7-AN ACT relating to elections; requiring a minimum threshold
8-of ballots cast in a bond election held on any day other
9-than a general election as specified; and providing for an
10-effective date.
11-Be It Enacted by the Legislature of the State of Wyoming:
12-Section 1. W.S. 22-21-110 is amended to read:
13-22-21-110. Ballot canvass; results certified;
14-declaration; effect of defeat.
15-(a) Immediately after the closing of the polls, the
16-counting board shall proceed to count the ballots. The
17-results disclosed by the count shall be certified by the
18-counting board to the clerk of the political subdivision.
19-Except as otherwise provided in subsection (b) of this
20-section, if the majority of the ballots cast on a bond
21-question is in favor of the issuance of the bonds, the
22-proposal shall be approved, and the governing body of the
23-political subdivision, in the manner provided by law, shall
24-then proceed to declare the results of said election, and
25-complete the printing, execution, advertising, and sale of
26-the bonds, but if the majority is opposed to such issuance,
27-the proposal to issue bonds for the same general purpose
28-shall not again be submitted to election within a period of
29-twelve (12) months or as otherwise provided by law.
30-(b) For any bond election that is held on a day other
31-than the same day as a general election, the proposal shall
32-not be approved unless the majority of the ballots cast are
33-in favor of the proposal and the total number of ballots
34-cast is not less than twentyfive percent (25%) plus one (1)
35-of the number of qualified electors who voted within the ORIGINAL HOUSE ENGROSSED

42-preceding the bond election. If the proposal is not
43-approved due to an insufficient number of qualified
44-electors voting, the proposal to issue bonds may be brought
45-at the next general election or at another time pursuant to
46-this act. This subsection shall apply only to bond
47-elections held in accordance with this article.
48-Section 2. Nothing in this act shall be construed to
49-impact a bond election held prior to July 1, 2025.
50-Section 3. This act is effective July 1, 2025.
