11	11	AN ACT to amend 20.931 (title); to create 20.931 (1) (am) and 20.931 (3) of the
12	12	statutes; relating to: governmental restrictions based on the energy source of
13	13	a motor vehicle or other device.

15	15	Under this bill, no state agency and no local governmental unit may restrict 1)
16	16	the use or sale of a motor vehicle on the basis of the energy source used to power the
17	17	motor vehicle, including use for propulsion or use for powering other functions of
18	18	the motor vehicle, or 2) the use or sale of any other device on the basis of the energy
19	19	source that is used to power the device or that is consumed by the device.
20	20	The people of the state of Wisconsin, represented in senate and assembly, do
21	21	enact as follows:
22	22	SECTION 1. 20.931 (title) of the statutes is amended to read:
23	23	20.931 (title) Prohibited boycotts governmental actions.
24	24	SECTION 2. 20.931 (1) (am) of the statutes is created to read:

35	35	20.931 (1) (am) XMotor vehicleY means a self-propelled device designed to
36	36	transport persons or property from one place to another.
37	37	SECTION 3. 20.931 (3) of the statutes is created to read:
38	38	20.931 (3) PROHIBITIONS BASED ON ENERGY SOURCE. No state agency and no
39	39	local governmental unit may do any of the following:
40	40	(a) 1. Restrict the use or sale of a motor vehicle on the basis of the energy
41	41	source used to power the motor vehicle, including use for propulsion or use for
42	42	powering other functions of the motor vehicle.
43	43	2. This paragraph does not affect any policy established by a state agency or
44	44	local governmental unit related to the purchase of motor vehicles for the use of the
45	45	state agency or local governmental unit.
46	46	(b) Restrict the use or sale of a device other than a motor vehicle on the basis
47	47	of the energy source that is used to power the device or that is consumed by the
48	48	device. Under this paragraph, a device is powered by an energy source or consumes
49	49	an energy source if any significant function of the device uses that energy source or
50	50	consumes that energy source to accomplish the function.
