2828 4 (a) The governing body of a city or town may
2929 5 designate a property within the limits of the city or town
3030 6 as abandoned or as a nuisance for the purposes of this
3131 7 section if the property has been vacant for not less than
3232 8 six (6) months or if the property has been neglected and
3333 9 contains a significantly deteriorated or deteriorating
3434 10 structure as determined by the governing body. The
3535 11 governing body of a city or town with less than fifteen
3636 12 thousand (15,000) residents shall not have more than three
3737 13 (3) properties designated as abandoned or as a nuisance at
3838 14 the same time. The governing body of a city or town with
3939 15 not less than fifteen thousand (15,000) and not more than
4040 16 fifty thousand (50,000) residents shall not have more than
4141 17 six (6) properties designated as abandoned or as a nuisance
4242 18 at the same time. The governing body of a city or town with
4343 19 not less than fifty thousand and one (50,001) residents
4444 20 shall not have more than ten (10) abandoned or nuisance
4545 21 properties designated as abandoned or as a nuisance at the

4747 1 require the owner of an abandoned or nuisance property to
4848 2 sell the property.

5050 4 (b) In determining whether a property is abandoned
5151 5 under subsection (a) of this section, a city or town shall
5252 6 examine the property and determine whether the property is
5353 7 occupied by the property owner or by permission of the
5454 8 property owner. In determining whether a property is a
5555 9 nuisance under subsection (a) of this section, a city or
5656 10 town shall consider whether an unreasonable or unlawful use
5757 11 or condition of the property has resulted or may result in
5858 12 an economic or physical injury to a neighboring property
5959 13 owner or endangers the life, health or safety of the
6060 14 community.

6262 16 (c) If the owner of an abandoned or nuisance property
6363 17 makes an expenditure to demolish the property and remove
6464 18 all demolished material within two (2) years after the
6565 19 property is designated as abandoned or as a nuisance under
6666 20 subsection (a) of this section and submits proof of the
6767 21 expenditure to the governing body of the city or town for
6868 22 approval under subsection (f) of this section, the owner
6969 23 shall be eligible for a tax credit as provided in W.S. 2025STATE OF WYOMING25LSO-00114HB0066
7070 1 39-13-109(d)(ii) in an amount not to exceed fifty percent
7171 2 (50%) of the expenditures to demolish the property and
7272 3 remove all demolished material.

7474 5 (d) If the owner of an abandoned or nuisance property
7575 6 makes an expenditure to bring the property into substantial
7676 7 compliance with applicable codes within two (2) years after
7777 8 the property is designated as abandoned or as a nuisance
7878 9 under subsection (a) of this section and submits proof of
7979 10 the expenditure to the governing body of the city or town
8080 11 for approval under subsection (f) of this section, the
8181 12 owner shall be eligible for a tax credit as provided in
8282 13 W.S. 39-13-109(d)(ii) in an amount not to exceed the amount
8383 14 expended to bring the property into substantial compliance
8484 15 with applicable codes.

8686 17 (e) Any person who purchases or takes ownership of an
8787 18 abandoned or nuisance property after the property has been
8888 19 designated as abandoned or as a nuisance under subsection
8989 20 (a) of this section and who demolishes the property and
9090 21 removes all demolished material or brings the property into
9191 22 substantial compliance with applicable codes within five

9393 1 ownership of the property shall be eligible for a tax
9494 2 credit as provided in W.S. 39-13-109(d)(ii) in an amount
9595 3 not to exceed the amount expended to demolish the property
9696 4 and remove all demolished material or bring the property
9797 5 into substantial compliance with applicable codes.

9999 7 (f) Prior to being eligible for any tax credit under
100100 8 subsections (c) through (e) of this section, the person
101101 9 claiming the credit shall document the person's
102102 10 expenditures resulting from the actions required by
103103 11 subsections (c) through (e) of this section and submit
104104 12 proof of the expenditures to the governing body of the city
105105 13 or town for approval. Only approved expenditures shall be
106106 14 eligible for a tax credit. The governing body shall not
107107 15 approve any expenditures that do not directly relate to the
108108 16 actions required by subsections (c) through (e) of this
109109 17 section. The governing body shall not approve any
110110 18 expenditures made after the applicable time limit specified
111111 19 in subsections (c) through (e) of this section. The
112112 20 governing body shall submit any approved expenditures to
113113 21 the department of revenue as provided in W.S.
114114 22 39-13-109(d)(ii).
