WEST VIRGINIA LEGISLATURE 2025 REGULAR SESSION Introduced House Bill 2350 By Delegate Burkhammer [Introduced ; referredto the Committee on ] A BILL to amend the Code of West Virginia, 1931, as amended, by adding a new section, designated §9-2-14, relating to enhancing nutrition in the Supplemental Nutrition Assistance Program. Be it enacted by the Legislature of West Virginia: ## ARTICLE 2. COMMISSIONER OF HUMAN SERVICES; POWERS, DUTIES AND RESPONSIBILITIES GENERALLY. (a) "Candy" means the same as it is defined in section §11-15B-2. (b) "Soft drinks" means the same as it is defined in §11-15B-2. (c) The Secretary of Department of Human Services shall request a waiver from the United States Department of Agriculture to exclude candy and soft drinks from the definition of eligible foods under 7 C.F.R. 271.2. If such waiver is granted, then the Secretary shall prohibit the purchase of candy and soft drinks with benefits provided through the Supplemental Nutrition Assistance Program. If no such waiver is granted, then the cabinet Secretary shall request such a waiver annually until such waiver is granted. NOTE: The purpose of this bill is to enhance nutrition in the Supplemental Nutrition Assistance Program.
