29	25		5 (a) Simulcasting shall be conducted only by the
30	26		6 holder of a simulcasting permit issued by the commission
31	27		7 and approved by the local approving authority, as specified
32	28		8 by this section.

34	30		10 (b) The commission shall promulgate rules for
35	31		11 simulcasting that are reasonably necessary to protect the
36	32		12 public interest.

38	34		14 (c) Except as specifically provided in this section,
39	35		15 simulcasting permits shall be subject to the same terms and
40	36		16 conditions and issued in the same manner as a pari-mutuel
41	37		17 permit issued under this act.

43	39		19 (d) A simulcasting permit or renewal issued by the
44	40		20 commission shall be subject to the following:

48	42		2 the corporate limits of any city or town, the permit or
49	43		3 renewal shall be subject to approval by the governing body

52		-	6 ~~simulcasting will~~ be conducted;

58	52		12 simulcasting will be conducted. If the simulcasting will
59	53		13 be conducted within one-half (1/2) mile of the corporate
60	54		14 limits of a city that has exercised the authority granted
61	55		15 under W.S. 15-3-202(b)(ii), the permit or renewal shall be
62		-	16 subject to review and objection by the governing body of
63		-	17 that city;

65		-	19 (iii) A permit or renewal shall be issued by the
66		-	20 commission for a term not to exceed three (3) years from
67		-	21 the date of issuance;

71	62		2 commission only to an applicant authorized under this act
72	63		3 to conduct a pari-mutuel event other than simulcasting.

74	65		5 (e) An applicant for a simulcasting permit or renewal
75	66		6 issued by the commission shall:
76	67		7
77	68		8 (i) File an application for approval with the
78	69		9 local approving authority. Renewal applications shall be
79	70		10 filed not later than ninety (90) days prior to expiration
80	71		11 of the permit;

82	73		13 (ii) At the time of filing the application, pay
83	74		14 an amount sufficient to reimburse the actual cost of
84	75		15 publishing notice of the application;

86	77		17 (iii) If the permit or renewal is subject to
87		-	18 review and objection by a second local authority under
88		-	19 paragraph (d)(i) or (ii) of this section, the applicant
89		-	20 shall notify that local authority of its application.

	78	+	18 consent by a second local authority under paragraph (d)(i)
	79	+	19 or (ii) of this section, the applicant shall notify that
	80	+	20 local authority of its application.

93	82		2 application under paragraph (e)(i) of this section, the
94	83		3 local approving authority shall promptly prepare and
95	84		4 publish notice of the application in a newspaper of local
96	85		5 circulation once a week for two (2) consecutive weeks and
97	86		6 post the notice on its official website. The notice shall
98	87		7 state that the named applicant has applied for approval or
99	88		8 renewal of a simulcasting permit and that protests against
100	89		9 the issuance or renewal of approval, if any, will be heard
101	90		10 at a designated meeting of the local approving authority.
102	91		11 For a renewal application, the local approving authority
103	92		12 shall hold the designated meeting not later than thirty
104		-	13 (30) days prior to expiration of the permit ~~and the holder~~
105		-	14 ~~of the permit to simulcast may, in advance of the~~
106		-	15 ~~designated meeting,~~ ~~request a contested case hearing.~~

108		-	17 ~~(g) With respect to approval and renewal of~~
109		-	18 ~~simulcasting permits issued by the commission, the local~~
110		-	19 ~~approving authority:~~

	114	+	13 retail liquor licenses under W.S. 12-4-201;

	118	+	17 may be located, to the extent the designations are not
	119	+	18 inconsistent with rules of the commission.

	122	+	21 imposed under paragraph (iii) of this subsection only upon

	125	+	3 specific location in the city, town or county where
	126	+	4 simulcasting will be conducted and the number of historic
	127	+	5 horse racing machines to be permitted at that location;

	130	+	8 is granted by the commission for a simulcasting permit;

	132	+	10 (vii) Shall issue written findings and
	133	+	11 conclusions in the event of a denial of an application;

	142	+	20 authority or the commission that are not cured by the
	143	+	21 holder of the permit within ten (10) business days of

	145	+	1 approving authority or the commission, or the date agreed
	146	+	2 upon by the holder of the permit and the local approving
	147	+	3 authority or commission;

	149	+	5 (B) Notification by the commission that the
	150	+	6 holder of the permit, or any employee or agent thereof, has
	151	+	7 acted in violation of any Wyoming gaming law specified in
	152	+	8 this chapter, W.S. 6-7-101 through 6-7-104 or 9-24-101
	153	+	9 through 9-24-106;

146		-	11 (vi) Shall grant approval for the same term as
147		-	12 is granted by the commission for a simulcasting permit;

149		-	14 (vii) Shall issue written findings and
150		-	15 conclusions in the event of a denial of an application;

159		-	2 any reasonable conditions imposed by the local approving
160		-	3 authority or the commission for which reasonable steps to
161		-	4 cure the issue are not initiated by the holder of the
162		-	5 permit within ten (10) business days of receiving written
163		-	6 notice of the breach from the local approving authority or
164		-	7 the commission, or the date agreed upon by the holder of
165		-	8 the permit and the local approving authority or commission;
166		-	9
167		-	10 (B) Notification by the commission that the
168		-	11 holder of the permit has acted in violation of any Wyoming
169		-	12 gaming law specified in this chapter, W.S. 6-7-101 through
170		-	13 6-7-104 or 9-24-101 through 9-24-106;
	155	+	11 (C) The welfare of the people residing in
	156	+	12 the immediate vicinity of the permitted premises is
	157	+	13 adversely and seriously affected by the permitted premises;

172		-	15 (C) The holder of the permit fails to
	159	+	15 (D) The holder of the permit fails to
173	160		16 demonstrate commencement of simulcasting at the approved
174	161		17 location within two (2) years after the permit is issued.
175	162		18 Upon a showing of good cause by the holder of the permit,
176	163		19 the local approving authority may extend the period for
177	164		20 commencement of simulcasting for one (1) additional year.

180		-	9HB00851 (h) For simulcasting permits or renewals that require
181		-	2 the review and objection of a second local authority, the
182		-	3 second local authority shall notify the applicant, the
183		-	4 commission and the local approving authority of any
184		-	5 objections or concerns in writing not later than thirty
185		-	6 (30) days after receipt of the notification of an
186		-	7 application under paragraph (e)(iii) of this section. The
187		-	8 commission and the local approving authority shall not
188		-	9 approve a permit or renewal unless all objections and
189		-	10 concerns raised by the second local authority have been
190		-	11 considered and settled, as determined by the local
191		-	12 approving authority.

193		-	14 (j) An applicant for renewal of a simulcasting permit
194		-	15 or the holder of a simulcasting permit may appeal to the
195		-	16 district court in the county where the permitted premises
196		-	17 are located from an adverse decision or revocation by the
197		-	18 local approving authority. During the pendency of the
198		-	19 appeal, the approval of the local approving authority for
199		-	20 the applicant to conduct simulcasting shall remain in full
200		-	21 force and effect.

	259	+	11 the commission. No permit shall be granted to any city,
	260	+	12 town, county, county fair board or any corporation or
	261	+	13 association except upon the express condition that it shall
	262	+	14 not, by any lease, contract, understanding or arrangement
	263	+	15 of whatever kind or nature, grant, assign or turn over to
	264	+	16 any person, corporation or association the operation or
	265	+	17 management of the pari-mutuel event permitted under this
	266	+	18 act or of the pari-mutuel system of wagering or in any
	267	+	19 manner permit any person, corporation or association to
	268	+	20 retain any of the money received for admission to the race
	269	+	21 meeting or from the operations of the pari-mutuel system.
	270	+	22 The commission shall revoke the permit of any permittee for 2025STATE OF WYOMING25LSO-005114HB0085
	271	+	1 any violation of the foregoing condition and such acts are
	272	+	2 a violation of this act. The permit is effective only for
	273	+	3 the times and at the places for which issued. In addition
	274	+	4 to all other fees and charges, there shall be charged
	275	+	5 before issuance of a permit a daily fee established by the
	276	+	6 commission to defray expenses of enforcing this act.

	278	+	8 (b) Every Wednesday following any pari-mutuel event,
	279	+	9 the permittee shall:
	280	+	10
	281	+	11 (ii) Pay an amount equal to one-quarter percent
	282	+	12 (1/4%) of the total amount wagered attributable to historic
	283	+	13 and one and
	284	+	14 one-half percent (1 1/2%) of the total amount wagered
	285	+	15 attributable to live pari-mutuel events, shown by the
	286	+	16 report to the commission, to be credited by the state
	287	+	17 treasurer to a separate account, in the manner indicated in
	288	+	18 subsection (d) of this section;

	290	+	20 (iii) Pay an amount equal to one percent (1%) of
	291	+	21 the total amount wagered attributable to historic
	292	+	22, shown by the 2025STATE OF WYOMING25LSO-005115HB0085
	293	+	1 report to the commission, to be transferred by the
	294	+	2 commission to the county and the city or town in which the
	295	+	3 permittee is located, in equal shares, or to the county
	296	+	4 alone if the permittee is not located within the boundaries
	297	+	5 of a city or town. The county, city or town receiving an
	298	+	6 amount under this paragraph may credit that amount to the
	299	+	7 state fair account upon a majority vote of the county's,
	300	+	8 city's or town's governing body; and
	301	+	9
	302	+	10 (iv) Pay an amount equal to one-quarter percent
	303	+	11 (1/4%) of the total amount wagered attributable to historic
	304	+	12, shown by the
	305	+	13 report to the commission, to be credited to the legislative
	306	+	14 stabilization reserve account.

	320	+	6 (b) On and after July 1, 2026, all applicants for a
	321	+	7 simulcasting permit or renewal shall be subject to the
	322	+	8 requirements of W.S. 11-25-210, as created by section 1 of
	323	+	9 this act, except as provided in this subsection. A city,
	324	+	10 town or county may deny or refuse to provide its approval
	325	+	11 or consent for an application filed by the holder of a
	326	+	12 permit issued before the effective date of this act by the
	327	+	13 Wyoming gaming commission to conduct simulcasting in that
	328	+	14 city, town or county only upon a showing of good cause, as
	329	+	15 specified in W.S. 11-25-210(g)(viii), as created by section
	330	+	16 1 of this act.
