23+12. W.S. 31-7-105(e), 31-7-113(a) by creating
24+13 a new paragraph (xiii), 31-7-115(b), 31-7-118 and
25+14 31-8-102(a)(vii) are amended to read:

30+3 (e) The licensee has twenty (20) days from the date
31+4 the department denies the license or gives the notice of
32+5 intent to suspend, revoke or cancel the license or
33+6 disqualify the licensee from driving a commercial motor
34+7 vehicle within which to request a hearing or the
35+8 opportunity for a hearing is waived. If the request for a
36+9 hearing is timely and the request is for a contested case,
37+10 the department shall forward the request and certified
38+11 record to the hearing examiner who shall schedule a hearing
39+12 within forty-five (45) days after receipt of the certified
40+13 record at a time and place specified by the hearing
41+14 examiner. The hearing examiner shall provide the licensee
42+15 notice of the hearing at least ten (10) days in advance of
43+16 the hearing. If the hearing examiner fails to schedule the
44+17 hearing within forty-five (45) days of
45+18, other than at
46+19 the request of the licensee, the licensee, as his sole
47+20 remedy, shall be given credit against any action upheld at
48+21 the hearing for the time between the expiration of the
49+22 forty-five (45) day period and the date the hearing was

56+4 consideration in accordance with W.S. 16-3-101 through
57+5 16-3-115 and may require reexamination of the licensee. The
58+6 hearing examiner shall issue subpoenas upon his own motion
59+7 or upon the request of any party to the proceedings in
60+8 compliance with the Wyoming Rules of Civil Procedure. Upon
61+9 hearing, the hearing examiner shall either rescind or
62+10 uphold the action or upon a showing of good cause, may
63+11 continue or modify a suspension of the license.

15-Be It Enacted by the Legislature of the State of Wyoming:
16-Section 1. W.S. 31-7-105(e), 31-7-113(a) by creating
17-a new paragraph (xiii), 31-7-115(b), 31-7-118 and
18-31-8-102(a)(vii) are amended to read:
19-31-7-105. Administrative hearings.
20-(e) The licensee has twenty (20) days from the date
21-the department denies the license or gives the notice of

63-(b) Licenses issued to persons under twenty-one (21)
64-years of age shall bear distinctive markings indicating the
65-licensee is under twenty-one (21) years. After January 1,
66-1994, a license shall expire
67-licensee attains twenty-one (21) years of age. The
68-department shall notify the licensee at least ninety (90)
69-days prior to his twenty-first birthday of the expiration
70-date of his license. A licensee may apply for a license

77-(21) years, payment of the proper fee and surrender of the
78-original license in accordance with W.S. 31-7-119(a).
79-31-7-118. Replacement license.
80-(a) If a license issued under this act is lost,
81-destroyed or if the licensee desires to withdraw or insert
82-notice of anatomical organ donation or a medical alert
83-designation, the person may obtain the appropriate
84-replacement license upon payment of the proper fee and
85-surrender of the original license, if available.
86-(b) The department may issue a replacement license
87-under this section without the examinations required under
88-W.S. 31-7-114, except for a commercial driver's license
89-with a hazardous materials endorsement, upon request by the
90-licensee either by mail or in person if the following
91-conditions exist:
92-(i) The expiration date of the licensee's
93-original license is more than one (1) year from the date of
94-the licensee's request for a replacement license;
95-(ii) The licensee has not legally changed the
96-licensee's name since issuance of the licensee's original
97-license; and
98-(iii) The department has a digitized photograph
99-and signature of the licensee on record.
100-(c) A replacement license issued under this section
101-shall expire on the expiration date of the licensee's
102-original license.

109-(a) The identification card or digital identification
110-card shall resemble a Wyoming driver's license or digital
111-driver's license. It shall have:
112-(vii) The following: "State of
113-Wyoming"-"Identification Card No. ...."-"This card is
114-provided solely for the purpose of identification of the
115-person described on the card
116-ONLY";
117-Section 2. W.S. 31-7-113(a)(iv) and 31-7-119(e) are
118-repealed.
119-Section 3. The department of transportation shall
