229+12 progress payments for no more than fifty percent (50%) of

233+16 resource management entity shall certify that the proposed
234+17 small water development project will meet expectations and
235+18 that appropriate engineering standards, as approved by the
236+19 commission, will be adhered to;

246+4 from the provisions of the Wyoming Administrative Procedure

250+8 (F) W.S. 16-6-116 shall not apply to a
251+9 small water development project unless the project sponsor
252+10 determines the small water development project meets the
253+11 definition of a "public work" as defined in W.S.

276+9 the legislative stabilization reserve account to water
277+10 development account I which shall be further appropriated

281+14 of this subsection. Of this appropriation, one million
282+15 dollars ($1,000,000.00) is appropriated for water
283+16 exploration to determine the placement of one (1) or more
284+17 wells or other water projects within the LaPrele Irrigation
285+18 District pursuant to paragraph (iii) of this subsection and
286+19 the remaining nineteen million dollars ($19,000,000.00) is
287+20 appropriated as a loan for a term of thirty (30) years that
288+21 shall have an interest rate of two percent (2%) interest
289+22 per annum to the LaPrele Irrigation District for the design

294+2 served by the LaPrele Irrigation District. Unexpended funds
295+3 appropriated under this subsection shall revert to the
296+4 legislative stabilization reserve account on July 1, 2030;

298+6 (vi) Special conditions: The Wyoming Water
299+7 Development Office shall investigate the feasibility of
300+8 developing groundwater to meet the needs of water rights
301+9 holders within the LaPrele Irrigation District whose rights
302+10 have been affected by the required breach and replacement
303+11 of the LaPrele Dam. The office shall assess whether
304+12 drilling and constructing wells or other water projects
305+13 within the project budget is likely to significantly
306+14 supplement the available water. Upon a determination by the
307+15 Water Development Commission that there is a reasonable
308+16 likelihood of successful development, the office shall
309+17 proceed with the construction of the wells or other water
310+18 projects.

1253-Laws, Chapter 34, Section 4, to the Cheyenne Board of
1254-Public Utilities (BOPU) is desirable and in the public
1255-interest and that BOPU is capable of constructing,
1256-operating and maintaining the project and accomplishing the
1257-public interest, the water development commission shall
1258-transfer to BOPU test wells, Belvoir No. 5 and Belvoir No.
1259-6, developed as part of a level II feasibility study for
1260-further development by BOPU, provided agrees to terms
1261-outlined by the commission for reimbursement of the expense
1262-of predevelopment costs, an amount which shall be not less
1263-than two hundred eighteen thousand dollars ($218,000.00),
1264-payment for property and assurances of construction,
1265-operation and maintenance of the test wells, Belvoir No. 5
1266-and Belvoir No. 6 in compliance with all applicable state

1273-(a) The state engineer's office is authorized up to
1274-one (1) full-time position in the board of control division
1275-for the period beginning with the effective date of this
1276-act and ending June 30, 2026 for a natural resources
1277-program supervisor. It is the intent of the legislature
1278-that the state engineer's office include this full-time
1279-position in its standard budget request for the immediately
1280-succeeding fiscal biennium.
1281-(b) There is appropriated one hundred fifty-six
1282-thousand three hundred twenty dollars ($156,320.00) from
1283-the general fund to the state engineer's office for the
1284-period beginning with the effective date of this act and
1285-ending June 30, 2026 to be expended only for purposes of
1286-funding the position authorized in subsection (a) of this
1287-section. This appropriation shall not be transferred or
1288-expended for any other purpose and any unexpended,
1289-unobligated funds remaining from this appropriation shall
1290-revert as provided by law on June 30, 2026.
1291-(c) This section shall not be effective if 2025 House
1292-Bill 0001 or 2025 Senate File 0001 is enacted into law and
1293-authorizes the position authorized in subsection (a) of
1294-this section.
1295-Section 6.
1296-(a) There is appropriated one hundred forty-eight
1297-thousand dollars ($148,000.00) from the general fund to the
1298-state engineer's office for updating the technology used
1299-for the accounting system that calculates the natural flow
1300-of the North Platte River. This appropriation shall not be
