	199	+	6 the actual development costs of the small water development
	200	+	7 projects, whichever is less;

	202	+	9 (vi) Appropriation: There is appropriated from
	203	+	10 water development account I to the commission one million
	204	+	11 five hundred thousand dollars ($1,500,000.00) or as much
	205	+	12 thereof as is necessary to carry out the purpose of this
	206	+	13 subsection. Unexpended funds appropriated under this
	207	+	14 subsection shall revert to water development account I on
	208	+	15 July 1, 2030;

	210	+	17 (vii) Definition: "Small water development
	211	+	18 project" means a project where the maximum financial
	212	+	19 contribution from the commission is thirty-five thousand
	213	+	20 dollars ($35,000.00) or less;

	219	+	2 fifty percent (50%) of the design, permit procurement,

	221	+	4 construction cost of a small project. No grant shall be
	222	+	5 more than thirty-five thousand dollars ($35,000.00);

	224	+	7 (B) The small water development project
	225	+	8 sponsors shall substantiate the public benefit that will be
	226	+	9 derived from proposed small water development projects;
	227	+	10
	228	+	11 (C) The commission may make monthly
	229	+	12 progress payments for no more than fifty percent (50%) of
	230	+	13 eligible monthly project expenses;
	231	+	14
	232	+	15 (D) An appropriate land management or
	233	+	16 resource management entity shall certify that the proposed
	234	+	17 small water development project will meet expectations and
	235	+	18 that appropriate engineering standards, as approved by the
	236	+	19 commission, will be adhered to;

	238	+	21 (E) The establishment of criteria and
	239	+	22 administrative procedures for the development of small
	240	+	23 water development projects under this subsection and 2025STATE OF WYOMING25LSO-0452

	243	+	1 decisions of the commission relating to the
	244	+	2 recommendations, prioritization or disqualification of
	245	+	3 small water development projects are specifically exempt
	246	+	4 from the provisions of the Wyoming Administrative Procedure
	247	+	5 Act including judicial review under W.S. 16-3-114 and
	248	+	6 16-3-115;
	249	+	7
	250	+	8 (F) W.S. 16-6-116 shall not apply to a
	251	+	9 small water development project unless the project sponsor
	252	+	10 determines the small water development project meets the
	253	+	11 definition of a "public work" as defined in W.S.
	254	+	12 16-6-101(a)(ix).

	256	+	14 (f) Project – LaPrele Irrigation District Additional
	257	+	15 Supply – 2025:
	258	+	16
	259	+	17 (i) Project sponsor: The state of Wyoming;
	260	+	18
	261	+	19 (ii) Project purpose: To provide additional
	262	+	20 supply to lands served by the LaPrele Irrigation District;
	263	+	21
	264	+	22 (iii) Project description: Investigate the

	269	+	2 provide additional supply to lands served by the LaPrele

	275	+	8 (v) Appropriation: There is appropriated from
	276	+	9 the legislative stabilization reserve account to water
	277	+	10 development account I which shall be further appropriated
	278	+	11 from water development account I to the Wyoming water
	279	+	12 development office twenty million dollars ($20,000,000.00)
	280	+	13 or as much thereof as is necessary to carry out the purpose
	281	+	14 of this subsection. Of this appropriation, one million
	282	+	15 dollars ($1,000,000.00) is appropriated for water
	283	+	16 exploration to determine the placement of one (1) or more
	284	+	17 wells or other water projects within the LaPrele Irrigation
	285	+	18 District pursuant to paragraph (iii) of this subsection and
	286	+	19 the remaining nineteen million dollars ($19,000,000.00) is
	287	+	20 appropriated as a loan for a term of thirty (30) years that
	288	+	21 shall have an interest rate of two percent (2%) interest
	289	+	22 per annum to the LaPrele Irrigation District for the design
	290	+	23 and construction of one (1) or more wells or other water 2025STATE OF WYOMING25LSO-0452

	293	+	1 projects necessary to provide additional supply to lands
	294	+	2 served by the LaPrele Irrigation District. Unexpended funds
	295	+	3 appropriated under this subsection shall revert to the
	296	+	4 legislative stabilization reserve account on July 1, 2030;

	298	+	6 (vi) Special conditions: The Wyoming Water
	299	+	7 Development Office shall investigate the feasibility of
	300	+	8 developing groundwater to meet the needs of water rights
	301	+	9 holders within the LaPrele Irrigation District whose rights
	302	+	10 have been affected by the required breach and replacement
	303	+	11 of the LaPrele Dam. The office shall assess whether
	304	+	12 drilling and constructing wells or other water projects
	305	+	13 within the project budget is likely to significantly
	306	+	14 supplement the available water. Upon a determination by the
	307	+	15 Water Development Commission that there is a reasonable
	308	+	16 likelihood of successful development, the office shall
	309	+	17 proceed with the construction of the wells or other water
	310	+	18 projects.

1196		-	(B) There is appropriated from the
1197		-	legislative stabilization reserve account to water
1198		-	development account II which shall be further appropriated
1199		-	from water development account II to the commission twenty
1200		-	million dollars ($20,000,000.00) or as much thereof as is

1219		-	one hundred percent (100%) of these actual development
1220		-	costs, whichever is less;
1221		-	(vi) Appropriation:
1222		-	(A) 2022 Wyoming Session Laws, Chapter 74,
1223		-	Section 1(a)(iii), as amended, appropriated thirty million
1224		-	dollars ($30,000,000.00) to the commission to carry out the
1225		-	purpose of this subsection.
1226		-	(B) There is appropriated from the
1227		-	legislative stabilization reserve account to water
1228		-	development account II which shall be further appropriated
1229		-	from water development account II to the commission sixty
1230		-	million dollars ($60,000,000.00) or as much thereof as is
1231		-	necessary to carry out the purpose of this subsection.
1232		-	Unexpended funds appropriated under this subparagraph shall

1241		-	Section 3. W.S. 99-3-303(b)(iv)(A) through (E) and
1242		-	99-3-2903(f) are repealed.

1244		-	(a) The Wyoming water development commission is
1245		-	hereby authorized to transfer four million two hundred
1246		-	thousand dollars ($4,200,000.00) from water development
1247		-	account I created by W.S. 41-2-124(a)(i) to water
1248		-	development account II created by W.S. 41-2-124(a)(ii).
1249		-	(b) In accordance with W.S. 41-2-115(b), upon a
1250		-	finding that the transfer of test wells, Belvoir No. 5 and
1251		-	Belvoir No. 6, developed as part of the level II
1252		-	feasibility study authorized under 2004 Wyoming Session
1253		-	Laws, Chapter 34, Section 4, to the Cheyenne Board of
1254		-	Public Utilities (BOPU) is desirable and in the public
1255		-	interest and that BOPU is capable of constructing,
1256		-	operating and maintaining the project and accomplishing the
1257		-	public interest, the water development commission shall
1258		-	transfer to BOPU test wells, Belvoir No. 5 and Belvoir No.
1259		-	6, developed as part of a level II feasibility study for
1260		-	further development by BOPU, provided agrees to terms
1261		-	outlined by the commission for reimbursement of the expense
1262		-	of predevelopment costs, an amount which shall be not less
1263		-	than two hundred eighteen thousand dollars ($218,000.00),
1264		-	payment for property and assurances of construction,
1265		-	operation and maintenance of the test wells, Belvoir No. 5
1266		-	and Belvoir No. 6 in compliance with all applicable state

1273		-	(a) The state engineer's office is authorized up to
1274		-	one (1) full-time position in the board of control division
1275		-	for the period beginning with the effective date of this
1276		-	act and ending June 30, 2026 for a natural resources
1277		-	program supervisor. It is the intent of the legislature
1278		-	that the state engineer's office include this full-time
1279		-	position in its standard budget request for the immediately
1280		-	succeeding fiscal biennium.
1281		-	(b) There is appropriated one hundred fifty-six
1282		-	thousand three hundred twenty dollars ($156,320.00) from
1283		-	the general fund to the state engineer's office for the
1284		-	period beginning with the effective date of this act and
1285		-	ending June 30, 2026 to be expended only for purposes of
1286		-	funding the position authorized in subsection (a) of this
1287		-	section. This appropriation shall not be transferred or
1288		-	expended for any other purpose and any unexpended,
1289		-	unobligated funds remaining from this appropriation shall
1290		-	revert as provided by law on June 30, 2026.
1291		-	(c) This section shall not be effective if 2025 House
1292		-	Bill 0001 or 2025 Senate File 0001 is enacted into law and
1293		-	authorizes the position authorized in subsection (a) of
1294		-	this section.
1295		-	Section 6.
1296		-	(a) There is appropriated one hundred forty-eight
1297		-	thousand dollars ($148,000.00) from the general fund to the
1298		-	state engineer's office for updating the technology used
1299		-	for the accounting system that calculates the natural flow
1300		-	of the North Platte River. This appropriation shall not be

1311		-	is enacted into law, the appropriation in subsection (a) of
1312		-	this section shall be reduced by one dollar ($1.00) for
1313		-	every one dollar ($1.00) appropriated to the state
1314		-	engineer's office for updating the technology used for the
1315		-	accounting system that calculates the natural flow of the
1316		-	North Platte River in 2025 Senate File 0001 or 2025 House
1317		-	Bill 0001.
1318		-	Section 7. The office of state lands and investments
1319		-	shall investigate opportunities to, and subject to the
1320		-	approval of the board of land commissioners shall, exchange
1321		-	public lands for private lands around the LaPrele dam and
1322		-	reservoir to increase public access to, and recreational
