7-AN ACT relating to the prioritization of cease and transfer
8-projects for municipal solid waste facilities; authorizing
9-expenditure of previously appropriated funds; establishing
10-a prioritized list of projects; establishing a maximum
11-amount to be expended on projects; granting the department
12-of environmental quality limited discretionary authority to
13-modify the prioritized list; specifying expenditures for a
14-carcass management project; providing definitions;
15-requiring reports; repealing a prior priority list of cease
16-and transfer projects; and providing for an effective date.
17-Be It Enacted by the Legislature of the State of Wyoming:
18-Section 1.
19-(a) As used in this section:
20-(i) "(C)" means closure project;
21-(ii) "Maximum amount" means the total amount to
22-be expended on the listed project and reflects one hundred
23-percent (100%) of the project cost, including any award by
24-the state loan and investment board under W.S. 35-11-528;
25-(iii) "SWDD" means solid waste disposal
26-district;
27-(iv) "(T)" means transfer project.
28-(b) From amounts appropriated by 2013 Wyoming Session
29-Laws, Chapter 194, Section 2(a) and (b), 2014 Wyoming
30-Session Laws, Chapter 26, Section 333(a) and (b), 2015
31-Wyoming Session Laws, Chapter 142, Section 345 (priority
32-2), 2016 Wyoming Session Laws, Chapter 31, Section 316(a),

45-municipal solid waste facilities cease and transfer program

67-(c) Any municipal solid waste facility operator may
68-apply for the funds associated with the carcass management
69-project listed as priority 1 in subsection (b) of this
70-section. Funds for the carcass management project shall be ORIGINAL HOUSE

26+2 (i) "(C)" means closure project;

76-expended only for infrastructure necessary to haul, bury or
77-compost dead animals. Funds expended under this subsection
78-shall not exceed the amount listed in priority 1 in
79-subsection (b) of this section.
80-(d) The department of environmental quality may
81-modify the authorized funds and the order of the projects
82-listed in the prioritized list contained in subsection (b)
83-of this section for any of the following reasons:
84-(i) To optimize efficiency;
85-(ii) Based on project readiness;
86-(iii) Based on compliance with grant or loan
87-qualifications or conditions;
88-(iv) To address emergency or immediate
89-environmental concerns.
90-(e) Not later than October 15 of each year, the
91-department of environmental quality shall report:
92-(i) Any modification of the prioritized list
93-contained in subsection (b) of this section to the joint
94-minerals, business and economic development interim
95-committee and the joint appropriations committee;
96-(ii) The names of recipients and amounts
97-expended for the carcass management project established by
98-priority 1 in subsections (b) and (c) of this section to
99-the joint minerals, business and economic development
