22	22	13 (a) The integrated test center established in 2014
23	23	14 Wyoming session laws, chapter 26, section 334(h)(ii) and
24	24	15 (n), as amended by 2015 Wyoming session laws, chapter 142, 2025STATE OF WYOMING25LSO-00452HB0013
25	25	1 section 334(h)(ii) and (o), shall be transferred to the
26	26	2 University of Wyoming school of energy resources on the
27	27	3 effective date of this act. All property, implements,
28	28	4 fixtures, facilities, equipment, obligations, rights and
29	29	5 unexpended funds of the integrated test center owned or
30	30	6 held by the state of Wyoming shall be transferred to the
31	31	7 University of Wyoming school of energy resources on the
32	32	8 effective date of this act.

34	34	10 (b) The governor's office, Wyoming energy authority
35	35	11 and school of energy resources shall, to the greatest
36	36	12 extent possible, take all actions necessary to transfer any
37	37	13 existing agreements or contracts of the integrated test
38	38	14 center to the school of energy resources.

45	45	21 (a) The integrated test center established in 2014
46	46	22 Wyoming session laws, chapter 26, section 334(h)(ii) and
47	47	23 (n), as amended by 2015 Wyoming session laws, chapter 142, 2025STATE OF WYOMING25LSO-00453HB0013
48	48	1 section 334(h)(ii) and (o), is hereby codified and
49	49	2 continued as the integrated test center.

51	51	4 (b) The University of Wyoming school of energy
52	52	5 resources, under direction from the energy resources
53	53	6 council, shall oversee and operate the integrated test
54	54	7 center.

56	56	9 (c) The school of energy resources, under direction
57	57	10 from the energy resources council, shall establish the
58	58	11 structure and policies for the operation of the integrated
59	59	12 test center consistent with the objectives of this section
60	60	13 and W.S. 21-17-117.

62	62	15 (d) In operating the integrated test center, the
63	63	16 school of energy resources shall:

65	65	18 (i) Design, construct and operate a facility to
66	66	19 study the capture, sequestration, utilization and
67	67	20 management of carbon dioxide emissions or other emissions
68	68	21 and other research projects. For purposes of this
69	69	22 paragraph, an integrated test center designed and
70	70	23 constructed under 2014 Wyoming session laws, chapter 26, 2025STATE OF WYOMING25LSO-00454HB0013
71	71	1 section 334(n) shall be deemed to satisfy the requirements
72	72	2 of this paragraph;

74	74	4 (ii) Provide opportunities for testing and
75	75	5 research projects at the facility specified in paragraph
76	76	6 (i) of this subsection;

78	78	8 (iii) Enter into leases in accordance with the
79	79	9 following:

81	81	11 (A) The school of energy resources shall
82	82	12 enter into leases or shall assign existing leases with
83	83	13 owners of real property where the facility specified in
84	84	14 paragraph (i) of this subsection is located. Any lease
85	85	15 entered into under this subparagraph shall offer the owner
86	86	16 of the real property the right of first refusal to purchase
87	87	17 the state's ownership interest in the physical plant at
88	88	18 fair market value after conclusion of all integrated test
89	89	19 center activities by the school of energy resources and its
90	90	20 partners and research tenants;

92	92	22 (B) The school of energy resources shall
93	93	23 enter into subleases with persons and entities who wish to 2025STATE OF WYOMING25LSO-00455HB0013
94	94	1 perform research or other projects at the facility before
95	95	2 those persons or entities become tenants and begin work at
96	96	3 the facility;

98	98	5 (C) Signed agreements between all partners,
99	99	6 research tenants and lessors regarding the integrated test
100	100	7 center and the school of energy resources shall include
101	101	8 provisions retaining sovereign immunity for the state of
102	102	9 Wyoming and the University of Wyoming and provisions for
103	103	10 the indemnification from any liability, damages and legal
104	104	11 fees incurred by the University of Wyoming or the state of
105	105	12 Wyoming from any claims, causes of action, injuries or
106	106	13 judgments resulting from the use of the integrated test
107	107	14 center by an employee, contractor or guest of a partner,
108	108	15 research tenant or lessor.

110	110	17 (iv) Prioritize space at the facility
111	111	18 established under paragraph (i) of this subsection and
112	112	19 resources to projects that the school of energy resources
113	113	20 and the energy resources council determine would:

115	115	2 success and are at the correct developmental stage for
116	116	3 testing at the integrated test center;

118	118	5 (B) Increase the knowledge base within the
119	119	6 state of Wyoming on the capture, sequestration, utilization
120	120	7 and management of carbon dioxide emissions or other
121	121	8 emissions with the potential benefit of improving the
122	122	9 future marketability of Wyoming energy sources;

124	124	11 (C) Increase the national and international
125	125	12 exposure of the state of Wyoming and its agencies,
126	126	13 institutions, instrumentalities and political subdivisions
127	127	14 as participants and locations for innovation in energy;

129	129	16 (D) Add ancillary or supplemental value to
130	130	17 Wyoming products or byproducts; or

132	132	19 (E) Lead to the development of methods or
133	133	20 products that may advance the future use of Wyoming's
134	134	21 natural resources.

136	136	2 University of Wyoming school of energy resources, shall
137	137	3 have sole ownership of the physical plant of any test
138	138	4 facility constructed in accordance with paragraph (d)(i) of
139	139	5 this section that was constructed with state funds. State
140	140	6 ownership shall not extend to the real property on which
141	141	7 the physical plant is located nor to any improvement,
142	142	8 equipment or fixture purchased with funds that are not
143	143	9 state funds.

145	145	11 (f) Not later than October 1 of each year and as part
146	146	12 of the report required under W.S. 21-17-117, the school of
147	147	13 energy resources shall report to the joint minerals,
148	148	14 business and economic development interim committee and the
149	149	15 joint appropriations committee on:

151	151	17 (i) The work of the integrated test center in
152	152	18 the past fiscal year, including the work and use of the
153	153	19 research facility established under paragraph (d)(i) of
154	154	20 this section;

156	156	22 (ii) All accomplishments of the integrated test
157	157	23 center in the past fiscal year and benefits accruing to 2025STATE OF WYOMING25LSO-00458HB0013
158	158	1 Wyoming's economy as a result of the integrated test
159	159	2 center's work;

161	161	4 (iii) The current occupancy of the integrated
162	162	5 test center, including lessees and the projects lessees are
163	163	6 conducting at the integrated test center.

166	166	9 paragraph (v) and (f) is amended to read:

174	174	17 (iv) Notwithstanding any other provision of this
175	175	18 chapter, develop and submit a budget for the school for
176	176	19 approval by the energy resources council and then shall
177	177	20 submit

182	182	2 its budget to the governor after approval by the energy
183	183	3 resources council created in subsection (e) of this
184	184	4 section. The school of energy resources shall submit a copy
185	185	5 of its budget for informational purposes to the
186	186	6 university's board of trustees;

191	191	11 (f) The university shall report annually, not later
192	192	12 than October 1, to the joint minerals, business and
193	193	13 economic development interim committee, the joint
194	194	14 appropriations committee and the joint education interim
195	195	15 committee regarding all revenues to and expenditures by the
196	196	16 school of energy resources during the preceding fiscal
197	197	17 year, any budget prepared and submitted under paragraph
198	198	18 (c)(iv) of this section, accomplishments of the school of
199	199	19 energy resources and its benefits to Wyoming's energy
200	200	20 economy.

204	204	2 impair existing agreements, contracts or other obligations
205	205	3 of the integrated test center that were entered into by the
206	206	4 integrated test center, the Wyoming energy authority, the
207	207	5 office of the governor or the University of Wyoming school
208	208	6 of energy resources before the effective date of this act.

210	210	8. This act is effective immediately upon
211	211	9 completion of all acts necessary for a bill to become law
212	212	10 as provided by Article 4, Section 8 of the Wyoming
213	213	11 Constitution.
