32	28		4 (a) As used in this section, "sexually explicit
33	29		5 event" means any show, exhibition or presentation before an
34	30		6 audience that lewdly or lasciviously depicts or simulates
35	31		7 nudity, sexual conduct, sexual excitement, prosthetic or
36	32		8 imitation genitals or breasts, subject to determination by
37	33		9 the entities specified in subsection (c) of this section.
38		-	10 "Sexually explicit event" shall include drag queen events.
39		-	11 "Sexually explicit event" shall not include age appropriate
40		-	12 sexual education instruction at the primary, secondary,
41		-	13 undergraduate or graduate level.

43		-	15 (b) No executive, legislative or judicial branch
44		-	16 agency, department or institution, nor any city, town,
45		-	17 county or political subdivision, including the University
46		-	18 of Wyoming, the community colleges and school districts,
47		-	19 shall use state or federal funds, personnel, facilities or
48		-	20 equipment to sponsor or contribute to a sexually explicit
49		-	21 event.

52		-	3HB01341 (c) Upon request by the sponsor of an event, the
	34	+	10 "Sexually explicit event" shall not include age appropriate
	35	+	11 sexual education instruction at the primary, secondary,
	36	+	12 undergraduate or graduate level.

53	46		2 following entities shall determine whether an event is
54	47		3 sexually explicit:

56	49		5 (i) For all executive branch agencies, the
57	50		6 governor;

59	52		8 (ii) For the University of Wyoming, the board of
60	53		9 trustees for the university;

82	73		8 (d) In determining whether an event is sexually
83	74		9 explicit under subsection (c) of this section, the
84	75		10 following shall apply:

86	77		12 (i) A determination shall be made within thirty
87	78		13 (30) calendar days of receiving a request;

89	80		15 (ii) The requestor shall have fifteen (15)
90	81		16 calendar days after a decision regarding whether the event
91	82		17 is sexually explicit to appeal that decision; and

93	84		19 (iii) An appeal under this subsection shall be
94	85		20 considered a contested case hearing that shall be conducted
95	86		21 in the same manner as a contested case hearing under the
96	87		22 Wyoming Administrative Procedure Act.

101	90		3 shall repay the funds expended to the granting entity
102	91		4 within twenty (20) business days of the determination.
