7-AN ACT relating to the Hathaway scholarship program;
8-modifying definitions; modifying the standards for
9-satisfactory academic progress; amending minimum enrollment
10-hours for Hathaway scholarship eligibility; modifying
11-scholarship awards; and providing for an effective date.
12-Be It Enacted by the Legislature of the State of Wyoming:
13-Section 1. W.S. 21-16-1301(a)(iv) and (xiv),
14-21-16-1304(a)(i) by creating a new subparagraph (C), (ii)
15-by creating a new subparagraph (C), (iii) by creating a new
16-subparagraph (C) and (c)(i) and 21-16-1305(a)(i) by
17-creating a new subparagraph (C) are amended to read:
18-21-16-1301. Definitions.
19-(a) As used in this article:
20-(iv) "Certificate" means a credential other than
21-a degree as defined in paragraph (vi) of this subsection. A
22-"certificate" is
23-degree or
24-an academic year program of study offered by a Wyoming
25-community college
26-certificate or other government or industry recognized
27-qualification for working in a trade or occupation and may
28-require on-the-job training and credit hours to complete
29-the program;
30-(xiv) "Satisfactory academic progress" means,
31-except as further specified in this paragraph, completing
32-at least six (6) semester hours per semester if enrolled
33-for less than twelve (12) semester hours and completing at
34-least twelve (12) semester hours per semester if enrolled
35-for twelve (12) or more semester hours, and meeting such ORIGINAL HOUSE ENGROSSED

41-other criteria as established by the eligible institution
42-to ensure the student earns his degree or certificate in a
43-timely manner. The student's hours of enrollment for
44-purposes of this paragraph shall be the same number of
45-hours of enrollment used to determine the state's
46-obligation to reimburse the eligible institution for the
47-student's scholarship under this article. Satisfactory
48-academic progress shall be determined annually following
49-the spring semester, but a student's scholarship may be
50-reinstated pursuant to W.S. 21-16-1304(f)(i) or
51-21-16-1305(d)(i) following any semester or summer school
52-session. For students enrolled in a program at a Wyoming
53-community college that requires on-the-job training and
54-less than six (6) credit hours per semester to receive a
55-certificate, "satisfactory academic progress" means
56-completing all semester hours the student is enrolled in
57-each semester, meeting the hourly on-the-job training
58-requirements and meeting other criteria as established by
59-the Wyoming community college to ensure the student earns
60-the certificate in a timely manner;

62-honor scholarships.
63-(a) Any student who meets the criteria under W.S.
64-21-16-1303 is eligible to receive a scholarship to pursue a
65-degree or certificate as follows:
66-(i) With a minimum cumulative high school GPA of
67-2.50 and a score equal to or greater than the 2015-2016
68-national percentile rank of forty-three (43) on a college
69-entrance examination administered throughout the United
70-States and relied upon by institutions of higher education
71-to determine acceptance of students for attendance, a

78-(C) For students enrolled in a program at a
79-Wyoming community college that requires on-the-job training
80-and credit hours to receive a certificate that are enrolled
81-in less than six (6) hours per semester, the amount
82-provided under subparagraph (A) of this paragraph times a
83-fraction, the numerator of which is the number of hours for
84-which the student is enrolled and the denominator is twelve
85-(12).
86-(ii) With a minimum cumulative high school GPA
87-of 3.0 and a score equal to or greater than the 2015-2016
88-national percentile rank of fifty-six (56) on a college
89-entrance examination administered throughout the United
90-States and relied upon by institutions of higher education
91-to determine acceptance of students for attendance, a
92-Hathaway performance scholarship for:
93-(C) For students enrolled in a program at a
94-Wyoming community college that requires on-the-job training
95-and credit hours to receive a certificate that are enrolled
96-in less than six (6) hours per semester, the amount
97-provided under subparagraph (A) of this paragraph times a
98-fraction, the numerator of which is the number of hours for
99-which the student is enrolled and the denominator is twelve
100-(12).
101-(iii) With a minimum cumulative high school GPA
102-of 3.5 and a score equal to or greater than the 2015-2016
103-national percentile rank of seventy-nine (79) on an
104-examination administered throughout the United States and
105-relied upon by institutions of higher education to
106-determine acceptance of students for attendance, a Hathaway

112-4 (C) For students enrolled in a program at a
113-Wyoming community college that requires on-the-job training
114-and credit hours to receive a certificate that are enrolled
115-in less than six (6) hours per semester, the amount
116-provided under subparagraph (A) of this paragraph times a
117-fraction, the numerator of which is the number of hours for
118-which the student is enrolled and the denominator is twelve
119-(12).
120-(c) To remain eligible for the scholarship under this
121-section, the student shall:
122-(i) Except as provided in W.S. 21-16-1303(f) and
123-subsection (h) of this section, make satisfactory academic
124-progress toward a degree. If a student
125-fails to make satisfactory academic progress or maintain
126-the cumulative grade point average required for
127-continuation in the program as provided in this subsection,
128-the student shall become ineligible for the scholarship in
129-subsequent semesters unless granted an exception for cause
130-by the department or except as otherwise provided in
131-subsection (f) of this section. The department may delegate
132-to any eligible institution the department's authority to
133-grant an exception for cause, but shall only do so in
134-accordance with department rules establishing procedures
135-and criteria for granting an exception and any eligible
136-institution acting pursuant to such delegation shall grant
137-exceptions only in accordance with those rules;

140-(a) Any student who meets the criteria under W.S.

147-opportunity scholarship to pursue a certificate or degree
148-as follows:
149-(i) With a minimum cumulative high school GPA of
150-2.50 and either a score equal to or greater than the
151-2015-2016 national percentile rank of thirty (30) on a
152-college entrance examination administered throughout the
153-United States and relied upon by institutions of higher
154-education to determine acceptance of students for
155-attendance or a qualifying cumulative score on a
156-career-technical aptitude test as determined by the
157-department, a scholarship for:
158-(C) For students enrolled in a program at a
159-Wyoming community college that requires on-the-job training
160-and credit hours to receive a certificate that are enrolled
161-in less than six (6) hours per semester, the amount
162-provided under subparagraph (A) of this paragraph times a
163-fraction, the numerator of which is the number of hours for
164-which the student is enrolled and the denominator is twelve
