2925 5 (a) Simulcasting shall be conducted only by the
3026 6 holder of a simulcasting permit issued by the commission
3127 7 and approved by the local approving authority, as specified
3228 8 by this section.

3430 10 (b) The commission shall promulgate rules for
3531 11 simulcasting that are reasonably necessary to protect the
3632 12 public interest.

3834 14 (c) Except as specifically provided in this section,
3935 15 simulcasting permits shall be subject to the same terms and
4036 16 conditions and issued in the same manner as a pari-mutuel
4137 17 permit issued under this act.

4339 19 (d) A simulcasting permit or renewal issued by the
4440 20 commission shall be subject to the following:

9887 7 state that the named applicant has applied for approval or
9988 8 renewal of a simulcasting permit and that protests against
10089 9 the issuance or renewal of approval, if any, will be heard
10190 10 at a designated meeting of the local approving authority.
10291 11 For a renewal application, the local approving authority
10392 12 shall hold the designated meeting not later than thirty

142+20 authority or the commission that are not cured by the
143+21 holder of the permit within ten (10) business days of

146+2 upon by the holder of the permit and the local approving

151+7 acted in violation of any Wyoming gaming law specified in
152+8 this chapter, W.S. 6-7-101 through 6-7-104 or 9-24-101

162-5 permit within ten (10) business days of receiving written
163-6 notice of the breach from the local approving authority or
164-7 the commission, or the date agreed upon by the holder of
165-8 the permit and the local approving authority or commission;

167-10 (B) Notification by the commission that the
168-11 holder of the permit has acted in violation of any Wyoming
169-12 gaming law specified in this chapter, W.S. 6-7-101 through
170-13 6-7-104 or 9-24-101 through 9-24-106;

156+12 the immediate vicinity of the permitted premises is
157+13 adversely and seriously affected by the permitted premises;

174161 17 location within two (2) years after the permit is issued.
175162 18 Upon a showing of good cause by the holder of the permit,
176163 19 the local approving authority may extend the period for
177164 20 commencement of simulcasting for one (1) additional year.

180-9HB00851 (h) For simulcasting permits or renewals that require
181-2 the review and objection of a second local authority, the
182-3 second local authority shall notify the applicant, the
183-4 commission and the local approving authority of any
184-5 objections or concerns in writing not later than thirty
185-6 (30) days after receipt of the notification of an
186-7 application under paragraph (e)(iii) of this section. The
187-8 commission and the local approving authority shall not
188-9 approve a permit or renewal unless all objections and
189-10 concerns raised by the second local authority have been
190-11 considered and settled, as determined by the local
191-12 approving authority.

193-14 (j) An applicant for renewal of a simulcasting permit
194-15 or the holder of a simulcasting permit may appeal to the
195-16 district court in the county where the permitted premises
196-17 are located from an adverse decision or revocation by the
197-18 local approving authority. During the pendency of the
198-19 appeal, the approval of the local approving authority for
199-20 the applicant to conduct simulcasting shall remain in full
200-21 force and effect.

269+21 meeting or from the operations of the pari-mutuel system.

271+1 any violation of the foregoing condition and such acts are
272+2 a violation of this act. The permit is effective only for
273+3 the times and at the places for which issued. In addition
274+4 to all other fees and charges, there shall be charged
275+5 before issuance of a permit a daily fee established by the
276+6 commission to defray expenses of enforcing this act.

278+8 (b) Every Wednesday following any pari-mutuel event,
279+9 the permittee shall:

281+11 (ii) Pay an amount equal to one-quarter percent
282+12 (1/4%) of the total amount wagered attributable to historic
283+13 and one and
284+14 one-half percent (1 1/2%) of the total amount wagered
285+15 attributable to live pari-mutuel events, shown by the
286+16 report to the commission, to be credited by the state
287+17 treasurer to a separate account, in the manner indicated in
288+18 subsection (d) of this section;

290+20 (iii) Pay an amount equal to one percent (1%) of
291+21 the total amount wagered attributable to historic

293+1 report to the commission, to be transferred by the
294+2 commission to the county and the city or town in which the
295+3 permittee is located, in equal shares, or to the county
296+4 alone if the permittee is not located within the boundaries
297+5 of a city or town. The county, city or town receiving an
298+6 amount under this paragraph may credit that amount to the
299+7 state fair account upon a majority vote of the county's,
300+8 city's or town's governing body; and

302+10 (iv) Pay an amount equal to one-quarter percent
303+11 (1/4%) of the total amount wagered attributable to historic

305+13 report to the commission, to be credited to the legislative
306+14 stabilization reserve account.

301-6 pursuant to the requirements of W.S. 11-25-210 only upon a
302-7 showing of good cause, as specified in W.S.

320+6 (b) On and after July 1, 2026, all applicants for a

322+8 requirements of W.S. 11-25-210, as created by section 1 of
323+9 this act, except as provided in this subsection. A city,
324+10 town or county may deny or refuse to provide its approval
325+11 or consent for an application filed by the holder of a
326+12 permit issued before the effective date of this act by the
327+13 Wyoming gaming commission to conduct simulcasting in that
328+14 city, town or county only upon a showing of good cause, as
329+15 specified in W.S. 11-25-210(g)(viii), as created by section
330+16 1 of this act.
