7-AN ACT relating to common law, statutes and rules of
8-construction; specifying definitions and standards for the
9-application of a person's biological sex in law, rules or
10-regulations; providing for the law to distinguish between
11-accommodations for males and females; requiring the
12-collection of vital statistics and other data to identify
13-persons as male or female at birth; and providing for an
14-effective date.
15-Be It Enacted by the Legislature of the State of Wyoming:
16-Section 1. W.S. 8-1-110 is created to read:
17-8-1-110. References to males and females; separate
18-accommodations for males and females; data reporting
19-requirements.
20-(a) Notwithstanding any other provision of law, with
21-respect to the application of a person's biological sex
22-under any law or rule and regulation in this state, the
23-following definitions and standards shall apply:
24-(i) A person's "sex" means the person's
25-biological sex, either male or female, at birth;
26-(ii) "Female" means a person who has, had, will
27-have or would have had, but for a congenital anomaly or
28-intentional or unintentional disruption, the reproductive
29-system that at some point produces, transports and utilizes
30-eggs for fertilization;
31-(iii) "Male" means a person who has, had, will
32-have or would have had, but for a congenital anomaly or

41-(iv) The terms "woman" and "girl" refer to human
42-females, and the terms "man" and "boy" refer to human
43-males;
44-(v) "Mother" means a parent of the female sex;
45-(vi) "Father" means a parent of the male sex;
46-(vii) With respect to biological sex, the term
47-"equal" does not mean "same" or "identical";
48-(viii) With respect to biological sex, separate
49-accommodations are not inherently unequal; and
50-(ix) A person born with a medically recognized
51-condition of a disorder or difference in sex development
52-shall not be denied legal protections and accommodations
53-afforded under applicable law.
54-(b) The legislature finds that laws, rules and
55-regulations that distinguish between the sexes are subject
56-to intermediate constitutional scrutiny. Intermediate
57-constitutional scrutiny forbids unfair discrimination
58-against similarly situated male and female persons but
59-allows the law to distinguish between the sexes where such
60-distinctions are substantially related to important
61-governmental objectives.
62-(c) Notwithstanding any provision of law to the
63-contrary, laws, rules and regulations that recognize or
64-enforce distinctions between the sexes with respect to

71-violence shelters, rape crisis centers, locker rooms,
72-restrooms and other areas where safety or privacy are
73-implicated and that result in separate accommodations
74-between the sexes are substantially related to the
75-important governmental objectives of protecting the health,
76-safety and privacy of persons in such circumstances.
77-(d) Any school district, or public school thereof,
78-and any state agency, department, office or other political
79-subdivision that collects vital statistics for the purpose
80-of complying with anti-discrimination laws or for the
81-purpose of gathering accurate public health, crime,
82-economic or other data shall, when identification by sex is
83-used, identify each person who is part of the collected
84-data set as either male or female consistent with the
