7-AN ACT relating to environmental quality; clarifying the
8-financial institutions from which operators may obtain
9-irrevocable letters of credit to deposit with the
10-department of environmental quality in lieu of a bond;
11-specifying applicability; authorizing rulemaking; and
12-providing for effective dates.
13-Be It Enacted by the Legislature of the State of Wyoming:
14-Section 1. W.S. 35-11-418 and 35-11-504(e) are
15-amended to read:
16-35-11-418. Cash or securities in lieu of bond.
17-(a) For coal mining operations, in lieu of a bond,
18-the operator or its principal may deposit federally insured
19-certificates of deposit payable to the Wyoming department
20-of environmental quality, or cash, or government
21-securities, or irrevocable letters of credit issued by a
22-bank organized to do business in the United States, or all
23-four (4).
24-(b) For noncoal mining operations that take place on
25-land that is not owned or operated by the United States or
26-a federal agency, in lieu of a bond, the operator or the
27-operator's principal may deposit federally insured
28-certificates of deposit payable to the Wyoming department
29-of environmental quality, or cash, or government
30-securities, or irrevocable letters of credit issued by a
31-bank or credit union organized to do business in the United
32-States, or all four (4).
33-(c) Irrevocable letters of credit deposited under
34-this section shall be issued by a bank that is insured by
35-the federal deposit insurance corporation or a credit union ORIGINAL HOUSE

42-administration.
43-35-11-504. Bonding for solid waste management
44-facilities.
45-(e) In lieu of a bond, the operator may deposit
46-federally insured certificates of deposit payable to the
47-Wyoming department of environmental quality, cash,
48-government securities, or irrevocable letters of credit
49-issued by a bank organized to do business
50-in the United States, or all four (4).
51-of credit deposited under this subsection shall be issued
52-by a bank that is insured by the federal deposit insurance
53-corporation or a credit union that is insured by the
54-national credit union administration.
55-Section 2. This act shall apply to irrevocable
56-letters of credit deposited under W.S. 35-11-418 and
57-35-11-504(e) that are issued on and after the effective
58-date of this act.
59-Section 3. The environmental quality council, upon
60-recommendation by the department of environmental quality,

67-(a) Except as provided in subsection (b) of this
68-section, this act is effective July 1, 2025.
69-(b) Sections 3 and 4 of this act are effective
70-immediately upon completion of all acts necessary for a
71-bill to become law as provided by Article 4, Section 8 of
72-the Wyoming Constitution.
