places without consent, that is, to commit a burglary, with intent to
1414 steal or commit a felony therein. Under current law, such a burglary is a Class E
1515 felony if certain additional circumstances apply. The penalty for a Class F felony is
1616 a fine not to exceed $25,000 or imprisonment not to exceed 12 years and six months,
1717 or both, and the penalty for a Class E felony is a fine not to exceed $50,000 or
1818 imprisonment not to exceed 15 years, or both.
1919 Under this bill, it is also a Class F felony, or a Class E felony if certain
2020 additional circumstances apply, to intentionally enter a dwelling or certain other
2121 places without consent with intent to commit any battery.
2222 Because this bill creates a new crime or revises a penalty for an existing crime,
2323 the Joint Review Committee on Criminal Penalties may be requested to prepare a
2424 report.
2525 The people of the state of Wisconsin, represented in senate and assembly, do
2626 enact as follows:

3333 SECTION 1. 943.10 (1m) (intro.) of the statutes is amended to read:
3434 943.10 (1m) (intro.) Whoever intentionally enters any of the following places
3535 without the consent of the person in lawful possession and with intent to steal or
3636 commit a felony or a violation of s. 940.19 (1) or 940.195 (1) in such place is guilty of
3737 a Class F felony:
