Solid waste municipal cease and transfer funding.

A BILL
for
1 AN ACT relating to the prioritization of cease and transfer 
2 projects for municipal solid waste facilities; authorizing 
3 expenditure of previously appropriated funds; establishing 
4 a prioritized list of projects; establishing a maximum 
5 amount to be expended on projects; granting the department 
6 of environmental quality limited discretionary authority to 
7 modify the prioritized list; specifying expenditures for a 
8 carcass management project; providing definitions; 
9 requiring reports; repealing a prior priority list of cease 
10 and transfer projects; and providing for an effective date.

15 (a)  As used in this section:  2025STATE OF WYOMING25LSO-01982HB0014

2 (i)  "(C)" means closure project;
3
4 (ii)  "Maximum amount" means the total amount to 
5 be expended on the listed project and reflects one hundred 
6 percent (100%) of the project cost, including any award by 
7 the state loan and investment board under W.S. 35-11-528;
8
9 (iii)  "SWDD" means solid waste disposal 
10 district;

12 (iv)  "(T)" means transfer project.

14 (b)  From amounts appropriated by 2013 Wyoming Session 
15 Laws, Chapter 194, Section 2(a) and (b), 2014 Wyoming 
16 Session Laws, Chapter 26, Section 333(a) and (b), 2015 
17 Wyoming Session Laws, Chapter 142, Section 345 (priority 
18 2), 2016 Wyoming Session Laws, Chapter 31, Section 316(a), 
19 2018 Wyoming Session Laws, Chapter 134, Section 323(a), (c) 
20 and (d), as amended by 2019 Wyoming Session Laws, Chapter 
21 80, Section 323, 2019 Wyoming Session Laws, Chapter 67, 
22 Section 1, 2024 Wyoming Session Laws, Chapter 118, Section 
23 2, Section 020, footnote 2 and other funds appropriated and  2025STATE OF WYOMING25LSO-01983HB0014
1 authorized for program expenses, the following amounts and 
2 prioritized projects are authorized pursuant to the 
3 municipal solid waste facilities cease and transfer program 
4 created by W.S. 35-11-528:

5 (c)  Any municipal solid waste facility operator may 
6 apply for the funds associated with the carcass management 
7 project listed as priority 1 in subsection (b) of this 
8 section. Funds for the carcass management project shall be 
9 expended only for infrastructure necessary to haul, bury or 
10 compost dead animals. Funds expended under this subsection 
11 shall not exceed the amount listed in priority 1 in 
12 subsection (b) of this section.

14 (d)  The department of environmental quality may 
15 modify the authorized funds and the order of the projects 
16 listed in the prioritized list contained in subsection (b) 
17 of this section for any of the following reasons:

19 (i)  To optimize efficiency;
20
21 (ii)  Based on project readiness;

2 qualifications or conditions;

4 (iv)  To address emergency or immediate 
5 environmental concerns.

7 (e)  Not later than October 15 of each year, the 
8 department of environmental quality shall report:
9
10 (i)  Any modification of the prioritized list 
11 contained in subsection (b) of this section to the joint 
12 minerals, business and economic development interim 
13 committee and the joint appropriations committee;
14
15 (ii)  The names of recipients and amounts 
16 expended for the carcass management project established by 
17 priority 1 in subsections (b) and (c) of this section to 
18 the joint minerals, business and economic development 
19 interim committee.

2.  This act is effective immediately upon 
3 completion of all acts necessary for a bill to become law 
4 as provided by Article 4, Section 8 of the Wyoming 
5 Constitution.
