7-AN ACT relating to the administration of government;
8-prohibiting governmental entities from engaging in any
9-diversity, equity or inclusion program, activity or policy;
10-prohibiting governmental entities engaging in institutional
11-discrimination; prohibiting required attendance for certain
12-programs or trainings; providing definitions; requiring
13-rulemaking; providing applicability; and providing for
14-effective dates.
15-Be It Enacted by the Legislature of the State of Wyoming:
16-Section 1. W.S. 9-25-101 is created to read:

20-DIVERSITY, EQUITY AND INCLUSION ACTIVITIES
21-9-25-101. Definitions.
22-(a) As used in this section:
23-(i) "Diversity, equity or inclusion" means any
24-program, activity or policy that promotes differential or
25-preferential treatment of individuals or classifies
26-individuals on the basis of race, color, religion, sex,
27-ethnicity or national origin;
28-(ii) "Governmental entity" means the state, any
29-department thereof, the University of Wyoming and any
30-county, city, town, school district, community college
31-district, other political subdivision and other public

37-2(iii) "Institutional discrimination" means any
38-of the following concepts:
39-(A) That any race, color, religion, sex,
40-ethnicity or national origin is inherently superior or
41-inferior;
42-(B) That a person should be discriminated
43-against or adversely treated because of the person's race,
44-color, religion, sex, ethnicity or national origin;
45-(C) That the moral character of a person is
46-determined by the person's race, color, religion, sex,
47-ethnicity or national origin;
48-(D) That because of a person's race, color,
49-religion, sex, ethnicity or national origin the person is
50-inherently racist, sexist or oppressive, whether
51-consciously or subconsciously;
52-(E) That by virtue of a person's race,
53-color, religion, sex, ethnicity or national origin, the
54-person is inherently responsible for actions committed in
55-the past by other members of the same race, color,
56-religion, sex, ethnicity or national origin;
57-(F) That fault, blame or bias should be
58-assigned to members of a race, color, religion, sex,
59-ethnicity or national origin, on the basis of race, color,
60-religion, sex, ethnicity or national origin;
61-(G) That any person should accept,
62-acknowledge, affirm or assent to a sense of guilt,

71-(H) That meritocracy or certain traits
72-including a hard work ethic are racist or sexist.
73-(b) No governmental entity shall:
74-(i) Engage in any diversity, equity or inclusion
75-program, activity or policy;
76-(ii) Engage in institutional discrimination;
77-(iii) Require instruction promoting
78-institutional discrimination;
79-(iv) Require any student, employee or contractor
80-to attend or participate in any diversity, equity or
81-inclusion program or training or any institutional
82-discrimination program or training.
83-(c) As a political class, classification or identity,
84-federally recognized Indian tribes and programs, trainings,
85-degrees, classes or endowments related to federally
86-recognized Indian tribes or Indian history, culture,
87-language and traditions, are not diversity, equity and
88-inclusion as defined by this section. Nothing in this
89-section shall be construed to apply to federally recognized
90-Indian tribes. For purposes of this section:
91-(i) "Federally recognized Indian tribe" means a
92-tribal government and its citizens who have an acknowledged
93-government-to-government relationship with the United

99-4(ii) Federally recognized Indian tribes and
100-their citizens shall be considered a political class,
101-classification or identity. Tribes and their members shall
102-not be considered a race or a racial classification.
103-Section 2. Not later than July 1, 2025, all
104-governmental entities as defined in section 1 of this act
105-shall take any actions required to implement this act

112-(a) Except as provided in subsection (b) of this
113-section, this act is effective July 1, 2025.
114-(b) Sections 2 and 3 of this act are effective
115-immediately upon completion of all acts necessary for a
116-bill to become law as provided by Article 4, Section 8 of
117-the Wyoming Constitution.
